SECTION SF 30 BLOCK 14 CONTINUATION PAGE
The following items are applicable to this modification:
REVISED SUMMARY OF CHANGES
The purposes of this amendment to solicitation N00024-17-R-2462 are to:
a) Respond to questions submitted by potential Offerors;
b) Revise SECTION C - DESCRIPTIONS AND SPECIFICATIONS;
c) Revise SECTION J - LIST OF DOCUMENTS, EXHIBITS AND OTHER ATTACHMENTS, and;
d) Revise SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS.
1. The following questions were submitted by potential Offerors. The Government’s response follows each question. Questions and Answers 050 through 057 are provided in this Amendment 0008. Questions and Answers 001 through 049 were provided in previous amendments.
Question 050: The timing of the Quarterly Program Reviews (QPRs), as stated in C.1.3.4, as well as Contract Data Requirement List (CDRL) item due dates, entry criteria, and other predecessor requirements derived from the solicitation restrict the ability to schedule the three design reviews stated in C.1.4.5. Will the Navy consider revising one or more of the formal design reviews to enable the Contractor to shift individual Quarterly Program Reviews (QPRs) to provide some flexibility in the scheduling of the Functional Design Review, the Critical Design Review and the Production Readiness Review?
Answer 050: QPRs are flexible for scheduling to accommodate these formal design reviews. They do not need to be exactly 3 months apart and may be adjusted to align with the formal design reviews when appropriate. In order to resolve a conflict between SECTION C - DESCRIPTIONS AND SPECIFICATIONS, C.1.3.4, Quarterly Program Reviews, and C.18, SHIPBUILDING PRODUCTION PROGRESS CONFERENCES, C.18(a) will be revised via amendment.
Question 051: Will the Navy assume the risk of all physical damage to the vessel and related equipment while under construction and under sea trials (with the exception of faulty workmanship) ?
Answer 051: Yes. As stated in paragraph (b) of the clause entitled H.2 5252.228-9104 ADDITIONAL INSURANCE PROVISIONS (FT) (SEP 2009) (MODIFIED)(XXX 2017) :
“…. the assumption by the Government of the risk of loss of or damage to the vessels and the materials and equipment therefor provided for by the aforesaid paragraph (a) of the requirement entitled "INSURANCE PROPERTY LOSS OR DAMAGE LIABILITY TO THIRD PERSONS", shall continue until the expiration of the guaranty period(s) of the vessel(s), or until completion of all work under this contract, whichever is later. The Government does not, however, assume the risk of loss of or damage to any equipment which results from a defect in a part thereof for which the Contractor is responsible pursuant to the "PRELIMINARY ACCEPTANCE", "GUARANTY PERIOD", or "INSPECTION OF SUPPLIES--FIXED-PRICE - ALTERNATE I " (FAR 52.246-2) requirements of this contract.”
Question 052: Is the Navy responsible for “Collision Liability and Protection and Indemnity Liabilities” during the construction and sea trials?
Answer 052: Yes. The Navy is responsible for “Collision Liability and Protection and Indemnity Liabilities” during the construction and sea trials. As stated in paragraph (a) of the clause entitled H.2 5252.228-9104 ADDITIONAL INSURANCE PROVISIONS (FT) (SEP 2009) (MODIFIED)(XXX 2017):
“…the Contractor shall not carry Collision Liability and Protection and Indemnity Liabilities insurance (Government Syndicate Form) referred to in the first sentence of paragraph (b) of the requirement of this contract entitled "INSURANCE PROPERTY LOSS OR DAMAGE LIABILITY TO THIRD PERSONS" during the period of the performance of the underway trials.”
Question 053: Under the clause entitled H.12 5252.228-9105 INSURANCE PROPERTY LOSS OR DAMAGE LIABILITY TO THIRD PERSONS (FT) (JAN 1990), is the Contractor’s maximum limit of liability 80% of the contract price or $2,000,000 (whichever is less)?
Answer 053: Yes. As stated in paragraph (b) of the clause entitled H.12 5252.228-9105 INSURANCE PROPERTY LOSS OR DAMAGE LIABILITY TO THIRD PERSONS (FT) (JAN 1990):
“… the Contractor shall procure and thereafter maintain with respect to each of the vessels Collision Liability and Protection and Indemnity Liabilities Insurance (Government Syndicate Form), as set forth in the aforesaid 23 November 1942 pamphlet, if available, in an amount equal to (i) eighty percent (80%) of the sum of the target price of the vessel and an amount estimated by the Department to represent the value of materials and equipment furnished by the Government for installation by the Contractor, or (ii) Two Million Dollars ($2,000,000), whichever shall be less.”
Question 054: The contract refers to “Marine Builder’s Risk (Navy Form-Syndicate) and (Government Syndicate Form). Is the Contractor permitted to utilize the standard “American Institute Builders Risk Form" or equivalent?
Answer 054: No. As indicated in paragraph (a) of the clause entitled H.12 5252.228-9105 INSURANCE-PROPERTY LOSS OR DAMAGE-LIABILITY TO THIRD PERSONS (FT) (JAN 1990), the pamphlet entitled "Standard Forms of Marine Builders Risk (Navy Form Syndicate) and War Damage Insurance Policies, referred to in Vessel Contracts of the Bureau of Ships” dated 23 November 1942, sets forth the extent to which the Government assumes the risks of loss of and damage to the vessels and/or materials or equipment therefor to which the Government has acquired title or which have been furnished by the Government for installation aboard the vessels under the terms of the Contract. A copy of this pamphlet will be posted to the IDE for reference.
Question 055: Paragraph L.3.5.1.4.1 (vi.) requires submission of an FSCM number. It appears the FSCM number is no longer in use. Please confirm the FSCM number is not required.
Answer 055: The FSCM number is not required. SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS, L.3.5.1.4.1 (vi) will be revised via amendment to remove this requirement.
Question 056: There appears to be a discrepancy between the location of the Isolated Receptacle Panel on Drawing 100-5111356, General Arrangement & Inboard Profile and Drawing 300-5111361, AC Electrical System One Line Diagram. Please advise which document is correct.
Answer 056: The Isolated Receptacle Panel in drawing 300-5111361, AC Electrical System One Line Diagram, is correct. Attachment "A" to this amendment, Attachment J-1B, Drawing Package Cover Sheet, Attachment “B” to this amendment, Attachment J-1B , Drawing 100-5111356 Rev A, and Attachment “C” to this amendment, Attachment J-1B, Drawing 300-5111361 Rev A, AC Electrical System One Line Diagram, will be provided via the Integrated Digital Environment (IDE) to update the locations of the Isolated Receptacle Panels.
Question 057: Will the Navy provide planned durations for review, comment, and acceptance/approval of contractor’s CDRL deliverables?
Answer 057: Yes. The Government will provide a planned response timeline for CDRL deliverables. Attachment "D" to this amendment, provided via the IDE, identifies the Government’s planned CDRL response time. This timeline is provided for planning purposes only and will not be incorporated into the request for proposal or any resulting contract. Additionally, upon further review, certain CDRLs will be revised to change Block 8 from “Acceptance” to “Approval”. Therefore, Attachment "E" to this amendment, Attachment J-2D Exhibit B Index will be revised via amendment and provided via the IDE.
