About this file
This is a Justification and Approval (J&A) document from Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC MIDLANT) seeking to limit competition by using brand name specifications for Facility Related Control Systems (FRCS) as part of construction project N4008524R2531 at Marine Corps Air Station Cherry Point, North Carolina.
The J&A specifically requests approval to use Cisco network controls (C9200CX-8P-2X2G Network Switch, Cisco Network Advantage Software License, and GLC-LX-SM-RGD Fiber SFP Transceiver) that are compatible with the existing Johnson Controls International Metasys system. This standardization is required to maintain cybersecurity requirements, operational effectiveness, and maintenance efficiencies for the new Marine Aviation Logistics Squadron 14 engine maintenance facility and Marine Aircraft Group 14 Headquarters building. A sources sought notice published on December 14, 2023 yielded zero responses. The work requires completion within 1,095 days after award and will be funded by FY24 Military Construction funds. The authority cited is 10 U.S.C. 3204(a)(1) for other than full and open competition.

DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEERING SYSTEMS COMMAND, MID-ATLANTIC
9324 VIRGINIA AVENUE
NORFOLK, VIRGINIA 23511-3095
J&A No. ML-2 -
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
The contracting activity is Naval Facilities Engineering Systems Command, Mid-Atlantic
(NAVFAC MIDLANT).
2. Description of the Action Being Approved.
The Government seeks to limit competition by using brand names and restrictive specifications to standardize the Facility Related Control Systems (FRCS) as part of a project to construct a new Marine Aviation Logistics Squadron 14 (MALS-14) engine maintenance facility, a new Marine Aircraft Group 14 (MAG-14) Headquarters building at Marine Corps Air Station (MCAS) Cherry Point, North Carolina. This Justification and Approval (J&A) seeks to use restrictive specifications and brand names to limit competition to the following network controls that are compatible to the existing Authority to Operation (ATO) FRCS system: Network Switch, C9200CX-8P-2X2G, Cisco Network Advantage, Software License, 3-year term, and Cisco Fiber SFP Transceiver, GLC-LX-SM-RGD.
3. Description of Supplies/Services.
Reference is made to NAVFACINST 11000.2 (FACILITY RELATED CONTROL SYSTEM STANDARDIZATION). Paragraph 3 of this instruction states, “[a]ll Navy and Marine Corps installations will, for all new construction and renovation projects going forward, standardize FRCS per function (and/or special area), at a given installation, eliminating disparate systems in order to” improve cybersecurity, increase operational effectiveness and consistency, and achieve maintenance efficiencies, among other things. The intent of the underlying solicitation N4008524R2531 for P226 is to construct a maintenance facility and MAG HQ which includes an engine maintenance shop facility, headquarters administration facility, and renovation.
The Energy Management Control Systems (EMCS) at MCAS Cherry Point is a DDC Johnson Controls International (JCI) Metasys system. The Metasys Media Redundancy Protocol (MRP) controllers are connected by Cisco network controls, which include a C9200CX-8P-2X2G, with software license, network switch and GLC-LX-SM-RGD Fiber SFP Transceiver. These will be required for all projects that require a connection to the identified installation networked facilities control and monitory systems FRCS which include Network Control Modules, Network Appliance Engines, Extended Digital Controllers, Variable Air Volume Modular Controllers, Unitary Controllers, and Field Equipment Controllers. The requirement to use the above stated equipment is so that all controllers can be programmed from a single central station versus a hybrid system composed of many different controllers and associated configuration/ programming software. Identification of these specific brand-name controllers does not restrict who can install, commission, test, maintain, or operate the controllers, and there are several known sources who can provide such services.
The estimated value of the brand name supply that is the subject of this J&A is (approximately of the estimated contract cost). The project will be funded by FY24 Military Construction (MILCON) funds for construction. The work under this contract is required to be completed within 1,095 days after award.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority for this acquisition permitting other than full and open competition is 10 U.S.C. 3204(a)(1) which permits the use of limited suppliers when it is essential to the Government’s requirements, as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
MCAS Cherry Point, NC, needs standardization and interoperability of its existing building control systems that requires a connection to the identified installation networked facilities control and monitoring system commonly referred to as Utility Monitoring and Control Systems (UMCS). MCAS Cherry Point, NC, finalized a rigorous business case analysis in January 2020 on the existing inventory of building control systems connected and not connected to the UMCS to assess the need for standardization and interoperability, as required by NAVFACINST
11000.2 (FACILITY RELATED CONTROL SYSTEM STANDARDIZATION). This business case analysis evaluated the standardization of building Heating, Ventilation, Air Conditioning (HVAC) programmable controllers and quantified the annual cost associated with procurement, sustainment of operations and maintenance (O&M), and establishment and sustainment of Department of the Navy cybersecurity requirements. The results of this business case analysis demonstrate that, to maintain existing cybersecurity posture of the Authority to Operate (ATO) per Department of Defense Instruction 8510.01 and increase operational effectiveness and consistency, the use of Cisco systems equipment compatible to the JCI programmable building controllers will be required for all projects that require a connection to the FRCS. Utilizing hardware products from the same vendors eliminates multi-vendor disputes regarding conflicts, standards, protocols, or performance characteristics should the controller not function as required. Standardization reduces personnel training costs and decreases procurement costs related to additional equipment, maintenance, and support contracts for another manufacturer’s hardware and software, as well as the maintenance of an additional parts inventory. Maintaining multiple solutions is inefficient and creates unnecessary work and overhead that increases the total costs of ownership and manpower costs. The life cycle cost analysis shows that the expected cost required to utilize multiple control manufacturers for a single operator front-end interface system is approximately annually. The equipment requested is valued at
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A sources sought notice was published on 14 December 2023 and yielded zero (0) responses.
The notice closed on 28 December 2023. The solicitation will be publicized on SAM.gov, in accordance with the requirements of FAR Part 5. The approved J&A will also be made publicly available as required by FAR 6.305.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will determine that the price for this acquisition is fair and reasonable in accordance with FAR Part 15 prior to contract award. Analysis will be performed by one or more of the following techniques: (1) Comparison of proposed prices received in response to the RFP;
(2) Comparison of proposed prices with the Independent Government Cost Estimate (IGCE); (3) Comparison of proposed prices with available historical information; and/or (4) Comparison of market survey results. The fair and reasonable determination will be made based on the total price of the project. These brand name items are not individual line-item prices in the solicitation.
8. Actions to Remove Barriers to Future Competition
For the reasons set forth in Paragraph 5, this is a one-time exception to full and open competition. There are no plans at this time to compete future contracts for the supply covered by this document. If another potential source emerges, NAVFAC Mid-Atlantic will assess whether competition for future requirements is feasible.
