and Scope of
Services
Can the Government confirm that the following statement will be addressed as a possible design change if found "The scope of services did not include an environmental assessment for determining the presence or absence of wetlands or hazardous or toxic material in the soil, bedrock, surface water, groundwater or air, on or below or around this site."?
Based on the information we have we do not anticipate hazardous, toxic material or wetlands, however, MIDLANT needs to confrim that if these are found it would constitue a design change.

Factor 1 –
Management
Approach &
Schedule
Can the Government confirm that the CMP schedule required within Factor 1 -
Management Approach &
Schedule will only show the design submission as milestones? The RFP states
"Provide a detailed construction schedule that illustrates your ability to achieve or improve on the requirements of the RFP while keeping within the RFP’s requirements." and therefore does not call out the need for the design (Pre-Final and
Final Design only) to be provided in the schedule.
The schedule is for construction
(post-award), not design.
General Due to the unusually high market volatility, we request the Government provide an
Economic Price Adjustment
PENDING RESPONSE
(EPA) Clause in the Contract as an appropriate tool to equitably balance the risk of inflation between the
Government and contractor.
As communicated by the DoD
Principal Director of Defense
Pricing and Contracting
“Guidance on Inflation and
Economic Price Adjustments” memo dated 2022.05.25, an
EPA clause would enable the contractor to provide the Firm
Fixed Price (FFP) without having to develop pricing based on potential worst-case projections to cover the unstable market conditions and the potential added risk to the success of the project. The
EPA clause should consider the extended period of performance beyond 1 year due to the design-build delivery where design effort and Government review are required prior to procurement of building materials and equipment. Reference FAR
Clause 16.203-4(d) Fixed
Price Contracts with EPA, which provides for adjustments based on cost indexes of labor and material.
Adding the appropriate EPA clause will benefit the successful outcome of the project. Please confirm the
Government will provide an
EPA clause to this project.

1.4.5 Paragraph 1.4.5 indicates that
100% drawings were planned for submittal in Sept of 2022, with Final Design drawings planned for October of 2022.
The MACC General
Requirements indicate the Pre-final drawings submittal is due on 07 March 2023 and the
Final Design is due 20 April
2023. Please confirm the dates outlined in the MACC
General Requirements are the most recent.
See Amendment 003 for updates to dates.
3 MACC General
Requirements
The paragraph containing the
Period of Performance for
Preconstruction Services says that the Final Design package will be issued on 20 April
2023. The SOW requires that the contractor must provide their FTP 14 days later, which would be around May 4th
2023. The MACC General
Requirements says the construction option is anticipated for award NLT 10
November 2023. Is it possible that the construction option will be awarded sooner, or is the date of the award of the construction option contingent on other factors, such as project funding?
Contingent upon funding and acceptable pricing.
3 MACC General
Requirements
Please confirm that preconstruction services may begin on 30 December 2022 and continue until the construction option is awarded, which is currently anticipated as 10 November

Government's intent that the
ITP be escalated through 10

Government later due to guessing since there is no data available for future events.

Requirements
The MACC General
Requirements, with the amended words " See CLIN
0002" states that in accordance with FAR clause
52.216-17, the Initial Target
Ceiling Price cannot be exceeded during the negotiation for the construction modification.
This puts the contractor in the position of pricing requirements which are not known, since the design documents are currently in the
50% phase and requirements, systems, and levels of quality have not yet been established.
In addition, it allows the
Government to make decisions and product selections for work which has yet to be designed, and requires the contractor to maintain a fixed price without the possibility of price adjustment for customer initiated design changes.
Please clarify.

This is in conflict with RFP
Part 1 Final, FAR 52-216-17 in the RFP, which describes the prescribed method for adjusting the contractor's profit up or down for successive targets - the
Prefinal and Final design. If the Final Target is higher than the Initial Target, the contractor's profit is adjusted down. If the Final Target is lower than the Initial Target, the contractor's profit is adjusted up. Please clarify the above noted conflict.

This is in conflict with The
Statement of Work, Page 4, Paragraph 1.3.3.2, which requires the contractor to provide a report of variances related to cost impacts arising from design decisions, whether it relates to an increase or a decrease in costs.
1.3.3.2 correctly acknowledges that the
Government may make design decisions during
Preconstruction which will have a cost impact on the
Contractor. Please confirm that the contractor will be allowed to price customer initiated design changes, and still be awarded the construction contract even if it exceeds the Initial Target

The RFP included Attachment
G with is a Contractor
Personnel and Visitor
Certification of Vaccination.
There is a section, Consequences of Failure to
Provide Information that states, the information is voluntary however, failure to provide will be treated as not fully vaccinated with the potentil fo denied access to
DoD Facilities.
In regards to Attachment G, because of the shortage of manpower in Eastern Carolina and the competitive, non federal, markets. Contractor fear subcontractors will not pursue this work or will not execute a subcontract if successful. Therefore, contractor is requesting this attachment be deleted from the
RFP.

The project documents are requiring two of the 14' x 14' high speed coiling doors to withstand a wind load of 139 mph. To our knowledge no manufacturers of a spiral high speed overhead door can meet this wind load. Please advise if the wind load is correct for the high speed coiling doors.
139mph is the code-required ultimate design wind speed for this site.

Will any interior structural steel need to be coated per
UFGS 09 97 13.27?
This is not anticipated to be required.
We understand the timing of award, however, as a result of the saturated market the subcontracing community is requesting a two week extension to December 1st, in order to provide the most compeitive pricing and value to the government.

(Tool/Shop/A ir)
The BOD is calling for a single 7.5 hp single oil-flooded rotary screw two stage air compressor. A 7.5 hp compressor is typically rated for around 32 cfm. There is supposed to be a total of 116 air drops throughout the building rated at 40 cfm each.
My AC supplier is concerned that the compressor will be underrated. With this load will a larger compressor be required?
This information will not be finalized until after the test stand procurement is completed. The air compressor may be larger to accommodate all equipment.
