About this file
This is a Questions and Answers (Q&A) document addressing offeror inquiries regarding a federal construction contract for work in Djibouti and Somalia, managed by NAVFAC.
The document clarifies pricing and cost structures: non-pre-priced coefficients apply uniformly to both competitive-quote and self-performed items; task order-specific security requirements and specialized permits expressly identified in solicitations are billable as separate direct costs rather than absorbed in coefficients; and costs from unique or extraordinary requirements not reasonably foreseeable are eligible for equitable adjustment under the Changes clause. The Government confirms that Djibouti falls under the current Status of Forces Agreement (SOFA), while the United States maintains no SOFA-like agreement with Somalia, affecting tax treatment. Regarding operational support in Somalia, the Government provides military air transportation from Camp Lemonnier (CLDJ) to Somalia sites at no charge, on-base housing at no charge, dining facility access at no charge, and secure laydown areas within perimeter boundaries, all exclusively for prime contractor employees. Subcontractors receive none of these benefits. The Government will not provide personal protective equipment (PPE), though contractors must have ballistic vests and helmets on-site, worn only when FPCON threat levels increase. Government-furnished equipment and materials storage areas are located on-site; contractors bear responsibility for securing their own tools and equipment, with after-hours storage requiring prior Contracting Officer or Contracting Officer's Representative approval. The document addresses compliance matters: no ITAR- or EAR-controlled equipment is currently identified, but future task orders involving such materials must be expressly identified; size status evaluations use only the solicitation's assigned NAICS code (236220 with $45M threshold) regardless of offeror primary classifications; bonding capacity verification requires letters from Treasury-listed surety companies, not bank references; and the proposal submission deadline will not be extended, with contract management remaining under the existing Djibouti-based Government framework.

1. Please clarify whether the non-pre-priced coefficients for Djibouti and Somalia apply equally to both competitive-quote non-pre-priced items and self-performed non-pre-priced items, or whether the Government intends different coefficient application depending on the non-pre-priced pricing method used for the Task Order.
a. Non-pre-priced (NPP) coefficients for Djibouti and Somalia apply to both competitive quote NPP items and self-performed NPP items.
2. Section C.4.2 states that standard licenses, permits, and training are included in the coefficient, except specialized licenses, permits, and training required specifically for a unique Task Order.
Please confirm whether unique Task Order-specific access, security processing, or specialized permit/training requirements expressly identified in a Task Order RFP are to be proposed as separate direct Task Order costs rather than included in the base coefficients.
a. Task Order-specific access, security processing, or specialized permit/training requirements expressly identified in a Task Order RFP are to be proposed as separate direct Task Order costs.
3. The coefficient is required to remain fixed for the entire contract term, including all option periods.
Please confirm whether costs arising from new or changed/revised requirements after contract award, including but not limited to security requirements, base access procedures, host-nation permitting, licensing, or regulatory changes, are eligible for equitable adjustment under the Changes clause, or whether all such costs must be absorbed entirely within the fixed coefficient for the life of the contract.
a. With respect to items such as security requirements, base access procedures, host-nation permitting, licensing, or regulatory compliance, the RFP places responsibility on the contractor to include normal and foreseeable requirements in the coefficient.
However, if a Task Order introduces unique or extraordinary requirements that were not reasonably foreseeable and are not typical of the contract scope, those costs may be addressed separately at the Task Order level consistent with the provisions of Section C.4.2.
4. Will the Government confirm that offeror transportation to Somalia will be available via U.S.
military air?
a. Yes, air transportation will be available from CLDJ for prime contractor employees
5. Will the Government charge offerors for military air transport to the Somalia sites?
If so, can the Government provide cost information?
a. No charge.
6. Will the Government confirm that offerors will be provided on-base housing at the Somalia sites for the duration of all projects?
a. Confirmed, housing will be available for prime contractor employees
7. Will the Government charge for offerors' on-base housing at the Somalia sites?
If so, can the government provide cost information?
8. Will the Government allow the Contractor to eat at the on-base dining facilities in Somalia?
a. Yes, prime contractor employees will be allowed to eat at the DFAC
9. If Contractors are allowed on-base dining facility privileges will the Government charge
Contractors for meals?
10. Will the Government provide transportation to the Somalia sites and from the base if military air is provided and the Contractor is allowed to live on base?
a. Transportation to the base will be provided to the Somalia sites from CLDJ and housing provided on site for prime contractor employees.
11. Will the Government provide a list of required PPE required for work on the Somalia sites?
a. All normal construction PPE as well at Body army and helmet
12. Will the Government list what PPE, if any, will be provided by the government?
a. None.
13. Will subcontractors be allowed to access the same facilities and receive meals if approved for the Prime offeror at the Somalia sites?
a. No, subcontractors will not be provided air travel or housing or meals on site.
14. Will a secure laydown area be provided on site for all ongoing construction activities at the Somalia sites?
a. Yes laydown is available inside the permiter
15. Are there any special HSE or Safety requirements that are not listed in the RFP for work required in Somalia?
a. Additional PPE required to have on hand would be a ballistics vest and helmet.
16. "The Contractor may be required to provide narratives, sketches, material catalog cuts, and quantity take-off with each Task Order proposal to ensure common understanding."
Will any of the work requiring these deliverables involve equipment or facilities subject to the International Traffic in Arms Regulations (ITAR) or the Export Administration Regulations (EAR)?
a. The current RFP does not identify any equipment or facilities as ITAR- or EAR-controlled.
If a future Task Order involves controlled equipment, controlled technical data, or restricted areas, that requirement would need to be specifically identified in the Task Order RFP or by amendment.
17. Infrequently the Government may provide materials or equipment to be installed by the
Contractor.
Will any of this material or equipment be subject to the International Traffic in Arms Regulations (ITAR) or the Export Administration Regulations (EAR)?
a. The current RFP does not identify any Government-furnished material or equipment as ITAR- or EAR-controlled. If a particular Task Order includes controlled Government-furnished equipment or related access restrictions, that would need to be expressly identified in the Task Order RFP or in subsequent Government direction.
18. The Contractor, with his/her own forces, shall transport all Government-furnished equipment/materials described on the Task Order at his/her own expense. The equipment/materials will be transported from the Government storage area to the work site indicated on the Task Order.
Is the Government storage area for each job site in Somalia located on-site, elsewhere in-country, or in other countries?
a. Storage areas will be on site.
19. Wear hard hats and other required PPE as applicable in designated areas . . . Will ballistic protection (vest, helmets) be required at any jobsite in Somalia?
If required, will the Government furnish the equipment?
a. Yes it will be required to have onsite but not worn at all times unless FPCON is increased. No it will not be provided.
20. Materials and equipment may not be stored at the jobsite lay down area after work hours unless approved in advance by the KO or COR.
Will the Government confirm that secure after-hours storage space will be available for all offeror tools and equipment at all locations?
a. "No. The RFP does not guarantee secure after-hours storage space at all locations. The solicitation states that after-hours storage at laydown areas requires prior approval, and if storage space is not identified in the Task Order, the Contractor shall assume none is available. The Contractor is also responsible for protecting and securing its own equipment and materials.
21. Will the Djibouti JOC contract fall under the current SOFA agreement?
a. Yes
22. Are there any defense or SOFA-like agreements with Somalia that may involve tax exemptions?
a. United States does not maintain SOFA-like agreement with Somalia.
23. Due to the location of potential task orders under this contract, coordination is needed to ensure compliance with Client's request of 30 day onsite performance. Would NAVFAC consider an extension on the required submittal date to allow for further coordination with supporting trade services?
a. An extension will not be granted.
24. The solicitation lists NAICS 236220 (Commercial and Institutional Building Construction) with a size standard of $45M. The offeror's primary NAICS in SAM is 541330 (Engineering Services). Will the Government evaluate the offeror's size status based on NAICS 236220 revenues only, and is there any disadvantage to an offeror whose primary NAICS differs from the solicitation NAICS?
a. The Government evaluates an offeror's size status based only on the NAICS code assigned to the specific solicitation. There is no disadvantage to an offeror whose primary NAICS code differs from the solicitation's assigned NAICS.
25. We respectfully inquire whether a bank reference letter can satisfy the requirement stated in the “Letter from the offeror's surety,” specifically regarding verification that the offeror has an aggregate bonding capacity of at least $3 million.
a. No, a bank reference letter is not an acceptable substitute for a letter from a Treasury-listed surety company.
26. Due to the tender period coinciding with the Ramadan Feast, we respectfully inquire whether the submission deadline could be extended by at least one week.
a. Proposal due date has previously been extended.
27. Can the Government confirm if Somalia-based JOC requirements will be managed/negotiated through the customer’s existing Djibouti-based project management element or if they will be managed/negotiated via the project management element on the ground in Somalia?
a. Contract management, negotiation, and Task Order issuance will remain under the existing Djibouti-based Government contracting and project management framework, while execution may require coordination with local/site personnel depending on the specific Task Order.
