1. Revises RFP, Factor 1, Experience, (1) Construction Experience:

Experience of proposed subcontractors will not be considered.

An Offeror may use experience of proposed first-tier subcontractors if experience of the small business prime does not independently demonstrate capabilities and past performance necessary for award. If an Offeror is using experience of a proposed subcontractor, the Offeror must clearly demonstrate that the subcontractor will have meaningful involvement in the performance of this MACC. The Offeror must provide a supporting joint venture agreement, partnership agreement, teaming agreement, or letter of commitment and an explanation of the meaningful involvement for the subcontractor. The explanation of the meaningful involvement shall be included within Factor 3.
2. Revises the section header in General Requirements

Factor 1 Experience
In the evaluation of non-price items, Factor 1 – Experience states that “Experience of proposed subcontractors will not be considered.” That statement appears to be inconsistent with recent changes to the SBA regulations that provide: (g) Capabilities, past performance, and experience. When an offer of a small business prime contractor includes a proposed team of small business subcontractors and specifically identifies the first-tier subcontractor(s) in the proposal, the head of the agency must consider the capabilities, past performance, and experience of each first tier subcontractor that is part of the team as the capabilities, past performance, and experience of the small business prime contractor if the capabilities, past performance, and experience of the small business prime does not independently demonstrate capabilities and past performance necessary for award.

266 13 CFR § 125.2(g). The solicitation as drafted does not appear to consider this regulation and may unfairly restrict competition for award. Can you clarify whether the Agency will consider capabilities, past performance, and experience of a first tier subcontractor that is part of the team as the capabilities, past performance, and experience of the small business prime contractor if the capabilities, past performance, and experience of the small business prime does not independently demonstrate capabilities and past performance necessary for award?
