About this file
This document provides details for a solicitation notice seeking multi-media compliance services with an emphasis on fuel storage tanks/spills, air, and waste/materials. The Naval Facilities Engineering Command Washington is seeking these services at various locations in Virginia, Maryland, Washington D.C., and other areas. Offerors will perform compliance projects for stormwater, drinking water, wastewater, air quality, hazardous waste and materials, storage tanks, environmental management systems, other environmental liabilities, environmental planning, natural resources, cultural resources, and installation restoration in accordance with applicable regulations and policies. This is a lowest price technically acceptable source selection for an indefinite-delivery/indefinite quantity contract over five years, potentially extending an additional six months, for firm-fixed price task orders ranging from $50,000 to $250,000 but allowable above and below this range. The minimum guarantee is $50,000 and maximum total is $30 million for the life of the contract.

1 1/29/20 41 of 46 1. Recent and Relevant Projects a.
Recent and Relevant Projects: The solicitation states that we must submit the following number of projects: 8 for tanks/spills, 8 for waste/materials, and 4 for Air. It then states that the Offeror can choose any other Specialized Experience project type to meet the 20-project submission requirement. However, completing the former requirement would meet the 20-project submission requirement (8+8+4=20). Did the Government intend to request 6 tanks/spills and 6 waste materials and 4 air projects leaving 4 projects the
Offeror may choose from the project types?
See Amendment 0006. Offerors shall submit 20 recent and relevant projects. Of the submitted projects, eight (8) must be Tank/Spill
Program, eight (8) must be Waste/Material Program, and four (4) must be Air Program, as set forth in Attachments C Table 1 – Tanks/Spills and Attachment D – Table 2 Waste/Materials-Air.
These tables lists mandatory specialized projects. Offerors must demonstrate completion of each mandatory specialized project within the submission of recent and relevant projects. A double asterisk (**) identifies the required mandatory specialized project types. The offeror is free to select any of the other projects not marked with a ** to demonstrate experience with the remaining Tank/Spill Program, Waste/Material Program and Air Program project requirements.

2 1/29/20 41 of 46/ 46 of 46 (1)2.b./(2)(ii) variable
The solicitation states that relevant project experience must only include projects that are a minimum of $100,000 in size (Page 41 of 46 under Definitions and qualifying information). Program Managers on the team have worked hard to keep estimates related to certain types of projects under the $100,000 threshold as a benefit to the Government.
For example, none of our contracts/task orders for EPCRA projects in this region fall above the $100,000 and, therefore, we would not be able to use any of those projects on this proposal. However, on Page 46 of 46 under (ii) Basis of Evaluation, the solicitation states that a minimum value of $20,000 is acceptable. Could the Government please confirm that the Offeror can use projects with value under $100,000 but not under
$20,000 for the required 20 projects?
See Amendment 0006. This amendment revises the definition of "size" for relevant projects to task orders with a minimum value of
$50,000.

The Government has written this scope in such a manner that it greatly reduces competition among small businesses and favors only an SBA approved mentor/protégé JV. The latter is allowed to have a large business as a venturer within the JV for small business set-aside opportunities. The SBA does not allow large businesses to be in a JV for these types of opportunities otherwise. However, the SBA does allow a small business to prime a team of subcontractors and as long as at least 50% of the contract revenue is performed by employees of the small business prime and it's similarly situated first-tier subcontractors, the remaining portion can be performed by a large business subcontractor.
Since the requirements of this scope are vast and it takes the SBA typically 6-8 months to approve a mentor/protégé JV, we can only think of one (perhaps two) teams that may compete fairly for this opportunity. Will the Government please revise the scope to accept Teams led by an experienced small business and to allow some projects/certs, etc. to come from subcontractors?
See Amendment 0006. Amendment 0006 allows for teaming agreements (joint venture member, partner, team member, subcontractor), to be proposed by offerors (via incorporation of Factor 1, Technical Approach/Management). Therefore, projects, resumes and certifications by team members that have signed a copy of the
Agreements or Letters of Commitment may be submitted in response to Factor 2, Corporate Experience/Personnel Qualifications.

4 1/29/20 43 of 46 Certifications 14-Jan
The amount of certifications required for the Offeror to have is completely unrealistic for a small set-aside competition especially when the Government forbids use of subcontractor certs/quals/resumes/projects. For example, even a highly experienced and qualified small tank company does not have a welder inspector certificate (#9) and typically subcontracts that niche specialty. 510 inspectors (#7) deal with "Pressure Vessels" and are not commonly involved with liquid fuels. Four STI inspectors is excessive especially when subcontractors can't be utilized. Because this scope does not accept a Contractor Teaming Agreement and subcontractor involvement, it is written for failure for all Offerors except perhaps for an SBA approved mentor/protégé JV.
See Amendment 0006. Amendment 0006 incorporates Factor 1, Technical Approach/Management which allows for teaming agreements (joint venture member, partner, team member, subcontractor), to be proposed by offerors. See Amendment 0006.
Certifications have been revised in Amendment 0006. Please look at the list again. All certifications submitted must be valid at the closing date of this solicitation.

We understand that the Government wishes to reduce complexity and control costs and we propose the following to increase competition: 1) That the scope be changed to also accept a signed copy of a Contractor Teaming Agreement (CTA); 2) That the CTA include language committing team members to utilizing the same list of labor categories and prices submitted in the cost proposal (i.e., the estimate to the client will have all of the team's labor contribution defined on the same labor spreadsheet); 3) That projects/ resumes/ experience/ past performance/ certifications may come from team members that have signed the CTA agreeing to the proposed labor category rates regardless if they are subcontractors or not; 4) That the requirement for prime position for relevant projects be relaxed as there is significant need for specialized work/certs and highly experienced and qualified small companies that do this work have never been a prime. The most important thing is to ensure the small business in the prime position has prime experience.
Additionally, Solicitation Submittal Requirements for price has been revised to state that Offerors shall submit one set of fully burdened rates and that the fully burdened rates submitted must include costs for all firms proposed under Factor 1.

The type of work described in the scope is predominantly environmental consulting services and not engineering. Could the Government consider changing the NACIS Code for this solicitation to 541620 - Environmental Consulting Services?
Amendment 0001, issued 3 February 2020, changed the NAICS code from 541330-Engineering Services to 541620-Environmental

Factor 1 for the evaluation states that the minimum value of relevant projects is $100,000 and Factor 3 Past Performance states a minimum value of $20,000.
The majority of tasks that would be included in this scope would be significantly less than
$100,000. A minimum value of $20,000 is much more appropriate for this scope.
Would the Government consider revising the minimum value of relevant projects to $20,000?
See Amendment 0006. Factor 2, Relevant project revises the definition of "size" for relevant projects to task orders with a minimum value of $50,000. Factor 4, Past Performance revises the minimum value to $50,000.00.

It appears from the Recent and Relevant Projects description beginning on page 41 of the solicitation and from the Basis of Evaluation on Page 44 that the Government will not consider a Prime/Subcontractor arrangement since it requires that submitted projects must have been performed by the Offeror (Prime) as the prime contractor or as a member of a
Joint Venture.
Is this the Government’s intention? Would the Government consider a Prime/Subcontractor team that includes a commitment from each team member to one set of agreed upon labor rates?
See Amendment 0006. Amendment 0006 allows for teaming agreements (joint venture member, partner, team member, subcontractor), to be proposed by offerors (via incorporation of Factor 1, Technical Approach/Management). Therefore, projects, resumes and certifications by team members that have signed a copy of the

The list of certifications on page 43 are very specific and extensive and it is unlikely to find all of these certifications in one SB, JV or Prime/Sub arrangement. Is it an unacceptable rating if the Offeror cannot demonstrate a certification on the team but has relationships with outside firms that can provide the certification when needed?
See Amendment 0006. Amendment 0006 allows for teaming agreements (joint venture member, partner, team member, subcontractor), to be proposed by offerors (via incorporation of Factor 1, Technical Approach/Management). See Amendment 0006.

Per Section C.2 "Contracted work is performed with minimial focus on government process and maximum focus on results. A results based product delivery CTO enables the Contractor to select actions best suited to the site requirements and ensures that the most up to date management practices are employed." The constraints placed upon Offeror to provide all certifications and personnel from in house capbailiies in Section M.2 for this Multi Media requirement limits the ability of the Offeror to provide the government the most up to date solutions to tasks. For example specific testing can sometimes only be performed by a specialty subcontractor. if the Offeror is required to use only resources it posseses internally, this limits flexibility to meet the intent of Section C.2. Please reconsider requiring all resources be held by the Offeror for an acceptable rating.
See Amendment 0006. Amendment 0006 allows for teaming agreements (joint venture member, partner, team member, subcontractor), to be proposed by offerors (via incorporation of Factor 1, Technical Approach/Management). - This is a 100% Small Business set-aside solicitation and,
- Small businesses, even though they have relevant experience as a prime contractor, generally participate as a subcontractor in a majority of projects. In addition, as a Small
