AMENDMENT 0007 INFO

The purpose of this Amendment 0007 is for the following:

1. Provide responses to the pre-proposal inquiries received and revise previous responses as shown below:

No.

Questions (Should include Specification Section or

Drawing Reference)

Answers

286 Reference: Amendment 004 and Amendment 005:

Given the large amount of new data that has just come in from both Amendments 004 and 005, would the Government consider extending the proposal deadline by at least one-month in order to allow bidders time to incorporate all new changes and new data into their proposals.

Please refer to Amendment 0007. The proposal due date is extended to 7 December 2020 at 2:30 PM Japan Standard Time.

287 Reference: Main RFP: We understand that a similar previous BOS contract was developed and solicited for a previous Okinawa-BOS contract and that the Okinawa- BOS contract was terminated by the Government (for convenience of the Government) and not through fault of the awarded contractor after the first year of operation.

Our Japanese partners are concerned that this may potentially occur for this Iwakuni BOS contract and as such, we are attempting to gain clarification if there is the potential for a similar occurrence on this Iwakuni BOS. If so, this may have an adverse impact on the risk profile of bidding this contract vis-i-vis the start-up capital requirements and the subsequent cash flow and profitability of this Iwakuni project. Request clarification of the Government's intent for operating the Iwakuni BOS for the full-five year term as specified in the PWS.

It is the Government's intent to award the base year and obligate the contract minimum guarantee for CLIN 0001 as stated in Section B "Services and Price" Paragraph B2.

However, in accordance with FAR 52.217-9 and 52.249-4, the Government reaffirms it's right to terminate or exercise/NOT exercise contract options as necessary.

288 We respectfully request the Government consider an additional 30 day extension to the Iwakuni BOS RFP (current due date 05Nov20) to allow our Japanese partners time to consider and properly respond to the Amendments 0004 and 0005 changes issued this week. Further, due to COVID 19 restrictions, the Japanese Visa process remains in flux making in person meetings with Japanese partners very difficult/impossible to plan and schedule. In addition to translation challenges, what was normally accomplished quickly in face-to-face meetings now takes days of back and forth discussion using televideo and telephonic means. In an effort to bring the Government the best possible and most cost-competitive solutions, and to ensure a level playing field among the competitors, especially other Japanese offerors, we respectfully request the Government provide a minimum 30-day extension.

Please refer to Amendment 0007. The proposal due date is extended to 7 December 2020 at 2:30 PM Japan Standard Time.

289 1. Will the Government allow offerors to use screen shots examples in their proposals that do not meet the 12

pt. font requirement?

There is no font restriction for screen shots, graphics, tables, document headers/footers, section headings and subheadings.

290 RFP Statement: The instructions, page 66, Factor 2, Sec.6), Phase-In Plan – Provide a phase-in plan limited to no more than 120 calendar days. The plan shall include: (a) a schedule for all key events; (b) personnel actions and responsibilities to meet mobilization timeline for employee staffing at all levels; and (c) a logistics/supply chain management mobilization strategy to provide logistic/supply resources to meet PWS requirements after the 120 day mobilization period for full performance of the contract.

Question: Will the Government please omit the schedule for all key events from the page count? By removing this restriction, this will provide the Government reviewers with a better understanding of an offeror's approach to phasing in the contract.

Please refer to revised paragraph a of Factor 2, Management Approach provided in Amendment 0004. The last paragraph states, "The management approach submittal shall be limited to 30 single-sided (15 double-sided) 8-1/2” x 11” or equivalent page sizes, 12 point font, not including the organization chart and joint venture agreement/partnership agreement/teaming agreement/approved mentor protégé agreement (MPA)/letter of commitment in Item 2 and the schedule in Item 6(a)".

As such, the schedule in Item 6(a) is not included in the page count and is not restricted to the formatting requirements.

291 Will the Government please reconsider use of 11 x 17s for graphics such as organization charts, timelines, and other important visual aids used to minimize tex and increase visual understanding?

Please refer to revised paragraph a of Factor 2, Management Approach provided in Amendment 0004. The last paragraph states, "The management approach submittal shall be limited to 30 single-sided (15 double-sided) 8-1/2” x 11” or equivalent page sizes, 12 point font, not including the organization chart and joint venture agreement/partnership agreement/teaming agreement/approved mentor protégé agreement (MPA)/letter of commitment in Item 2 and the schedule in Item 6(a)".

As such, the organization chart and schedule in Item 6(a) is not included in the page count and is not restricted to the formatting requirements.

292 Will the Government please reconsider use of a font no less than 9 point for graphics, tables, and focus boxes?

This affects the overall readability of the proposal and further enables offerors to fully address the requirements set forth in the Technical Volume.

section headings and subheadings.

293 We respectfully request that document headers/footers, and section headings and subheadings be exempt from the requirement for the 12 point font requirements. This allows the Offeror's to meet the stated margin requirements without sacrificing valuable text space while meeting the page marking and compliance requirements. Will the Government please reconsider this request?

section headings and subheadings.

294 Under Amendment A0004, answers to questions 135 & 136, the government indicates that the majority of locks that will require maintenance are X-10 type. Without specified locations being identified, are there any that will be in areas with classified materials and if so, is the government going to allow foreign nationals to work on these locks?

Contractor will not provide maintenance on locks in classified spaces.

295 Under Amendment A0004, in answer to question # 180 for Automatic Doors, for clarification, was the "Interior" removed to mean "all" (both interior / exterior) and does this also apply to Section C - 1502000, Page 80, 3.2.1 and attachment J-1502000-05, Pages 587 - 595?

Yes, the Contractor shall maintain all automatic doors, interior and exterior, listed in the inventory in both Annex 1401000 and Annex 1502000.

296 Under Amendment A0005, Revised+Attachment+3+ELINS, for any requirement per the required standards, whereby maintenance is only performed once or twice per year, when invoicing, is the monthly invoice required to be spread out equally over the 8 or 12 month period or submitted for the actual month services are performed?

In alignment with the ELIN structure, pricing for recurring service will be spread over the service period on the contract. Pursuant to the contractor meeting the full requirements of the contract, the invoicing spread out over the contract period is acceptable. This does not apply to non-recurring service items which the Government anticipates will be invoiced after the work is completed.

297 IAW Amendment 0006 Revised J-1502000-31” under Attachment 8 “Additional Revised Specifications and Supplemental Data, the Hood Auto Washing Systems at all locations have been removed, however in Amendment 0006 Revised Annex 1502000 Spec Item 3.2.20, pg 2, the requirement for the Washdown Systems remain. For clarification, has the maintenance of the Washdowns as well as the drains been removed in it's entirety from the requirement?

Please refer to "Amendment 0007 Revised Annex 1502000 Spec Item 3.2.20” under Attachment 9 “Additional Revised Specifications and Supplemental Data”. Yes, the Washdown Systems to include drain pipe areas have been removed.

298 In Amendment 0006 Revised Annex 1502000 Spec Item 3.4.3, pg 3, the requirement is for exhaust hoods, ducts and associated equipment, however IAW Amendment 0006 Revised J-1502000-31” under Attachment 8 “Additional Revised Specifications and Supplemental Data", for bldg. #'s 222, 410, 1562, 6222, 9520, 615, 635, majority of the Exhaust Hoods are lined out. Have these been removed from the requirement?

No, buildings 222, 410, 1562, 6222, 9520, 615, 635 have NOT been removed from the requirements. Refer to J-1502000-32 for Spec Item 3.4.3 as specified; services for buildings 222, 410, 600, 635, 637, 1333, 1562, 1600, 6222, 9520, & 615 are required.

Please refer to "Amendment 0007 Revised J- 1502000-31" under Attachment 9 “Additional Revised Specifications and Supplemental Data”.

299 In Amendment 0006 Revised Annex 1502000 Revised J-1502000-31” under Attachment 8 Additional Revised Specifications and Supplemental Data" there is equipment (Fans, Hoods and Ducting which are over dishwashers which are not grease generating equipment?) that are not in the current Kitchen Exhaust Maintenance contract requirement. Without more detailed drawings and a site visit, it is hard to assess & validate the requirements. In addition if these systems are added is the government going to install the access panels in the duct system before award of the contract?

Kitchen exhaust maintenance will be completed per the kitchen exhaust inventory listed in "Amendment 0007 Revised J-1502000-31" under Attachment 9 “Additional Revised Specifications and Supplemental Data”.

300 DRAFT+N40084-20-R-0060+PWS_Part+1, Section C – 1502000 Facility Investment, 3.2.19, Pg. 93 Swimming Pools, can the Government provide the average annual quantities per location of chemicals used? Also, since it takes time to acquire the OEM requirements, what chemicals are currently being utilized?

Please refer to "Amendment 0007 Pool Chemicals" under Attachment 9 “Additional Revised Specifications and Supplemental Data”.

301 DRAFT+N40084-20-R-0060+PWS_Part+1, Section C – 1502000 Facility Investment, Pg. 85, 3.2.5 Fire Drill Pit, The requirement is for the Maintenance of the equipment to include leak testing of fuel tanks and piping in accordance with Chapter 9 of the JEGS and Division 33 of the UFGS as well as ensuring all LPG and oxygen tanks for the Fire Drill Pit system remain above 60%. Are there any other requirements to be included for the Maintenance aside from the items mentioned above?

302 RFP - For requirements whereby heavy equipment may need to access (i.e. Boilers, Under / Above ground storage Tanks, HVAC systems for elevated equipment, etc.) without a proper site visit to ensure accessibility, it is difficult to propose on a requirement confirming the requirements can be fulfilled without the knowledge of whether or not some of the locations can be accessed.

With the restrictions due to the pandemic lightening up, can the Government reconsider an actual site visit? This will not only assist in the items mentioned above, but collectively with the entire solicitation as without a proper site visit, there will no doubt be numerous and major impacts for the Customers, the Acquisition and Post Award side of the house after award.

The Government is not planning to offer an on-site visit.

303 Annex 1502000 Spec 3.2.6 - Concerning weights used for load testing WHE, are government provided weights available on site and/or will the government bring them to the site? Or does the government have them stored offsite and contractor needs to bring them to the site?

Contractors are responsible for coordinating the use of government weights. Transportation of weights to locations is the contractor responsibility. Availability of Government provided weights does not preclude contractor from meeting the required maintenance schedule.

304 Annex 1502000 Spec 3.2.6 - Please confirm the required Inspections for WHE: 1) Type C Inspection. 2) Approval of Usages 3) Third Party Inspection

Please refer to Question and Answer 131.

305 Annex 1502000 Attachment J-1502000-10 - Are all of the Cranes listed for Cargo transportation?

Please refer to Question and Answer 219.

306 Attachment J-1502000-25 - Please provide size/volume for Oil Water Separators listed in J-1502000-25. Without knowing sizes, we are unable to provide estimates for pumping out and cleaning the OWS.

Sizes of the Oil Water Separators (OWS) on station vary. Please refer to "Amendment 0007 OWS with Capacities" under Attachment 9 “Additional Revised Specifications and Supplemental Data”. This lists capacities for most of the OWS listed in J-1502000-25. The document has some OWS that have been removed. J-1502000-25 remains the current inventory list of installed OWS.

307 Annex 1401000 Spec 3.2.3.1 - Please confirm whether or not DSWT effluence testing is to be performed monthly.

The Government's minimum requirement is for annual testing. Contractor will follow OEM recommendations and follow the strictest testing requirement.

308 Annex 1502000 Spec 3.2.20 - Please provide historical data on frequency of hood and duct maintenance at each location as listed in the inventory.

Please refer to "Amendment 0007 Revised J- 1502000-31" under Attachment 9 “Additional Revised Specifications and Supplemental Data” for inventory. Historical data is not available for maintenance frequency, please refer back to manufacturer recommendations.

309 Annex 1502000 Spec 3.2.20 - Please confirm that drain pipes are no longer a part of the exhaust hoods and ducts equipment and systems. They were listed in Spec 3.2.20 in amendment 5 and removed in amendment 6.

That is correct. Please refer to “Amendment 0007 Revised Annex 1502000 Spec Item 3.2.20” under Attachment 9 “Additional Revised Specifications and Supplemental Data”.

The drain pipes for Hood Auto Washing Systems have been removed from Annex 1502000 Spec Item 3.2.20.

310 Annex 1502000 Spec 3.2.20 - Under attachement J- 1502000-31, auto washing systems have been removed.

However, in spec 3.2.20, it still includes hood auto washing systems as part of maintenance requirements.

Please correct the spec information.

Please refer to “Amendment 0007 Revised Annex 1502000 Spec Item 3.2.20” under Attachment 9 “Additional Revised Specifications and Supplemental Data”.

The verbiage of "Hood Auto Washing Systems" has been removed and replaced with "fans" to clarify the requirements.

311 Annex 1502000 Spec 3.2.20 - We would like to confirm the changes provided in Amend 6. When Auto Wash Systems were removed, all Exhaust Hood inventory for those locations were also removed. Is this correct? (We understand that the washing system cleans the hoods, but our understanding is that exhaust hoods and washing system hoods are separate items.)

312 Annex 1502000 Attachment J-1502000-21 - Please provide photos/videos of the 11 submersible pumps as well as control rooms at buildings 2980, 2990, and 5040.

Please refer to "Amendment 0007 Sample Pump Photos" under Attachment 9 “Additional Revised Specifications and Supplemental Data”.

313 Annex 1502000 Attachment J-1502000-18, Pg.434/657 Section 2.i.b) - "All the points identified in the provided sketches shall be annotated in the record sheet and kept updated. The earth Tester shall be configured as shown in Figure 1. Prior to connecting/using of earth tester always clean thoroughly the connection points" Question: Please provide the sketch of "Figure 1".

Please refer to "Amendment 0007 Figure 1 Earth Tester Electrodes Configuration" under Attachment 9 “Additional Revised Specifications and Supplemental Data”.

314 Annex 1502000 Attachment J-1502000-18, Pg.434/657 Section 2.i.d) - "For bonding resistance or point-to-point resistance use the earth tester with long leads, measure between all points listed on the record sheet for each shown facility."

Question: All test points listed in the attachedment are to be measured for resistance to the grounding test point measured in c) above. Is there any problem in conducting this measurement in the resistance measurement range of the tester/circuit tester?

The test shall be conducted in the manner explained in the test plan and with the resistance identified on the record sheet. No other resistance will be accepted. And the tester should have the range requested at each record sheet at a minimum.

315 Annex 1502000 Attachment J-1502000-18, Pg.434/657 Section 2.i.e) - "When the ordnance grounding system bus bar can be isolated, the isolated bus bar should be measured to ensure a resistance greater than 20,000 ohms."

Question: Please provide a concrete example of this.

This requirement is based on NAVSEA OP5 and all ordnance bus bar should not measure more than 20,000 ohms in resistance and it should be isolated/disconnected from the entire system.

316 Annex 1502000 Attachment J-1502000-18 Pg. 435/657 Section 2.ii.b) - "Resistance shall be measured with a suitably calibrated ohmmeter. The ohmmeter shall operate on a nominal open-circuit output voltage of 500 Volts direct current (Vdc), a short circuit current of 5 milliamperes (mA), and an effective internal resistance of 100,000 ohms ±10%."

Question: Are you referring to a 500V insulation resistance measurement?

This refers to the parameter of the ohmmeter and the 500V is the open circuit voltage which is measured in direct current (Vdc). It has nothing to do with the resistance.

317 General - We respectfully request to extend the bid date by 1 month due to the number of questions/answers that must be reviewed before pricing can be confirmed, as well as any additional questions/answers that are to be submitted by 13-October-2020.

Please refer to Amendment 0007. The proposal due date is extended to 7 December 2020 at 2:30 PM Japan Standard Time.

318 Annex 1502000 Attachment J-1502000-08 Pg.179/657 Fire Hydrant Location Map. Please provide underground waterlines and pipe sizes.

Please refer to "Amendment 0007 Water Distribution Map" under Attachment 9 “Additional Revised Specifications and Supplemental Data”.

319 RFP - For requirements whereby the Equipment is proprietary and the Manufacturer does not want to provide a quote, what is the Governments suggestion on how we should proceed in terms of the RFP submittal?

The Government cannot provide guidance on how to price your proposal.

320 Section C - 0200000 Management and Administration, Spec Item 2.4.3 Government Furnished Materials(GFM) (Page 12), 1401000 Family Housing Spec item 1.1 Concept of Operations (Page 2) & 1401000 Family Housing Spec item 3.2.4 Change of Occupancy Maintenance (COM) (Page 18)

Question: According to the Q & A, No. 101, "the Government will provide the family housing unit equipment such as refrigerators, ovens, dishwashers, washers and dryers and smoke detectors and garbage disposals as GFE. The Government does not have a parts inventory for these items and they will have to be ordered."

- As for foreign-made(non Japanese made) items to be replaced, it is difficult for us, Japanese contractors, to procure the parts. The spec states that units are available within ten(10) working days of requested start work from the Government (unless otherwise requested at a later date). Even if possible to procure, it seems almost impossible to complete from ordering the parts to installation within 10 days. Would you extend the 10-day period?

Contractor will immediately notify Government when they cannot meet procurement of US products.

321 Section C - 1401000 Family Housing Spec item 3.2.4 Change of Occupancy Maintenance (COM) (Page 18)

Question: The spec states that units are available within ten (10) working days of requested start work from the Government (unless otherwise requested at a later date).

It is even hard for Japan made products to be completed from ordering the parts to installation within 10 days.

Would you extend the 10-day period?

Contractor will immediately notify Government when they cannot meet procurement of US products or 10-day period.

322 Section C - 0200000 Management and Administration, Spec Item 2.4.3 Government Furnished Materials(GFM) (Page 12), 1401000 Family Housing Spec item 1.1 Concept of Operations (Page 2) & 1401000 Family Housing Spec item 3.2.4 Change of Occupancy Maintenance (COM) (Page 18)

Question: According to the Q & A, No. 101, "the Government will provide the family housing unit equipment such as refrigerators, ovens, dishwashers, washers and dryers and smoke detectors and garbage disposals as GFE."

- We understand that foreign-made(non Japanese made) lighting fixtures are also GFM. Is our understanding correct?

Lighting fixtures are Contractor Furnished Materials, not GFM.

323 Section C - 1401000 Family Housing Spec item 3.2.4 Change of Occupancy Maintenance (COM) (Page 18)

Questions: Regarding COM work exceeding the threshold, ¥400,000,

1. How long will it take from notifying KO/COR to the issuance of task order?

2. Does the 10-day work period start from the issuance day of the task order?

1. Issuance of the task order will vary due to a variety of factors. We anticipate issuance will occur between 1 to 15 days.

2. The 10-day work period will start on receipt of Government forecasted schedule. During peak season this is estimated to be 80 homes. During non-peak season, this is estimated to be 50 homes.

324 Section C - 1401000 Family Housing Spec item 3.2.4 Change of Occupancy Maintenance (COM) (Page 18)

Question: Are there any quantity limits on COM work items?

Please refer to Question and Answer 323.

325 Revised Attachment 3, ELINS (for Non-recurring Works) Questions:

1. Regarding A thru E709, is the correct "Unit of measure" not SM but EA?

No, SM is correct.

326 Revised Attachment 3, ELINS (for Non-recurring Works)

Question: As for A thru E711, 712, 723, 724, etc., there are no ELIN items for occupied units. We think they require different prices than unoccupied units.

The work space will be vacated at the time of work, therefore the contractor's price should not vary based on occupancy of unit.

327 Revised Attachment 3, ELINS (for Non-recurring Works)

Question: Regarding A thru E731, please provide the detailed information, such as shape, material(solid wood, plywood, etc.). Is closet door included in A thru E 731?

Replacement doors should match existing wood door. E731 refers to standard size door, not the accordion style door. Accordion style door replacement is not covered under this ELIN.

328 Revised Attachment 3, ELINS (for Non-recurring Works)

Question: Regarding A thru E732 & 733, does the replacement work include the sash frame?

Sash frame is not included. Sash frame is included in E735.

329 Revised Attachment 3, ELINS (for Non-recurring Works)

Question: Regarding A thru E734, please provide the information on type of glass.

This ELIN covers both single and double windows.

330 Revised Attachment 3, ELINS (for Non-recurring Works)

Question: Regarding A thru E743 & 744, does the replacing refrigerator/dryer handle only provide to occupied units? How about unoccupied units?

This applies to occupied units.

331 Revised Attachment 3, ELINS (for Non-recurring Works)

Question: Regarding A thru E745, would it be difficult to replace if the gaskets were not GFM?

Contractors are expected to furnish gaskets.

332 Revised Attachment 3, ELINS (for Non-recurring Works)

Question: Regarding A thru E748 & 749, is the range hood GFM?

Yes.

333 Revised Attachment 3, ELINS (for Non-recurring Works)

Question: Regarding A thru E786 & 787, we might also need the ELINs for occupied units.

The work space will be vacated at the time of work, therefore contractor price should not vary based on occupancy of unit.

334 Revised Attachment 3, ELINS (for Non-recurring Works)

Question: Regarding A thru E723, shall their width be up to 2000mm? It might be better to quote according to size.

Any replacement of vertical blinds up to 3 meters.

335 1. PWS-Attachment 1502000/J-1502000-08/Page173- 179/Fire Hydrants As per the provided inventory information, there are some hydrants noted as "Failed".

Will they be repaired in normal conditions before the contract begin by the government, or will the new contractor be responsible to repair those?

Also, there is a contradiction of installed hydrants’ quantity between “ATTACHMENT J-1502000-08 FIRE PROTECTION SYSTEMS Fire Hydrant Inventory” and

“ATTACHMENT J-1502000-08 FIRE PROTECTION

SYSTEMS Fire Hydrant Location Map”, therefore, will the government provide us the accurate quantities of fire

Please utilize the updated Inventory and Map:

Updated inventory is attached and an updated location map will be provided after award.

Please refer to "Amendment 0007 Hydrant Test Data 2020". Contractor to notify Government for fire hydrants in not working order during mobilization so that the Government can take action on repairs.

Discharge water during flow test: The discharge of fire hydrants has at times gone to the storm drain system. This is not in keeping with the hydrants to be maintained?

Additionally, can you answer what are red marks on the

ATTACHMENT J-1502000-08 FIRE PROTECTION

SYSTEMS Fire Hydrant Location Map without allocated numbers?

Lastly, please provide the correct instruction for the waste water which will be generated by the water discharge test (i.e., UFC 3-601-02, Table 2-14, 2yrs frequency task 4).

As we have seen the discharge test which was conducted by the station fire dept before, they discharged the water to the lawn areas driveways and walkways, however, this is prohibited by the environment division to discharge the test water to such places. Therefore, please provide what is the corrective action to this matter?

Storm Water Prevention Plan.

All efforts should be made to divert water sprayed from hydrants to a grassy area that can absorb the water if at all possible. This could include things such as diking or diverting the flow of water away from storm drains, giving it more time to be absorbed into turf, soil, or be evaporated.

This is situation of trying to adhere to the best management practices for storm water while trying to fulfill higher level requirements for flushing, which is required for drinking water quality, JEGS, and NFPA regulations. Since this is a performance based contract, how to prevent the discharged water from going to the storm drain system is up to the Contractor's discretion.

336 PWS-1502000-3.2.4, There are some emergency water supply pumps that are supervised/utilized by Facilities Department Production Division Utilities Branch to their operations, as applicable, and installed within the pump houses of this branch (i.e., B#177, 919, 1707). These are the water supply pumps that pressurize the water main directly, and in the past contract, these pumps were activated by Utility Branch personnel in the presence of Contractor’s workers when these pumps are activated for Monthly ITM (i.e., UFC-3-601-02, Table 2-16) because the activation lamp will be displayed on fire pump control panel which is supervised by this branch and sends activation signal to Emergency Dispatch Center (EDC) via Fire Alarm Network (FAN) System.

Question: Will these pumps be subjected to the scope of ITM required equipment for BOSC?

Section 3.2.4 only applies to fire protection pumps used solely for the purpose of fire protection.

L10. FAR PROVISION 52.229-11 AND FAR CLAUSE 52.229-12

FAR provision 52.229-11 and FAR clause 52.229-12 are included in this RFP. This provision and clause concern the imposition of a 2 percent Federal excise tax withholding on any resultant contract award or payment request.

This rule applies to Federal Government contracts for goods or services that are awarded to foreign persons. It implements the Department of the Treasury final regulations published in the Federal Register at 81 FR 55133 on August 18, 2016, under section 5000C of the Internal Revenue Code relating to the 2 percent tax on payments made by the U.S. Government to foreign entities pursuant to certain contracts.

If an offeror identifies as a “Foreign Person”, exemptions from this excise tax must be claimed by an offeror when it submits, with its offer, a U.S. Department of Treasury Internal Revenue Service (IRS) Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, available via the internet at www.irs.gov/w14. If offerors identifying as a “Foreign Person” do not submit the IRS Form W-14 with the offer, exemptions will not be applied to any resulting contract and the Government will withhold a full 2 percent on each payment. Failure of offerors identifying as a “Foreign Person” to submit IRS Form W-14 with a payment request will also result in an automatic withholding of 2 percent from the payment request.

When filling out the IRS Form W-14 the following information may be used to complete Part I, Line 6 and 7:

Line 6 Contract / reference number:

N40084-20-R-0060 Line 7 Name and address of the acquiring agency:

Naval Facilities Engineering Command (NAVFAC) Far East City or town, state or province. Include postal code where appropriate Country (do not abbreviate) Bldg. 1828, 1F, Tomari-cho Yokosuka, Kanagawa, 238-0001 Japan

Any exemption claimed and self-certified is subject to audit by the IRS. Any disputes concerning this tax are adjudicated by the IRS because the Section 5000C tax is a tax matter not a contract issue.

Offerors are encouraged to seek guidance from their own tax, legal, or accounting professionals for advice concerning the provision, clause, and the execution/submission of IRS Form W-14. Additional information is also available at:

https://www.navfac.navy.mil/navfac_worldwide/pacific/fecs/far_east/about_us/contractors_information.html

However, offerors are advised to consult Title 26 U.S.C. 5000C and its implementing regulations at 26 CFR 1.5000C-1 through 1.5000C-7 (see FAR 29.402-3, 31.205-41(b)(8)) for specific details and/or updates.
