About this file

This document is a solicitation for the execution of the USS TRIPOLI (LHA 7) FY23 SELECTED RESTRICTED AVAILABILITY (SRA). The Naval Sea Systems Command (NAVSEA) seeks to award a single contract to a capable contractor to complete maintenance, modernization, and repair of the USS TRIPOLI. The availability requires substantial facilities and human resources to complete, coordinate, and integrate multiple areas of ship maintenance, repair and modernization over approximately 12 months from March 2023 to March 2024. Interested parties must request access to relevant attachments and comply with the announcement on SAM.gov. The solicitation is not set aside for small business as the Governments market research indicates no two or more small businesses are capable of meeting these complex requirements. The Technical POC is Timothy Russell and the Government anticipates awarding a single contract in or around December 2022.

Question Date Contractor Question Government Response

38 7/25/2022 As FAR 11.5 requires a cap or max on Liquidated Damages, will the Government add a cap or max?

Section I, FAR 52.211-11, Paragraph (a) is updated to read as follows: (a) If the Contractor fails to deliver the supplies or perform the services within the time specified in this contract, the Contractor shall, in place of actual damages, pay to the Government liquidated damages of $372,701 (not to exceed 10% (5% for Small Business) of the awarded price of the availability, including all Base and Option CLINs, for milestone Contract Complete - Mission Ready Vessel Redelivered to Fleet) per calendar day of delay.

39 7/25/2022 Contractor notes that the specification does not address how the antenna is to be handled. Are bidders to remove the antenna along with the bracket? Or is no antenna present despite being directed to place it in lay-up by 993-31-001; Waveguide and Transmission Line Dry Air Lay- Up? Please clarify and advise.

All the listed antennas will remain in place. Contractor is only responsible for keeping the waveguides and transmission lines pressurized with the appropriate dry air. Antennas will be placed in layup by ship’s force until CSLO.

40 7/25/2022 The J-3 R1 ERL indicates that Open and Inspect 20% Reports are required for work items 262-41-003 and 262-42-002. However, when referring to the J-10, it indicates paragraph 3.2.2.2 for both work items, which does not exist in either work item. Can the Gov't clarify the 20% Report requirement for these two work items?

For 262-41-003 and 262-42-002 the paragraph should be 3.3.3.2 in lieu of 3.2.2.2.

42 7/25/2022 If the availability is executed at the Government provided pier, will the Government be providing the barge and gangway for this work item?

At which end will the barge need to be placed, forward or aft of the ship, for the entire availability?

The Government will provide the Barge and Gangway to the Barge. The placement of the barge will be determined by Port Ops at a later date and can be discussed at the WPER.

43 7/25/2022 Which C5ILO date listed on the Exec Milestones tab correlates to C5ILO on the PERL tab? On the J-3 Exec Milestone tab, C5ILO Combat Systems Lightoff (10/10/2023) correlates to the C5ILO on the PERL

44 7/25/2022 Contractor notes that (6) of the (36) dates listed on the Exec Milestones tab land on a weekend and recommends revising the dates to a weekday. Is it the Government's intention to hold to the (6) weekend dates, or will these dates be revised? The dates on the J-3 Exec Milestone Tab have been revised.

45 7/25/2022

In reviewing the specification package, there are work items that identify the location and requirements for the Contractor's facility.

Contractor assumes that any work item where the Location of Work is identified as "In the Contractor's Facility" or "Contractor's Plant", will not be required/needed if using the Government provided pier. Does the Government concur? If no, please clarify which items and requirements will still be necessary if using the Government pier.

The government concurs, the Contractor's Facility/Plant will not be needed if Government Peir is provided.

46 7/25/2022 Will the Towboat Service and Fuel Barge be required if the availability is executed using the Government provided pier? Please clarify refueling requirements if Bidders use the Government provided pier.

If the government provided pier is used the ship will schedule the fuel barge and Port Ops will schedule tow services.

47 7/25/2022 Contractor notes that there is no location identified for this work item. However, it does say the the offices must be within 1/4 mile from the vessel and multiple mentions of the "Contractor's Facility" and "Contractor's Plant". Will this work item be required if Bidders are using the Government provided pier? If yes, please clarify requirments for bidders using the Government pier.

Please clarify your question. 992-11-010; there is no paragraph 1.2.2.

Paragraph 3.1 does not mention an office.

48 7/25/2022 Will the requirements listed in Para 3.12 apply if Bidders use the Government provided pier? If the Bidder uses athe Government provided pier, then paragraph 3.12 "Provide a watch hut", will not apply.

49 7/25/2022 Will a messing and berthing barge already be present/on station for Ship's Force if Bidders use the Government provided pier? Yes a messing and berthing barge will be present/on station for Ship's Force if Bidders use the Government provided pier.

50 7/25/2022 The J-3 R1 PERL indicates that Open and Inspect 20% Report is required for work item 321-11-005. However, when referring to the J-10, it indicates paragraph 3.2.1 which is for 009-12 weld repair vice inspection. Contracts believes the correct para is 3.1.2. Can the Government clarify the 20% Report requirement for this work item?

Governments concurs, the correct paragraph is 3.1.2 vice 3.2.1.

51 7/25/2022 Para. 3.5 is asking to accomplish a 009-13 for each gage, temperature and pressure switch. There are numerous gages and switches on the refrigeration plant. Requesting the Gov't to be more specific on exactly which gage (pressure and temperature) and switch (pressure and temperature) they wish calibrated.

Paragraph 3.5 was deleted in Errata #2

52 7/25/2022 Para. 3.5.1 is indicating there are “new” gages and switches temperature & pressure but none are called out to be procured. Please clarify if we are to procure new gages and or switches pressure and or temperature Paragraph 3.5.1 was deleted in Errata #2

53 7/25/2022

Page 163, Section L paragraph IV.C.2.b,1, 2 and 3 lists Emphasis Area A (Manpower), Emphasis Area B (Physical Resource Capacity) and Emphasis Area C (Production Schedule) respectively.

However, page 167 Section L paragraph V.B.2 only discussed the actual breakdown of Emphasis Area C (Production Schedule) and is silent or completely omitted Emphasis Area A (Manpower) and Emphasis Area B (Physical Resource Capacity).

Please provide actual breakdown or explain the contents of Emphasis Area A (Manpower) and Emphasis Area B (Physical Resource Capacity).

Concur. The RFP will be updated to reflect the correct proposal format in Section L to reflect:

a) Factor 1: Technical Eligibility - No page limitation

b) Factor 2: Production Schedule - No page limitation

c) Factor 3: Past Performance - No page limitation

Par. 3.1 calls out to use Ref 2.2 in removal and replacement of items in 1.3 However, Ref 2.2 is useless as it only shows a bird's eye view of items in 1.3 on sheet 4

Please provide 2nd tier reference 664-7566128 (Ref 16 in 2.2) and invoke it in the specification.

Or provide amplifying/ordering information of items in 1.3 to include part numbers or stock numbers and APL.

Errata #2 was issued to change the scope of work to remove light fixture and hinge leaf mounting brackets only. No installation will be required.

56 7/25/2022 Para. 1.2 shows the location as "Contractor Facility / Naval Base San Diego". For bidders located in San Diego the barge will not be in open water and therefore paragraphs 3.3 through 3.5.7 do not apply. Please confirm.

Government confirms paragraphs 3.3 through 3.5.7 do not apply to bidders located in San Diego.

59 7/25/2022 Work Item 857-11-001 requires transportation of the crew between the Naval Station parking area and the living facility while the ship is in the contractor's facility. If the offeror proposes to execute the SRA at the Naval Station, San Diego, please confirm the requirements of this work item are not required?

Government confirms the requirements are not required for bidders located in San Diego.

60 7/25/2022 Work Item 857-11-001 requires transportation of the crew between the Naval Station parking area and the living facility while the ship is in the contractor's facility. For estimating purposes, what is the dropoff and pickup location of the berthing facility in San Diego and for each o the locations listed in the RFP, Section L, V - Proposal Content, paragraph 6, "Inter-port Differential (IPD)."

The pier differential represents the expected value of the temporary services to be provided by the government in the event the availability is conducted at the Naval Base San Diego. The government does not intend to provide the calculations used to determine the pier differential to bidders at this time.

61 7/25/2022

Work Item 857-11-001 requires transportation of the crew between the Naval Station parking area and the living facility while the ship is in the contractor's facility. There isn't currently a work item for providing off-ship berthing. Offeror is aware that there is insufficient capacity in Navy housing in the IPD ports to provide the required off-ship messing and berthing for this SRA. Please clarify the Navy's plan for providing off-ship berthing in the IPD ports other than San Diego.

The Fleet Commander is responsible for providing the crew berthing during the availabilty in the event the availabilty is out of the homeport.

62 7/25/2022

Work Item 857-11-001 requires transportation of 1,100 crew members between the Naval Station parking area and the living facility while the ship is in the contractors facility indicating the intent to move the crew off of the ship during the SRA. The interval between the Availability Start milestone and the Habitability Complete milestone listed in Attachment J-3 is 226 days. GSA per diem rates (housing, M&I) for current year 2022 are $256 per day for Portland, $311 per day for Seattle, $292 for Vallejo and $235 per day for San Diego.

Therefore, the increased cost to the Government over San Diego for housing and meals per person in Portland is $21 per day, Seattle $76 and Vallejo $57. Applying these differentials to the crew size specified in the work item and the number of days specified by RFP Attachment J-3 results in an increased cost to the Government of $5.2M for Portland, $18.8M for Seattle and $14.1M for Vallejo over the cost in San Diego. The IPD rates in the RFP for these three locations are only $6.9M, $3.1M and $2.8 respectively. Since off ship berthing and meals is a cost to the Government regardless of how it is budgeted, how are the costs of messing and berthing the crew off-ship accurately being accounted for in the Total Evaluated Price? Please clarify.

The Fleet Commander is responsible for providing the crew messing and berthing during the availabilty in the event the availabilty is out of the homeport. This is funded internally by the government. The IPD takes this into account.

63 7/25/2022

Work Item 992-11-011 requires pickup and towing of a personnel berthing barge from Naval Station San Diego, to the contractor's facility and returning to the naval Station San Diego when directed. Please confirm this work item is not required to be priced for offers who may propose to execute the SRA at the Naval Station, San Diego since the barge is already located at the Naval Station and contractor commercial tugs aren't allowed acces to the Naval Station.

Government confirms the requirements are not required for bidders located in San Diego.

64 7/25/2022 Work Item 992-11-011 requires pickup and towing of a personnel berthing barge from Naval Station, San Diego, to the contractor's facility and returning to the naval Station San Diego when directed. Please confirm type (APL or YRBM) of the barge to be towed.

The type of barge cannot be determined at the present time - the availability of barges will be determined closer to the strart of the availability.

65 7/25/2022 Work Item 992-11-011 requires towing of a berthing barge but there isn't currently a work item to provide services for the berthing barge.

Please clarify.

Berthing Barge work item is 992-11-012. The work item should be priced by all bidders. This item should be bid for all possible execution areas as an option item that may/may not be invoked prior to the start of the availability. If an offeror believes that this work item does not apply, they have the opportunity to propose $0. However, if circumstances change and a berthing barge is not available, this work item would need to be invoked.

66 7/25/2022 Work Item 992-21-001 requires removal and disposal of 50,000 gallons of lubricating oil. Please confirm the accuracy of this quantity.

Should this be 5,000 gallons of lubricating oil? The bidder's should estimate for 50,000 gallons for Lubricating Oil.

Work Item 992-21-001 requires removal and disposal of approximately 500,000 gallons of distillate and JP-5 fuels to a contractor provided conveyance. Historically in San Diego, this offload effort has been done at the Navy fuel depot or by a Government provided fuel barge at the shipyard or Naval Station SRA location of work. Additionally, in San Diego, the uncontaminated fluids, IE; distillate fuel and JP-5 fuel have historically been offloaded and recovered rather than disposed of. Why is a Government fuel barge not being provided for this effort for San Diego offerors?

The 400,000 gallons of distillate fuel and the 100,000 gallons of JP-5 are to be recovered as stated in 3.1.2.

Errata #2 was issued to change verbiage to "from the low suction level"

Errata #2 was issued to change verbiage in 992-21-001 to "Government provide barges"

68 7/25/2022

69 7/25/2022 Work Item 992-21-001 requires removal and disposal of approximately 500,000 gallons of distillate and JP-5 fuel to a contractor provided conveyance. Please confirm the fuel levels listed are only the amounts below low suction as per the guidance in JFFM Volume Vll. Errata #2 was issued to change verbiage to "from the low suction level"

70 7/25/2022

Work Item 992-21-001 requires removal and disposal of approximately 500,000 gallons of distillate and JP-5 fuel to a contractor provided conveyance. Historically in San Diego, this offload effort has been done at the Navy fuel depot or by a Government provided fuel barge at the shipyard or Naval Station SRA location of work. If the SRA is awarded to an offeror outside of the vessel homeport area of San Diego, the vessel will transit to the shipyard under its own power and fuel levels will likely be above low suction on arrival at an additional cost to the Government for removal and disposal of the additional quantities of fuel. As stated in Volume VII of the JFFM, "It is difficult, very costly and disruptive to off-load and transport or even shift fluids during any availability, especially in a contractor’s facility that has the potential to result in a REA or even a claim for delay or disruption." How is that additional cost of disposal above low suction for offerors outside of the San Diego homeport accounted for in the TEP evaluation for the contract award of this SRA?

The contractor should price the appropriate work items and the estimated costs will be included in the TEP.

71 7/25/2022 Work Item 992-21-001; Please change the work item to make the fuel barges for the defueling effort Government provided barges instead of contractor provided similar to Work Item 992-11-006.

Errata #2 was issued to change verbiage in 992-21-001 to "Government provide barges"

72 7/25/2022 Work Item 992-11-006; Contractor commercial tugs aren't allowed inside of the US Navy Fuel Depot in San Diego. Please clarify the towing logistics of the (2) fuel barges for paragraph 3.2.

Errata #2 was issued stating: para. 3.2.1 : Navy tugs will be used to get fuel barges from Fuel Depot and turn over fuel barges to Contractors tugs prior to entrance to their facility.

Para. 3.2.2 : Contractors tugs will turn barge over to Navy tugs upon leaving Contractors facility to be returned to the Fuel Depot. An errata will be issued to add the following

73 7/25/2022 Work Item 992-11-006; This work item requires towing 2 fuel barges from the nearest US Navy Fuel Depot to the contractor's facility. For shipyards outside of the vessels homeport of San Diego, how will the Government account for the cost of executing this work item in the total evaluated price, for shipyards that don't have access to a US Navy Fuel Depot.

This item should be bid for all possible execution areas as an option item that may/may not be invoked prior to the start of the availability. If an offeror believes that this work item does not apply, they have the opportunity to propose $0. However, if circumstances change and a berthing barge is not available, this work item would need to be invoked.

74 7/25/2022 Please clarify which work items in Attachment J-4 apply to Out of Homeport Offerors only and are not required to be priced by Homeport Offerors.

If outside of San Diego, the work item should be priced by all bidders. This item should be bid for all possible execution areas as an option item that may/may not be invoked prior to the start of the availability. If an offeror believes that this work item does not apply, they have the opportunity to propose $0. However, if circumstances change and a berthing barge is not available, this work item would need to be invoked.

75 7/25/2022 For the Liquidated Damages clause, will the Government append the following industry standard language to paragraph a)?:

For large businesses, the sum of liquidated damages shall not exceed 10% of the awarded price of the availability.

For small businesses, the sum of liquidated damages shall not exceed 5% of the awarded price of the availability.
