BIDDER QUESTIONS & NAVY RESPONSES
QUESTION 1: Some projects require security clearance that we do not have. Do you have any information that could assist me in getting security clearances for my team?
NAVY RESPONSE 1: No security clearance is required for this procurement.
QUESTION 2: I am doing some research and I am hoping to look over the contracts for WorkBoat Large (GS07F6093P-N0002414F2204) and WorkBoat Medium (GS07F6093P-N0002414F2201) - are you able to help me with this or tell me how I can go about getting this information?
NAVY RESPONSE 2: To obtain the two referenced contracts, you would need to submit a FOIA request. The FOIA request website for NAVSEA is http://www.navsea.navy.mil/Contact/FOIA.aspx.
QUESTION 3: Attachment 9 CLIN Pricing for CLIN 1002 Pre Delivery Inspection and Trial shows a quantity of two (2) vessels. Please confirm this is correct quantity to be priced for CLIN 1002.
NAVY RESPONSE 3: The correct QTY to be priced for CLIN 1002 is two (2).
QUESTION 4: To respond to the RFP, contractors will incur a certain amount of non-recurring cost to develop the design, as well as comply with Specification Section 085 Technical Data Package and Equipment / Boat Technical Manuals configuration. Section B and Attachment 9 CLIN pricing only request pricing for an average boat price for the first 6 boats in CLIN 1001. Should the government not award all 6 boats in CLIN 1001, the contractor may not be compensated for all non-recurring costs. Please consider adding a one-time non-recurring CLIN to capture contractors non-recurring cost. Another option is to isolate the first boat price into a stand-alone CLIN in which contractors can include non-recurring cost. Additionally, contractors may have non-recurring costs for crew familiarization training development and option CLIN scope items (life rafts, capstan, cold weather package, transom swim platform).
NAVY RESPONSE 4: The RFP has been amended to incorporate a separate CLIN (6002) to capture NRE associated with the TDP.
QUESTION 5: Section L, Volume I, Item 1.C.ii.c requires contractors to provide a build schedule. Please provide notional dates for initial CLIN 1001 contract award, as well as future construction CLINs 2001, 3001, 4001, and 5001 contract award dates. This information is required to provide appropriate response to Section L, Volume I, Item 1.C.ii.c build schedule.
NAVY RESPONSE 5: We estimate award by Sep 2017, in which case the notional dates for the base year CLIN 1001 would be Sep 2017 - Sep 2018 and the notional dates for each of the option year CLINs would be the end date for the preceding CLIN + 1-year (e.g. notional dates for option CLIN 2001 would be Sep 2018 - Sep 2019).
QUESTION 6: Attachment 4 Delivery Schedule requests delivery dates in DARO (Days After Receipt of Order). Section L Volume I, Item 1.C.ii.c requires delivery dates in DACA (Days After Contract Award). Please advise if these acronyms are correct for Attachment 4 and Section L responses. Also please advise assumed CLIN contract award dates or order receipt dates that contractors should assume when producing the build schedule to respond to both the RFP Section L as well as Attachment 4.
NAVY RESPONSE 6: The RFP Section L reference to DACA (Days After Contract Award) has been changed to DARO (Days After Receipt of Order). See above response for answer to second part of question regarding CLIN award dates.
QUESTION 7: Will crane service be provided at SASEBO/YOKOSUKA, NNSYNSSPORTSVA, or PNSY to assist contactors with offloading boat hull and cabin from transport vehicles or vessels, as well as re-assembly of boat?
NAVY RESPONSE 7: No.
QUESTION 8: Please provide descriptions for following acronyms: NSROTA, NBPOINTLOMA, NSAPNYSYPORTSNH.
NAVY RESPONSE 8: NSROTA - Naval Support Rota. NBPOINTLOMA - Naval Base Point Loma. NSAPNYSYPORTSNH - Naval Support Activity Portsmouth Naval Shipyard New Hampshire
QUESTION 9: Please provide address for all shipping locations. RFP requests eight (8) different delivery locations pricing (example CLIN 1003 to 1010). Section F only provides six (6) addresses for delivery locations.
NAVY RESPONSE 9: Sections E & F have been updated to include the addresses for the remaining two locations.
QUESTION 10: 084-1 Road Transport - Boat with cabin removed shall meet all requirements for road transport (wide load with restrictions) via low-boy trailer on Continental United States (CONUS) Highways. Is it acceptable to ship the cabin on a separate truck/trailer than the boat hull, if required to comply with DOT interstate highway transportation law?
NAVY RESPONSE 10: Yes.
QUESTION 11: Section L.1.k states “Offerors are advised that proposals shall be accepted only from those Offerors proposing as potential prime contractors.”. Please confirm if the prime contractor can be other than the shipyard/boat builder.
NAVY RESPONSE 11: Yes, the prime contractor can be someone other than the shipyard/boat builder. In accordance with FAR 52.219-14, "the concern shall perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials".
QUESTION 12: Has the government considered the use of a generator instead of the inverter. Then you could use regular traditional air conditioning it would keep the load off the engines and make standby time much better.
NAVY RESPONSE 12: A generator is not desired.
QUESTION 13: We hereby respectfully request that NAVSEA extend the Offer Due Date from June 26, 2017 for an additional three (3) weeks, until July 17, 2017.
NAVY RESPONSE 13: The Government is not inclined to extend the proposal due date at this time.
QUESTION 14: 085-2f Transportation and Handling Drawings – Are contractors required to supply the re-usable waterproof cover for transportation for every hull delivery? Or is the intention to provide 1 cover and use for each hull? Also is the cover desired to protect the entire hull, or just the area of cabin when removed?
NAVY RESPONSE 14: Yes, the builder is required to supply the re-usable waterproof cover for every hull delivery. The desired cover is to protect the area of the cabin when removed
QUESTION 15: Please provide addresses for the locations in which the Crew Familiarization CLINs (CLIN 1016 to 1023) training will take place.
NAVY RESPONSE 15: For CLIN 1023, the address for the location in which Crew Fam training will take place on CLIN 1023 will be at the awardee builder's facility. For CLIN 1016, the address is as follows:
US Naval Base Yokosuka CFAY Port Operations Bldg#5203 1 Banchi Tomari-Cho Yokosuka, Kanagawa-Ken Japan 238-0001
QUESTION 16: Please confirm a hoisting sling set and hardware set per Attachment 1 Section 611-5 and 611-6 shall be included in each Workboat Large boat construction price.
NAVY RESPONSE 16: Yes.
QUESTION 17: Please provide details of Final Acceptance tests/process after delivery to end user location. Will the contractor, after reassembly and reactivation of the boat per Section C-3.080-3, be required to perform an acceptance trials at the end user locations.
NAVY RESPONSE 17: No, the builder will not be required to perform an acceptance trial at the end user locations. Per Section C-3.080-3 DELIVERY "If direct delivery to end user location is ordered, the boat shall be delivered in water, fully assembled and operational."

SECTION H - SPECIAL CONTRACT REQUIREMENTS
CONTRACT FINANCING
The Government will offer financing based on terms of contracting officer-specified commercial contract financing.
Contract financing shall not be a factor in the evaluation of resulting proposals, and proposals of alternative financing terms shall not be accepted. However, an offer stating that the contracting officer-specified contract financing terms will not be used by the offeror does not alter the evaluation of the offer, nor does it render the offer nonresponsive or otherwise unacceptable. In the event of award to an offeror who declined the proposed contract financing, the contract financing provisions shall not be included in the resulting contract. Contract financing shall not be a basis for adjusting offerors’ proposed prices, because the effect of contract financing is reflected in each offeror’s proposed prices.
The Government will divide the total price of the Boat CLIN* for each delivery order into five (5) major events and using the applicable Boat CLINs in Section B of the individual delivery orders to calculate the interim finance payments. Interim payments shall be made upon completion and acceptance of each event described below. There are five major events described below, each having its own criteria for payments.
*For the purpose of this Contracting Financing Clause, “Boat CLIN” is defined as the price of the Contract Line Items (1001, 2001, 3001, 4001, and 5001) not inclusive of the following CLINs (1002-1024, 2002-2024, 3002-3024, 4002-4024, and 5002-5024) defined in Section B.
EVENT #1
Upon completion and acceptance of Post Award Conference (PAC) minutes by the Government program office (PMS 325G), the Government will provide a single interim payment, 5% of the total delivery order Boat CLIN value.
EVENT #2
Upon delivery by the Contractor of the progress report validating the start of production of the ordered boats and acceptance by the Government program office (PMS 325G) and submission of purchase orders from major component and raw material suppliers to the WAWF primary POC, the Government will provide a single interim payment, 20% of the total delivery order Boat CLIN value.
EVENT #3a Upon delivery by the Contractor of the preliminary Technical Data Package (TDP) (i.e., the TDP submission required 45 days prior to the official scheduled dates of Pre-Delivery Inspection and Boat Trials) and review and acceptance by the Government, the Government will provide a single interim payment, 15% of the total delivery order Boat CLIN value.
Note pertaining to completeness of the TDP’s Bill of Materials (BOM): The BOM as defined by Attachment 1 must have minimal errors or omissions for payment.
EVENT #3b Upon successful completion and acceptance of PDIT by Government program office (PMS 325G), the Government will provide a single interim payment, 5% of the total delivery order Boat CLIN value. Where PDIT is not required by the delivery order, the Government will provide the payment upon successful completion and acceptance of Post-Delivery Inspection Report (PDIR).
EVENT #4
Upon acceptance of each boat and all deliverables at destination by the Government program office (PMS 325G), the Government will provide an interim payment on a per boat basis until all of the boats in the delivery order are accepted. All discrepancies must be resolved before invoicing. This event is 45% of the total delivery order Boat CLIN value, but it is further calculated on a per boat basis for payment purposes.
Note Pertaining to Boat #1: All requirements of the contract, to include TDP, must be met before submission of invoice for payment on follow on boats. Failure to satisfy conditions of the contract for Boat #1 may result in rejection of future invoices.
EVENT #5
The remaining 10% balance of the total delivery order Boat CLIN value is due thirty (30) days after delivery and acceptance at destination of the last boat in the delivery order.
Please note: All conditions of Interim Payment Events must be met before submission of invoice for payment. Failure to satisfy any condition will result in rejection of invoice. Submission of invoices for partial payments will not be accepted unless noted.
The interim payment events will be apportioned among each Boat CLIN in Section B of the delivery order. As each interim payment is paid, the calculated amounts will be deducted from the total price of the Boat CLINs. As a result, the unliquidated balance for each Boat CLIN will be the total amount of each Boat CLIN as shown in SECTION B, less the amounts paid above against each Boat CLIN as indicated in Payment Events.
Any following modifications to the delivery order totaling under $100,000.00 per modification shall not be subject to a recalculation of the interim payments. The increase or decrease in price shall be reflected in Payment Event #4 in its entirety and should be invoiced at such time as indicated in Payment Event #4. Any and all payments made hereunder shall be secured when made, by a paramount lien in favor of the Government upon craft, articles, and items contracted for on account of all payments so made and on all material, equipment and other property acquired for or allocated to the performance of this contract, except to the extent that the Government, by virtue of any other requirements of this contract, or otherwise shall have valid title to such articles, things materials, or other property as against other creditors of the Contractor. If such property is not identified by marking or segregation, the Government shall be deemed to have a lien upon a proportionate part of any mass of property with which such property is commingled. Any lien provided for by virtue of this paragraph is paramount to all other liens under the provisions of 10 U.S.C. § 2307.
