About this file
This document contains an amendment to a solicitation for an Indefinite Delivery Indefinite Quantity Job Order Contract (IDIQ JOC). The amendment makes several changes to the solicitation, including extending the proposal due date from March 18, 2024 to March 21, 2024. It provides responses to 226 pre-proposal questions, revises the price schedule blue and gold forms, and includes historical task order information from the previous fiscal year JOC.
The Naval Facilities Engineering System Command (NAVFAC) Washington requires an eligible 8(a) construction contractor to perform general construction and repair services on a JOC basis at various NAVFAC Washington locations. Services include minor construction, alteration, and design-build or design-bid-build projects. The contractor will provide all materials, labor, equipment, and incidentals. The contract has a potential value of $100 million over five years or two 2-year base ordering periods and three 1-year option periods. Proposals for the IDIQ JOC are now due on March 21, 2024.

The staffing requirements stated in the solicitation and General Requirements are onerous and unreasonable. Based on an average distribution of task order size, even a small individual contracting office that has 29 active task orders totaling $5M will be contractually required to have 23 on-site personnel to manage this work. This will lead to prices that are so high that they are not in the taxpayers’ best interest. In response to prior PPI about this issue, the Government has repeatedly provided answers such as
“Coordination of the requirement should be conferred with the Contracting Officer for a specific ordering office.” This implies that offerors are to include contractually mandated staffing requirements in their price, but that the enforcement of these requirements may be waived by individual contracting offices post-award. This is going to lead to a variety of pricing approaches by offerors depending on 1) their insight into current NAFVAC JOC operations and 2) the

If the government does not truly intend to hold contractors to the staffing requirements described in the solicitation and General
Requirements, then providing a more realistic guideline to actual staffing requirements prior to the proposal submission would reduce the potential risk to offerors and allow offerors to provide lower, more accurate coefficients with all offerors having the same basis of pricing. Would the government please consider providing a more accurate assessment of staffing requirements during the solicitation phase so that all offerors can use this information to provide their most realistic, cost-effective pricing?

Amend 6
Many questions have been asked regarding OTR and Escort coefficients. However, there has been no response that clarifies how the OTR and Escort coefficients will be applied at the TASK ORDER level. It is imperative that the specific clarifications and issues surrounding OTR and Escort coefficients are addressed thoroughly.

Experie nce
Section 00 21 00, Factor 2 - Experience includes specific instructions for projects performed by a JV when not all partners from that JV are on the JV proposed for this contract. Specifically, the instructions state, "The Offeror shall also submit a SIGNED copy of the Joint Venture agreement indicating the proposed participation of each Joint Venture member." Please clarify where the JV Agreement should be included if submitting a construction experience project for a JV where not all partners from that JV are on the JV proposed for this contract.
Should this JV agreement also be included in
Factor 1 following our proposed JV agreement or in Factor 2 following the JV project?
The JV Agreement for this procurement is part of the technical proposal under
Factor 1 for the JV entities that are proposing for the current

ProjNet questions #8 and #169 indicated that the Factor 2 - Experience (2) Design
Experience requirement to submit a DBB project would be removed. However, the requirement for a DBB project remained in Section 00 21 00 issued with Amendment

Design-Bid-Build (DBB) projects will not be considered for evaluation. Only Design- Build (DB) projects will be evaluated under Factor 2 -
Experience.
Section 00 21 00
As of today there are over 210 inquiries submitted and answered. Today is the deadline for inquiries so there may be more answers remaining. Due to the complexity of this requirement and team effort required, we would like to respectfully request this requirement be extended until April 1st, 2024 to be able to submit a responsive and reasonable proposal.
This Amendment 7 provides a changed proposal due date of
21 March 2024
We are planning on bidding this as the
General Contractor using a subcontractor who has been our designer on other
Design/Build projects as our designer or design team. In the Solicitation on page 19 of 71 No. 2 Design Experience It says “Submit a maximum of five (5) relevant design projects for the design team that best demonstrates design experience on relevant projects that are similar in size, scope and complexity to the RFP. Our question is do these 5 projects by the design team need to involve us as the GC or are they just to demonstrate the Design team’s abilities?
No - However, projects where the Offeror and the proposed design firm(s) have previously worked together may be considered more favorably than those that have not worked together.
