| QUESTIONS AND ANSWERS #1 | ||
| The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation. | Wednesday, April 03, 2019 | |
| HULLS/TITLE: | DDG 112 USS MICHAEL MURPHY | |
| SOLICITATION NO: | N00024-19-R-4404 | |
| NAVSEA POCs: | Steven Galer |
Zachary Tucker NAVSEA POC E-MAIL: Steven.Galer@navy.mil Zachary.M.Tucker@navy.mil NAVSEA POC #: Steven Galer: 202-781-2040 Zachary Tucker: 202-781-4234
| QUESTION #/ DETAILS | QUESTION/ ANSWER | |||||
| # | Question Area | Para # | Date Received | Contractor Question | Government Response | |
| 1 | Place of Performance | N/A | 19-Mar-19 | What pier will USS MICHAEL MURPHY FY20 SRA be conducted at? | ||
| JBPHH has moderate to significant pier limitations that impact pier-side availabilities. Costs to mitigate risks need to be incorporated into offerors’ bids. | Offerors should propose assuming pier B15/16. There is a mobile crane limitation of 60tons. | |||||
| 2 | GFP Differential | Section L | 19-Mar-19 | GOVERNMENT FURNISHED PROPERTY DIFFERENTIAL: |
Please provide details regarding “Government Furnished Property provided under the MSMO contract”? Exactly what Government Furnished Property is being provided by the Government in support of USS MICHAEL MURPHY FY20 SRA?
Please provide cost components and values that comprise the Government Furnished Property Differential of $344,843? The Government is providing the following GFP under the MSMO contract that would be expected to be used by the MSMO contractor in execution of the USS MICHAEL MURPHY FY20 SRA:
Building 1444 Office Space Building 1444 Machine Shop Building 139 Compound Land Vision Tower 7 (VT-7) Office Space Building 394 Warehouse Space Building 388 Warehouse Space Annex C Land Bravo Pier Laydown Land DD4 Improved Space Land The MSMO contractor does not pay the Government for the use of these buildings or for the building services. Therefore, the GFP differential cost is comprised of the implied building and land rental values (based on prevailing local rates) and the implied operating costs, specifically utilities, management fees, building maintenance, real property taxes and insurance (based on prevailing local rates).
3 Section C, Statement of Work 2.2 19-Mar-19 Government defines minor delay as (8) hours or less. The subject duration can represent an entire day/shift of productive effort on the critical path.
Further, this definition of a “minor delay” incongruous with the balance of MURPHY RFP’s terms and conditions that stress schedule adherence and penalize the contractor for violations.
Recommend minor delay be defined as (2) hours or less.
| This is a standard definitition used throughout the enterprise which will remain unchanged. | ||||
| 4 | Section B | N/A | 19-Mar-19 | Level of Effort (LOE) to Completion |
What is the Government's basis for the LOE-completion growth requirement?
Please provide guidance as to the methodology Industry is to assume to develop a fully burdened labor rate for the complete execution of unknown scopes of work? Historically, work specifications containing growth reserve have provided a means to accomplish anticipated repairs which could not be clearly defined in advance of the ship’s availability due to operational restrictions or ship limiting evolutions (e.g., situations where assessments or ship checks cannot be completed or were only partially completed). Under the LOE-completion growth CLINs, anticipated growth is specifically defined and planned based upon historical growth for like or similar work specifications.
The offeror's price for LOE-completion growth CLINs shall reflect the requirements of RFP Section B, NOTE B: FIXED SHIP REPAIR LABOR AND MATERIAL BURDEN RATES FOR GROWTH AND NEW WORK.
5 Small Dollar Changes Note F 19-Mar-19 NOTE F: SPECIAL AGREEMENT FOR GROWTH WITH A VALUE OF $25,000 OR LESS:
How does the Gov’t rationalize a per occurrence value of $7,894 value when $25,000 is the threshold for application? Please explain how the Government derived this $7,894 per occurrence value? Will the Government adjudicate this provision for each individual contract change valued at less than $25,000? How was the number of occurrences (72) derived?
To increase the velocity of change that occurs during ship repair and modernization availabilities, the Small Dollar Value Growth clause establishes a streamlined process to reconcile growth expected to be between $1 and $25K.
To make administration of small dollar value growth more efficient and less costly, both parties (Government and contractor) agree to pre-price increase price changes with an estimated price of $25,000 or less. The values of price and quantity were derived by reviewing and analyzing historical data for the same or similar items at Pearl Harbor, HI.
The quantity, as specified for each CLIN, will be utilized for each change valued between $1 and $25 until the quantity for that CLIN reaches zero.
6 Section C, Statement of Work 1.9.2 19-Mar-19 1.9.2 Quality Assurance Surveillance Plan (QASP)
For every incorrect / late CAR, CFR, etc., that is issued by the Gov’t, which creates contractor inefficiencies & delays, will the QASP value be deducted?
| Deducts will be based on unfavorable contractor performance as determined by the ACO. There will be monetary deducts as outlined in Enclosure (1) of the QASP. Application of any deductions in accordance with Enclosure (1) of the QASP is at the ACO’s discretion. It is not the intent to enforce deductions which are directly caused by the Government. | ||||
| 7 | Section C, Statement of Work | 4.4 | 19-Mar-19 | PAINT ABATEMENT - Abatement work will be conducted in accordance with NAVSEA Standard Item 009-32. Paint abatement will be included as part of offerors’ proposed pricing and is not subject to additional growth. |
The above requirement is impractical and unreasonable.
The Contractor has no prior knowledge of paint conditions in all affected, accessible and inaccessible areas. Recommend deletion in its entirety.
| This is an enterprise-wide definition and implimentation of the Standard Item used throughout the enterprise which will remain unchanged. | |||
| 8 | Section L | 19-Mar-19 | “52.216-1 TYPE OF CONTRACT (APR 1984) |
The Government contemplates award of a Firm Fixed Price with a performance incentive contract resulting from this solicitation.”
Please provide details of the contemplated “performance incentive” contract.
Liquidated damages and punitive QASP requirements were noted; however, performance incentives were not.
| An amendment will be used to revise to "The Government contemplates award of a Firm Fixed Price contract resulting from this solicitation.” | |||||
