L3. CONTRACTOR LICENSING REQUIREMENTS:

See E11. Offeror will be required to provide verification of such permits and licenses prior to award of the contract to the contracting officer if such information is not already on file with or available to the contracting officer.

As required by the PWS, 0200000 – Management and Administration, Spec Item 2.3.4, Permits and Licenses, the Contractor shall obtain all required permits, licenses, and authorizations to perform work under this contract and comply with Waste Management and Public Cleaning Act (Haikibutsu no Shori Oyobi Seiso ni Kansuru Horitsu), Japan Environmental Government Standards (JEGS), and all other applicable Federal, host nation (Japanese), prefectural, and local laws and regulations. See the PWS, 1503030 – Integrated Solid Waste Management, Spec Item 2.3.3. Permits and Licenses for more details.

The JEGS prohibits the generators of industrial waste to contract with a licensed transporter that requires the transporter to then separately subcontract with a licensed disposal facility. Therefore, a single Contractor shall be licensed to both transport and dispose of industrial waste. A Joint Venture Agreement (JVA) wherein one joint venture (JV) partner possesses a required transportation license and the other partner possesses a required disposal license is an acceptable alternative to meet this single contractor requirement. Such JV must be registered in the System for Award Management (SAM) website and possess a valid NATO Commercial and Government Entity (NCAGE) code prior to submittal. In case of a JV, the JVA shall include all contractors involved in the Offeror’s proposed Solid Waste Management (SWM) Plan. Such plan shall be submitted by the Contractor after award as required by the Contract. Please refer to paragraph L8. for JVA submittal requirements.

L4. SYSTEM FOR AWARD MANAGEMENT REGISTRATION NOTICE: All offerors (i.e., whether individually or as a joint venture, etc.) responding to this solicitation must be registered in the System for Award Management (SAM) database to be eligible for award. For more information please go to https://www.sam.gov, or by calling 866-606-8220 or 334-206-7828 for international call and complete the provisions associated with the annual representations and certifications identified in the Federal Acquisition Regulation (FAR) Subpart 4.1202 and Defense FAR Supplement (DFARS) Subpart 204.1202.

An Offeror is required to be registered in SAM when submitting its offer/quotation/bid, and shall continue to be registered at all relevant times, i.e., time of award, during contract performance, and through final payment of the contract resulting from this solicitation.

CAUTION: All offerors are required to be registered in SAM at the time their offer/quotation/bid is submitted.

Offerors with no active SAM registration upon receipt of their offer/quotation/bid shall be considered ineligible for award."

A contract cannot be awarded to a contractor not registered in SAM with ACTIVE status. Remember to review the NAICS codes listed in your record and make sure that you have listed the NAICS code for this procurement.

The CLIN which includes recomputed contract ELINs will also be recomputed to take into account the change in the contract ELIN. If the Offeror provides a total amount for a CLIN or ELIN but fails to enter the unit price, the total amount divided by the CLIN or ELIN will be held to be the intended unit price.

e. The Government reserves the right to award some or all of the ELINs in any order depending on availability of funds and operational requirements.

EVALUATION FACTORS FOR AWARD

M1. BASIS FOR AWARD

1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest priced, technically acceptable offer.

2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

3. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

4. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award.

An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

B. SAFETY EVALUATION

The evaluation of safety has been tailored specifically to meet the requirements and constraints of contract performance in Japan and is described in Section D, Evaluation Factors for Award.

C. ADJECTIVAL RATINGS/DESCRIPTIONS

Each offeror’s technical factors and past performance will be evaluated separately. Upon the conclusion of the evaluation of the technical factors and past performance, an overall non-price factors rating of Acceptable (A) or Unacceptable (U) will be assigned to each offeror’s non-price factors proposal.

1. ADJECTIVAL RATINGS AND RATINGS DESCRIPTIONS:

The following adjectival ratings and rating descriptions will be used to assign a rating to each technical factor. Use upper case letter ratings for major technical factor ratings. The addition of plus (+) or minus (-) to an adjective rating is not allowed.

Table A-2. Technical Acceptable/Unacceptable Rating Method

Adjectival Rating Description

Acceptable (A) Proposal meets the minimum requirements of the solicitation.

Unacceptable (U) Proposal does not meet the minimum requirements of the solicitation.
