Pre-proposal Inquiries (PPI) Questions & Answers

Question 21: "Size: A contract with a yearly value of at least $8,000,000 for recurring services." This requirement creates a barrier to entry for small businesses.

Would the Gov't. lower the annual contract value requirement for relevant past performance from $8M to $7M?

Answer 21: The Size requirement remains unchanged.

Question 24: The Gov't. reserves the right to acquire additional guard services at additional locations in addition to the services and locations identified in the recurring work requirements of this contract. Would the Gov't. please provide historical data on utilization (frequency, duration, location)?

Answer 24: The Government has not added any additional locations in the previous six years. The Government cannot provide a NTE in terms of frequency as this is dependent upon mission and security requirements.

Question 25: "a. Is the current incumbent workforce fully staffed at all locations?

Answer 25: The Navy does not consider information regarding the current contractor’s performance to be necessary for offerors to respond to the solicitation. Any awardee will be required to meet all contract requirements during performance of the contract.

Question 26: b. Please provide the staffing shortages, if any, by location and the level of personnel shortages.

Answer 26: See Amendment 0009 Answer #25.

Question 27: Is the current incumbent workforce qualified to all specifications at all locations, required of this RFP?

Answer 27: See Amendment 0009 Answer #25.

Question 32: "PM shall have at least five years of relevant experience in managing a workforce providing services on contracts of similar size, scope and complexity."

We recommend removing the words "on contracts" as this is over restrictive and eliminates veteran personnel with viable military (or civilian) security forces management experience who may not have been employed by a federal government contractor. Additionally, the process of clearing veteran personnel reduces staffing risks to the Gov't.

Answer 32: As stated in Section C, Annex 0200000, Spec Item 2.7.1.1, “the PM has full authority to act for the Contractor on all contract matters relating to this contract” and that they are “the senior contractor employee outside of the corporate level who is responsible for the overall management and operation of this contract.” As such, the requirement that the PM’s relevant experience shall have been “on contract” remain unchanged.

Question 42: Is the Gov't. going provide necessary training resources such as manuals, instructions, lesson plans, etc.?

Answer 42: The Government will provide the lesson plans for the Navy Security Guard Training Course (S- 540-1012) at time of award.

Question 52: The Contractor shall, in accordance with FAR Clause 52.222-17 entitled “Non-Displacement of Qualified Workers” (May 2014). The Contractor shall, by the end of the phase-in period, meet all of the requirements specified in Section J-0401000 Attachments. This includes all security guards currently working on the contract. No employees are “grandfathered” from any contract requirement.

All Contractor personnel providing guard services shall meet the following minimum training requirements prior to being assigned to guard duties. All Training certificates shall be kept current and maintained with the Data Housing and Report Tool (DHART) and submitted to the COR and SPAR upon request to document training has been completed in accordance with DODI 5525.15, CNICINST 5530.14A, CNIC M 3502.2. The four-week Navy Security Guard Training Course (NSGTC) (S-540-1012) is the standard curriculum for CNIC contract security guards and is the only course authorized for initial training of Navy Security Guards. This course will not be grandfathered.

Question 52a. In order to level the bidding opportunity and ensure price fairness, Would the Gov't please clarify if it is their intention for the awardee to RETRAIN all of the incumbent work force as if they are all new employees during the transition period?

If that is the intent, we do not believe it would be feasible to do so in a 90-day period."

Answer 52a. All Guards are required to be trained under the new contract. As such, any incumbent work force is also required to meet the Section J-0401000 Attachments requirements (which includes a revised Attachment J-0401000-12), as if there were new employees; no Guards training is grandfathered. The new Contractor is required to conduct training in accordance with the training requirements listed in the contract.

Question 52b. Without knowing the actual training record for each incumbent person, Offerors are unable to appropriately price training needs.

Would the Gov't please provide a master certification list with dates for incumbent’s staff, without including names?"

Answer 52b. See Amendment 0009 Answer #52a. Any incumbent work force is also required to meet the Section J-0401000 Attachments requirements as if there were new employees; no Guards training is grandfathered.

Question 58: Two instances of NNSY Portsmouth appear in the referenced attachment, one under REGION (CNIC) and the other under NAVSEA.

Would the Gov't. please clarify how Offerors are to distinguish between the two funding sources in terms of post staffing requirements?

Answer 58: See Amendment 0005, Attachment J-0401000-02 Post Manning Requirements Summary. The requirements are identified for each funding source. The Post Manning Requirements Summary, Attachment J-0401060-02, identifies the requirements for REGION (CNIC) under the title “NNSY PORTSMOUTH” and the requirements for NAVSEA under the title “NAVSEA NNSY PORTSMOUTH.”

Question 69: Of the estimated 7,700 hours for Special Events and 7.700 hours for Special Guard Services, how many hours were ordered for each year of this current contract?

Answer 69: The Government does not have this information to provide. Special event, world events, all vary depending on what the installation requires at that time. It is all based on mission requirements, world events, FPCON changes, as they arise.

Question 70: What make, and model land mobile radio is used by military police and local Government police at each of the supported locations? 2. How many radios are required? 3.Will contractor require separate FCC licensing or is this requirement waived by virtue of operating on the NAVFAC’s net?"

Answer 70: See Amendment 0009 Section C, Revised Annex 0401000 C - Force Protection, Spec 2.3.2.

Communications Equipment.

Question 71: The RFP requires contractors to have a SECRET Clearance prior to award. As an unpopulated joint venture, where one partner is cleared, we want to bring forward the following regulations regarding unpopulated JV clearances to confirm we can submit a compliant response. Reference: 13CFR121.103 (5) - "A joint venture may be awarded a contract requiring a facility security clearance where either the joint venture itself or the individual partner(s) to the joint venture that will perform the necessary security work has (have) a facility security clearance". Given the information in 13CFR121.103 along with the conclusion and recommendation of GAO (InfoPoint - B-419856): a. Will the government accept the clearance of an SBA MPA 8(a) JV partner (issuing that partner the DD-254) for those positions requiring a cleared individual?

Answer 71: The DD254 must be issued to the prime contractor. If the prime contractor is a JV, the DD 254 must be issued to the JV.

Question 75: Can the government provide a post exhibit for this effort?

Answer 75: This question does not contain sufficient information or context in order for the government to provide a response. Specifically, it is unclear what the term “post exhibit” means in this question. Please clarify the question and provide additional context if a response is still desired.

Question 76: Can the government provide the number of NSGTC academies in the previous FY by location?

Answer 76: The Government does not have this information to provide. The contractor is responsible for providing NSGTC training, therefore the incumbent contractor maintains this information.

Question 77: If the government is not willing to provide by location, can you provide the overall number of academies in the previous FY.

Answer 77: See Amendment 0009 Answer #76.

Question 93: At (2), Clause 52.215-1 provides a list of what the first page of the proposal must show. Please clarify whether this must appear on the cover/title page of each volume or may it be included in the offeror’s cover letter.

Answer 93: In accordance with FAR Clause 52.215-1 this information shall be included on the first page of the proposal. Since proposals are to be submitted electronically, the information required by FAR Clause 52.215-1 shall be included on the first page of the Price volume electronic file and Non-price volume electronic file, respectively.

Question 108: Is the Transition ELIN CLIN for all Transition costs, or only the cost of the training and equipment upgrade from shotguns to AR-15? What does the 2% per month refer to?

Answer 108: See Amendment 0009 revised Attachment J-0200000-05 – ELINs. The “(90-DAY) PHASE-IN PERIOD” ELINs are provided to capture all phase-in costs the Offeror incurs in order to meet contract requirements to start all services on the first day of the contract performance period. As it relates to the 2% per month, this information was included in error and has been removed; see revised Attachment J-0200000- 05 – ELINs.

Question 110: Per Section C Annex, Contractors are to provide Land Mobile Radios; what are the requirements and specifications for the Land Mobile Radios (Manufacturer, model number, UHF Range, MHz, cost, etc.).

Answer 110: See Amendment 0009 Answer #70.

Question 111: How many Land Mobile Radios are required per location?

Answer 111: See Amendment 0009 Answer #70.

Question 112: Annex, 0401000 Force Protection, item 3, requires contract guards to participate in a 30-minute Navy Guard Mount at the beginning of each shift. It further states that "on-post" hours do not include the guard mount, arming, disarming, or transportation to and from assigned posts. What is the average additional time per post or location for these activities, that are in addition to the 30 minutes?

Answer 112: The distance between posts varies for each location. Additionally, arming and disarming varies based on number of personnel disarming and arming.

Question 116: Can the government provide information for the number of vehicles needed for each site and the number of estimated miles per year per vehicle? Is there a required type of vehicle (ex: pickup, sedan, SUV, 4x4, etc.)? Also is there a required year, age, or mileage of the vehicle (it cannot be beyond a 2020 model with over 50,000 miles).

Answer 116: See Amendment 0009 revised Section C, Annex 0200000, Spec Item 2.8.2 – Vehicles.

Question 117: Please advise if the plan includes annual drug testing for each of the SOs? Will the Government please identify the drug screen panel required to comply with this standard i.e. five or seven-panel drug screen?

Answer 117: See Amendment 0009 revised Section C, Annex 0200000, Spec Item 2.9.3.1. Alcohol and Drug Abuse Prevention Plan.

Question 119: Radios. Since the contractor's radio equipment must be compatible with the current communication equipment, can the government provide information on your current system and if land mobile radios are assigned per Security Officer or per Post? Is the Contractor radio net separate from the Government radio net, or will the Contractor connect to the existing Government radio net used for this contract?

Answer 119: See Amendment 0009 Answer #70.

Question 120: Please advise what is the model and type of firearms that the current Security Officers are carrying at each site.

Answer 120: See Amendment 0009, a revised Annex J-0401000- Attachment J-0401000-15 -Weapons, for Firearms requirement.

Question 124: Please advise if parking is available on-site for contractor employees and a company vehicle.

Answer 124: Parking is available at all site locations for contractor employees and company vehicles.

Question: 131: Can the government confirm the operating frequency/MHz the radios need to operate within?

Answer 131: See Amendment 0006, Answer #70.

Question 132: "IAW the DOL’s Executive Order (EO) 14055, Non-displacement of qualified personnel guidelines, contractors must offer first right of refusal of employment on the successor contract (i.e. the existing guards, corporals, sergeants, lieutenants). The Lieutenants labor category is listed on the CBA. However, Section C Annex

2.7.1 lists Lieutenants as Key Personnel, which conflicts with the CBA. The incumbent has exclusive access to personnel in these bargaining unit positions, making it impossible for non-incumbent bidders to adequately source personnel for these positions.

In order for bidders to comply with both the EO and the CBA, the RFP should be revised by removing Shift Supervisors/Lieutenants from Key Personnel."

Answer 132: The Key Personnel requirements of Section C Annex 0200000, Spec Item 2.7.1 Key Personnel, remain unchanged.

Question 133: Section L.5 says Arial or Times New Roman font is required. Please confirm that Arial Narrow is acceptable.

Answer 133: See Amendment 0006 for the revised L.5 Content of Proposal: L.5.a. the font requirement remains the same.

Question 134: At (2), Clause 52.215-1 provides a list of what the first page of the proposal must show. Please clarify whether this must appear on the cover/title page of each volume or may it be included in the offeror’s cover letter.

Answer 134: See Amendment 0009, Answer #93

Question 135: The solicitation states that “the attached Corporate Experience Data Sheet (Attachment C) is MANDATORY” but is not included in solicitation documents. Please provide Attachment C.

Answer 135: See Amendment 0005, revised Section J, J-0200000-06.

Question 136: The solicitation states that “IF THERE ARE NO CPARS EVALUATIONS, the Past Performance Questionnaire (PPQ) included in this solicitation is provided” but is not provided within the solicitation documents.

Please provide the PPQ attachment.

Answer 136: The PPQ attachment has been provided in the original RFP Section J, Attachment J-0200000-07, and subsequent Amendment 0004 and 0005, Attachment J-0200000-07.

Question 137: PWS Section C states, “Contractors shall submit a List of Key Personnel and Qualifications along with associated resume per Section F.” Section F requires Contractors to provide a list of key personnel and qualifications within 15 calendar days after award but does not mention resume requirements. Please confirm if Offerors are to provide resumes within their proposal or if resumes are only required with the list of key personnel and qualifications within 15 calendar days after award. If resumes are to be provided at proposal submission, please consider excluding resumes from page limitations.

Answer 137: Offerors are not required to provide resumes with this proposal.

Question 138: Post orders states, “Note: The Posts that are required to be staffed are identified in J-0401060-02” but are not provided in solicitation documents. Please provide Offerors section J-0401060-02.

Answer 138: See Amendment 0005, revised Section J-0401000, Attachment J-0401000-02 Post Manning Requirements Summary

Question 139: The RFP requires the proposal to be formatted as an 8 ½ x 11-inch page layout. Please consider allowing Offerors to provide 11 x 17-inch page layouts but to be counted as two pages for deliverables such as charts, schedules, graphics, etc.

Answer 139: The proposal formatting requirements remain unchanged.

Question 140: No seniority list is provided. Please provide a seniority list for each site.

Answer 140: See Amendment 0005 revised Section J 0200000, Attachment J-0200000-02 which incorporates the Seniority List for the USS Constitution & NSA Philadelphia. See Amendment 0009, revised Section J 0200000, Attachment J-0200000-02 for all other locations.

Question 141: "The four-week Navy Security Guard Training Course (NSGTC) (S-540-1012) is the standard curriculum for CNIC contract security guards and is the only course authorized for initial training of Navy Security Guards. This course will not be grandfathered.

Will the USG confirm that all personnel currently working on the contract have received this training?

Answer 141: All Guards are required to be trained under the new contract. As such, any incumbent work force is also required to meet the Section J-0401000 Attachments (which includes a revised Attachment J-0401000-12), requirements as if there were new employees; no Guards training is grandfathered. The new Contractor is required to conduct training in accordance with the training requirements listed in the contract.

Question 142: Factor 2, Corporate Experience, states “The Government will not consider information submitted in addition to this form (Corporate Experience Data Sheet) nor will the Government consider information submitted via any other medium” and then further down the requirements states “If an Offeror is utilizing experience information of affiliates/subsidiaries/parent /LLC/LTD member companies, the proposal shall clearly demonstrate that the affiliate/subsidiary/parent member companies will have involvement in the performance of the contract in order for the experience information of the affiliate/ subsidiary/parent.. member companies to be considered Failure to submit this information may result in a lower rating.”

Request the Government allow Offerors to provide a Corporate Experience/Affiliate discussion in Factor 2, and allot five additional pages for this narrative

Answer 142: The paragraph in Factor 2 beginning with “The attached Corporate Experience Data Sheet (Attachment C)…” is specific to the contract information required to be included in the Corporate Experience Data Sheet. The requirements and restrictions in that paragraph are not applicable to the paragraph in Factor 2 beginning with “If an Offeror is utilizing experience information of affiliates/subsidiaries/parent /LLC/LTD member companies.” Other than the overall 100-page limit for the non-cost/price proposal, there is no additional page limitation associated with the paragraph in Factor 2 beginning with “If an Offeror is utilizing experience information of affiliates/subsidiaries/parent /LLC/LTD member companies.

Question 143: "Pg. 5, B.15, "When receiving GPC orders against Section B, the contractor shall provide the supplies and services at the offered price without additional markup or handling fee."" " Please provide an estimate of the dollar value of services that have been purchased by GPC on the current contract.

Answer 143: There were not armed guard services ordered using the GPC on the current contract.

Question 144: ELINS-1st Opt. -Recurring, Column H. Please specify what data is meant to be placed in the CAC column.

Answer 144: See Amendment 0009 and revised Attachment J-0200000-05 – ELINs.

The Lieutenants labor category is listed on the CBA. However, Section C Annex

2.7.1 lists Lieutenants as Key Personnel, which conflicts with the CBA. The incumbent has exclusive access to personnel in these bargaining unit positions, making it impossible for non-incumbent bidders to adequately source personnel for these positions.

In order for bidders to comply with both the EO and the CBA, the RFP should be revised by removing Shift Supervisors/Lieutenants from Key Personnel.

B.6 Wage Determination (Service)

Service Contract Labor Standards (formerly Service Contract Act (SCA), wages are included in this solicitation. Refer to Section J, Attachments.

Service Contract Labor Standards formerly SCA (Wage Determination No.2015-4047 Rev. 27 Massachusetts; No.: 2015-4230 Rev. 30 Philadelphia. No.: 2015-4341 Rev. 27 North Carolina and Virginia, and 2015-4195 Monmoth New Jersey, shall be used for wage rates and fringe benefits for FSC services that are not covered in the current CBA. The Service Contract Labor Standards Wage Determination incorporated in Section J is for the Base Year performance period only. The latest Wage Determination available at the time each option is exercise will be incorporated into the contract. Unit prices will ONLY be adjusted for the Service Contract Labor Standards wage increases in accordance with FAR Clauses 52.222-43, Fair Labor Standards Act and Service Contract Act – Price Adjustment and FAR Clause 52.222-55 Minimum Wages for Contractor Workers Under Executive Order 14026. The contractor warrants, by submission of his proposal, that the price does not include any contingency for future Service Contract Act related wage increases.

Collective Bargaining Agreements (CBA) 2024-351 NWS Earle, New Jersey, 2024-352 Norfolk Virginia, 2024-354 USS Constitution, Massachusetts, and NSA Philadelphia, PA, shall be used for wage rates and fringe benefits for services set forth in the current Collective Bargaining Agreement and any modified extension agreement(s). Refer to Section J Attachments.

B.7 Bid Guarantee/Bonding Requirements:

B.8 Contract Term:

This contract contains provisions for a Base Period with four 12 mnth Option Periods, and one(1) six-month Option period, not to exceed a total of sixty-six (66) months. The Government has the option to extend the term of the contract in accordance with Section I, Contract Clauses, 52.217-9, Option to Extend the Term of the Contract-Services (Mar 2000). In the option periods, the Government will adjust the prices, if applicable, based on the new Department of Labor Wage Determination.

B.9 Period of Performance:

The period of performance will be determined at the time of award.

B.10 Evaluation of Proposal: Proposers shall submit a lump sum price for Section B, CLINs 0001 through 0012 and unit prices for Exhibit A through Exhibit F, referenced in Section J. For purposes of evaluating offers for award, the Government will utilize the pricing submitted for the base year and all option periods. Refer to Section M, FAR 52.217-5, Evaluation of Options (JUL 1990).

B.11 Contract Line Items and Contract Exhibit Line Items

a. Proposers shall enter unit prices and amounts for Contract Line Items (CLINs) and Contract Exhibit line items (ELINs) as indicated in the schedules and accompanying exhibits.

b. In the event there is a difference between a unit price and the extended total amount, the unit price will be held to be the intended bid and the total of the CLIN, the ELIN will be recomputed accordingly. The CLIN will also be recomputed to take into account the change in the contract ELINs. If the offeror provides a total amount for an ELIN, but fails to enter the unit price, the total amount divided by the ELIN quantity will be held to be the intended unit price.

c. The Schedule of Recurring Work (CLIN 0001, 0003, 0005, 0007, 0009 and 0011) and the Schedule of

Non-Recurring Work (CLIN 0002, 0004, 0006, 0008, 0010 and 0012) will be used as the basis for deductions in accordance with FAR Clause 52.246-4, Inspection of Services – Fixed Price, Section E.

B.12 Indefinite Quantity Individual Contract Line Item Quantities

The overall maximum dollar value/overall maximum not-to-exceed (NTE) amount of the contract is the total dollar value of the recurring services and non-recurring services for all CLINS for the base period and all option periods. Once the estimated quantities for individual line items shown in the Schedule have been ordered, additional quantities may be ordered as long as the overall NTE amount of the contract is not exceeded and the Contractor agrees by signing the task order. The overall NTE amount shall not be exceeded except as may be provided by formal modification to the contract.

B.13 Unit Prices For Labor

a. A portion of the work included in the scope of this contract cannot be identified in advance in sufficient detail to be as a Unit Price Task in this contract. Labor for this work will be ordered and paid for based on unit prices for labor proposed by the Contractor listed in the Schedule of Non-Recurring Quantity Work. This contract includes the requirement for a Service Contract Act composite rate and a CBA composite rate.

b. Estimated hours in the Schedule are a forecast of future requirements. These estimated hours are for performing "Non-Recurring Quantity Work” accomplished in the time period shown.

c. The Contractor shall enter, in the above described unit price proposal space, the unit price for performing composite labor respectively. The composite labor price shall include all direct and indirect costs associated with performing an hour of work. The composite labor price should be the Contractor's hourly craft wage adjusted to allow for the offerors work force productivity (i.e., the Contractor's estimate of how its’ work force will perform in relation to the Means Facilities Cost Data and/or the Engineered Performance Standards). The Composite Labor Rate shall include all costs for preparation of the cost proposal, job preparation, travel, pre- expended bin materials and supplies, ordering and stockpiling job material, additional material handling, items of equipment necessary to perform work (I.e.

bucket truck, lifting equipment, staging, etc.), profit, tools, equipment, field and home office overhead, clerical support, supervision, inspection, fees, taxes, licenses, bonds, permits, insurance, etc.

B.14 Period Of Performance – Less than One Year

Offer shall be submitted with the assumption that the performance of work during the base year will be for a period of one year. The contractor is cautioned to recognize that the initial term of the contract may be for a period of less than one year in accordance with the “Term of Contract” clause in Section F. In the event that the period of performance is less than one year, the Government will reduce the individual line item quantities to reflect work remaining in the contract term and no other adjustments to the pro-rated contract price will be made.

B.15 Government Purchase Card

Non-Recurring quantity work may be ordered at the prices offered by two ways: 1) by the issuing activity using a DD Form 1155 “Order for Supplies and Services”; 2) by an authorized Government user via a Government Purchase Card (GPC). When receiving GPC orders against Section B, the contractor shall provide the supplies and services at the offered price without additional markup or handling fee.

B.16 Contractor Support of Electronic Facilities Support Contracting (e-FSC)

This procurement allows for the use of FEDMALL for issuing orders. Refer to Section H, Special Contract Requirement. The contractor is required to be fully registered and able to accept non-recurring work orders through FEDMALL within 30 days of the base period of performance start date.

B.17 Incorporation of Technical Proposal

a. The Contractor’s technical proposal, including revisions and amendments made prior to contract award and a copy of which is in the possession of both parties, will be incorporated into this contract upon award by reference with the same force and effect as if set forth in full text. All contractor personnel shall meet or exceed the qualification standards, experience levels, and trade backgrounds set forth in the technical proposal.

b.In the event of an inconsistency between the provisions of this contract and the technical proposal, the inconsistency shall be resolved by giving precedence in the following order: (i) the contract (excluding the technical proposal), and then (ii) the technical proposal.

B.18 Request For Proposals (RFP) Information/Clarification Questions

Contractors are required to review the entire solicitation package before submitting questions. All questions must be submitted by email to susan.c.roberts4.civ@us.navy.mil at least 10 days before proposals are due, or the Government may not respond. This is the most efficient way to ensure all questions are addressed in a timely manner.

B.19 Request for Proposal (RFP) Files:

Solicitations are posted to the Contract Opportunities website (https://www.sam.gov) as mandated by our Agency. By necessity, these files are protected to prevent unauthorized editing.

It is the sole responsibility of the offeror to obtain the RFP files, along with any amendments, from this website.

B.20 Solicitation

This solicitation incorporates by reference a Performance Work Statement (PWS) developed by using NAVFAC performance-based specifications. The PWS consists of Annexes 1, 2, and 4. The contractor will be required to meet the specifications in those Annexes per Section C of this solicitation.

B.21 Notice to Offerors:

Offerors are required to submit Section B, Contract Line Items (CLINs) Schedule, and Section J, Exhibit Line Items (ELINs) with their proposal. The total of the CLIN is equal to the sum of the ELINs as shown below:

B.22 Proposal Delivery

In response to this request for proposal, the complete proposal shall include the Price Proposal and the Non-Price Factors Proposal, submitted in accordance with the Basis of Evaluation and Submittal Requirements for each Factor. Offerors shall submit an electronic copy of the proposal in accordance with the instructions below by the proposal due date.

Offerors shall only submit electronic proposals (.pdf and .xlsx format) at https://piee.eb.mil in response to this solicitation. Only the Procurement Integrated Enterprise Environment (PIEE) Solicitation Module is authorized for the submission of electronic proposals in response to this solicitation. Proposals sent via a commercial carrier, such as Federal Express, hand carried or submitted electronically (i.e. via email) using other than the PIEE Solicitation Module will NOT be accepted.

Electronic proposal submissions should be no larger than 1.9 GB per file. Offerors shall ensure that the Government has received the electronic proposal prior to the date and time specified. PIEE Solicitation Vendor Access Instructions are provided via Attachment J-0200000-09. Offerors shall allow adequate time to upload files which may be slower for non-DoD users and to avoid other technical difficulties that may be encountered.
