AMENDMENT 0006

The purpose of this Amendment is to:

1. Add Section C-1.4.3.3 Prescription Drugs and Eyeglasses as shown in red font followed by the associated amendment number in superscript.

2. Revise Attachment V per Questions & Answers below.

3. Respond to solicitation questions. Questions are italicized and answers are in bold font. All questions received have now been answered as of this amendment.

Solicitation N32205-21-R-4117 Questions and Answers

99. We are still waiting for final CBA’s from our unions, and as you know we can’t finalize our pricing without these critical items. Given the upcoming holidays and the need to complete normal end of year accounting functions we request a 2 week extension on the due date for the proposal. Will the Government consider this request?

ANSWER: The closing date was revised in Amendment 0004. See SF-33 for closing date.

100. Question 31 and 32 asked what the work hours were for the wages shown in Appendix B for the SIU, the answer referred to the work hours shown in Section B.1.15 and Section C1.7.10.2. We are aware of what hours the crew is to work, what the question was trying to determine was whether the wages shown in Attachment B for the SIU on the Bobo class included the first 8 hours on Saturday and Sunday or if the SIU were paid overtime for those hours and whether on the Stockholm whether the wages paid included the first 8 hours on Saturday and Sunday or if they were paid overtime for the first 8 hours on these days. Please have the SIU MOU updated to define when overtime is payable on the Bobo Class vessels and on the Stockhom so that we may insure we are incompliance with the SCA.

ANSWER: See amendment 0003, question #62 for information on when overtime is payable. The Wage Determination establishes the minimum wage and fringe benefit requirements required by the Department of Labor for the contractor's employees covered by the Wage Determination.

101. The answer to Question 33 was not sufficiently answered. We understand that the unions provide the CBA, however for us to certify that we are incompliance with the SCA, the information provided in the RFP needs to provide all the wage and benefit information. The MOU for the Stockholm for with the AMO, did not provide ROS benefit costs.

Without this information we will not be able to certify we are in compliance with the SCA. Please have the AMO update their MOU.

ANSWER: In the AMO memorandum of understanding for USNS STOCKHAM, Section II, Reduced Operation Status (ROS) and Repair Availability (RAV), paragraph A, Wages, states “For the purpose of calculating the defined contribution benefits, the Officers earned Weekly Base Wage shall be used to calculate benefits for all shipboard and vacation days.”

102. Please provide the missing sections: 6.8.1, 6.8.2, 6.8, 6.10.26.11.4, 6.12.3, 6.12.4, 6.13.1.1, 6.13.1, 6.17.1, 6.17.2, 6.18.1, 6.18.4, 6.19.1, 6.19.2, 6.19.3 ANSWER: These sections are reserved for future use and have been marked accordingly in amendment 0005.

The Government is not using these sections at this time.

103. C-6.4.5.3 & C-6.4.5.4 LAN/IT Managers: These individuals must be certified to Operating System (OS) certification for Win 7 or appropriate version being utilized onboard the MSC Vessels, along with A+, NETWORK + and SECURITY+. Technical Exhibit 1 indicates that current client/server architecture is using XP/Server 2003.

These systems are outdated and certifications for them no longer provided by authorized Microsoft vendors. Will the government respect a more modern/current Microsoft OS certification?

ANSWER: The MSC networks are currently running on Server 2008 and Win7 or WIN10 with the Update. See revised Technical Exhibit 1 in Attachment V.

104. Att L AMD 2 / Att P - New Tabs D7 and D8 were added in AMD 2 for Comms Suite pricing for each Squadron. Is it the governments intent that the Shore Based Manager costs be split between the two squadrons since the costs are Comms Suite associated or to include them elsewhere in our fixed expenses?

ANSWER: IAW with Section C-3.7.2.a, “The contractor shall include all costs associated with shore side personnel support in the contractor’s fixed rate.” Amendment 0002 revised the table in this section to include the Shore Based Communication Manager.

105. Att L AMD 2 - New Tabs D7 and D8 were added in AMD 2 for Comms Suite pricing for each Squadron. Since these costs are associated with OCONUS ROH, OCONUS major repairs, is it the governments intent that the Shore Based Manager costs be split between the two squadrons since the costs are Comms Suite associated or to include them elsewhere?

ANSWER: See question #104.

106. Att L AMD 2 - New Tabs D7 and D8 were added in AMD 2 for Comms Suite pricing for each Squadron. Since these costs are associated with OCONUS ROH, OCONUS major repairs, will the vessels be in FOS during these OCONUS ROH and repair periods for pricing purposes?

ANSWER: When a flagship enters a shipyard availability, a Flag Shift typically occurs. Services shall be provided IAW section C-6.1. See sections C-6.2.1 and C-6.3.1 for further information on Flag Shifts.

107. Att L AMD 2 - New Tabs D7 and D8 were added in AMD 2 for Comms Suite pricing for each Squadron. Since some of these costs are associated with CONUS ROH with the vessel in RAV, where should we price the attendance as D7 and D8 only provide for FOS rates?

ANSWER: See questions #106

108. The Government did not adequately answer Question 50 in Amendment 003. If the labor agreements that are part of the subsequent contract require payments to crewmembers who are restricted to the ship by either local authorities or MSC policy due to the COVID-19 global pandemic or other similar events will these payments be reimbursed by the government under the terms of the contract?

ANSWER: MSC is not able to provide a more definitive response to Question 50 in Amendment 0003 because the response depends on many variables, such as the specific collective bargaining agreement wage determination in effect and incorporated into the contract at the time, the terms of the contract and the facts and circumstances resulting in the implementation of a liberty restriction at a given location.

109. The Government’s answer to Question 74 in Amendment 003 does not appear to be correct. The contractor will be the employer of the Communications Suite personnel regardless of their union affiliation, as are all of the shipboard employees working aboard these ships. If the employee is working on a federal service contract, the government must provide a wage determination for the position. Will the Government reconsider the answer to Question 74 and provide a wage determination for the onboard Communications Suite personnel required by this contract?

ANSWER: The Government submitted a Communications Suite personnel wage determination request to the U.S. Department of Labor. When received, the wage determination will be incorporated via amendment.

110. While the Answer says a “Communications Suite” training section has been added to C1.8.1.a, it appears to be missing so we cannot provide adequate pricing. The section titled “Communications” is the same training required for vessel crew not the comms suite staff. Please provide the required training for communication suite personnel.

ANSWER: Amendment 0005 updated the training matrix to include the Communications Suite training.

C-1.1.4.1. Directives The contractor shall comply with the MSC Standard Operating Manual (SOM), COMSCINST 3121.9 (series), Standard Operating Manual (SOM) and the other directives referenced in this contract. In cases where the SOM and this Contract conflict, the contractor shall notify the COR, and the Operational Commander immediately.

C-1.1.5. Operational Control (OPCON) Operational control of the ships covered under this contract is normally exercised by a designated operational commander who may or may not be the cognizant MSC Area Command. The contractor shall comply with Operational Commander's and MSC Area Commander’s operational control direction. If there is a conflict between the Operational Commander and the MSC Area Commander then the contractor shall follow the direction of the Operational Commander. In exercising command authority commanders are not authorized to make changes to the scope of the contract. If compliance will result in expenses that will exceed available funding obligated to the contract, then the Contractor shall obtain preapproval IAW section G-7, prior to incurring the expense.

The contractor shall comply with all anti-terrorism/force protection (AT/FP) and other security requirements for the ships while at sea and in port that the Operational Commander requires MSC ships follow. Expenses incurred in performance of meeting AT/FP and other security requirements will be reimbursable when the contractor obtains contracting officer approval prior to incurring the expense. If a situation arises which prevents the operator from complying with mission tasking, the contractor shall immediately notify the Operational Commander and provide an information copy to COMSC and the cognizant MSC Area Commander.

The Operational Commander or Area Commander will obtain clearances to call at foreign ports for each ship. Each operational mission will be the subject of a classified Operational Order (OPORD) or Sailing Order (SAILORD) that specifies exactly how the mission will be accomplished. The contractor shall comply with all direction and instructions in OPORDs. The Master is authorized to make minor deviations from sailing orders to meet mission requirements, provided the Master immediately notifies all commands within the operational chain of command of the deviation.

The contractor shall immediately report any delay of any ship and/or diversions from operations to the Operational Commander.

C-1.1.5.1. Tactical Control (TACON) The command exercising TACON will issue sail orders IAW the established ship schedules. The contractor shall comply with all sail orders. However, the Master is authorized to make minor deviations from sailing orders to meet mission requirements, provided the Master immediately notifies all commands within the operational chain of command of the deviation.

C-1.1.5.2. Administrative Control (ADCON) Administrative control of the ship will be exercised by the Program Management Office, Military Sealift Command Headquarters (MSC HQ).

C-1.1.6. Area of Operations The contractor shall plan to operate the ships worldwide and have the ability to do so during the entire period of performance. At time of solicitation, ships are operating in the areas identified in C-1.1.6.a.

C-1.1.6.a. Vessel Operating Areas The Government anticipates prepositioning three of the vessels in the Indian Ocean (Diego Garcia - Squadron 2) and three of the vessels in the Western Pacific (Guam/Saipan or Korea– Squadron 3). The government does not provide any guarantee the ships will continue to operate in these areas during the contract’s period of performance. Contract price shall not be increased or decreased to account for cost changes due to a change in ship(s) operational locations.

Concept of Operations:

At commencement of Contract performance and throughout the performance period of this contract, the government anticipates the ship(s) will be operated as indicated in C-1.1.6.b. However, the Government may direct ships to be placed into a Full Operating Status (FOS), Reduced Operating Status (ROS), Repair Availability Status (RAV) at any time and offerors shall account for this risk in their pricing. Contract’s firm fixed price shall not be increased or decreased to account for cost changes due to a change in a ship’s operating status.

C-1.1.6.b. Operating Tempo (OPTEMPO) Normal OPTEMPO for each ship in FOS is based on its prepositioning location. The below percentages are an estimate of the ships’ OPTEMPO and they do not include the ship(s) transits to/from CONUS to conduct maintenance or participation in military exercises. Future OPTEMPO may radically vary from the estimates below.

LOCATION INPORT (anchor or pier side) UNDERWAY Marine Corps Ships Worldwide 92% 8%

Underway periods consist of all time a ship is operating outside of a port, which includes but is not limited to:

independent steaming, speed trials, convoy operations and transits to and from selected ports for ship and cargo maintenance or for the loading or discharging of cargo in support of sponsor exercises. The government does not guarantee future OPTEMPO will be similar to past OPTEMPO. Operational commitments drive OPTEMPO of ships.

Operational commitments during this contract’s period of performance may radically differ from past operational requirements.

C-1.1.6.3. General Operations The contractor shall ensure the ship(s) and all ship(s) equipment, systems, and appurtenances are continuously maintained in good working order and repair regardless of the frequency or importance of use.

In case of emergency, nothing in this Contract shall be construed as preventing the Master from taking the most effective action to safeguard life, property and the ship. The Master shall have authority to abort operations temporarily on the basis of clear and present danger to life at sea. Upon abortion of any operation, the Master shall inform the OPCON with an information copy to COMSC and the cognizant MSC Area Commander. The Master shall provide a written report of the action taken, the rationale for the action, and recommendations to prevent a future recurrence of a similar event that requires a Master to abort an operation. The Master shall submit the written report as soon as possible but not later than five working days of the aborted event. Under normal operating conditions the Master shall not take any mission-aborting action without the prior approval of the
