1. PROJECT INFORMATION
1.1. Project Description
The GSA is using the Design Build Bridging (DBB) delivery method to design and construct a new Land Port of Entry (LPOE) for the U.S. Customs and Border Protection (CBP) in Madawaska, ME. The GSA hired a Bridging Architect, hereafter known as Designer of Record (DOR), as part of the DBB delivery method.
The Designer of Record (DOR) has created Owners Project Requirements (OPR). The OPR is a compilation of narratives, specifications, drawings, appendices, studies, calculations and other documents that identify the specific functional requirements of the new LPOE that are in addition to, qualify or exceed the GSA PBS Facilities Standards for the Public Buildings Service (P100, 2018 edition) and Customs and Border Protection Land Port of Entry Design Standard (2018) requirements.
Under this project, the Design-Build Contractor (DB Contractor) shall finish the design developed by the DOR and build the new LPOE.
GSA is providing the DB Contractor with this statement of work (SOW), the Owners Project Requirements (OPR), and Standards, Criteria, Policy and Procedure Documents that shall be used to finish the design and construct the new LPOE.
The DB Contractor will serve as the Architect of Record (AOR) for the project and Engineer of Record (EOR) for the project.
The program of requirements (POR) for this new LPOE contains 76,717 GSF of facilities placed on an 10.73 acre site between Mill Street and Main Street in Madawaska, Maine.
The program facilities include a Main Port Building, Commercial Inspection Building, Canopies, Booths, 3 primary inspection lanes, and a bypass lane and Surface Parking.
Concurrent with GSA’s LPOE project, Maine Department of Transportation (MaineDOT), is constructing a new Madawaska-Edmundston International bridge. The new bridge will be landing on the GSA site in Madawaska.
The LPOE and International Bridge are separate projects but require strong multi-discplinary and cross agency coordination. The new LPOE must be operational by November 2023 to coincide with completion of the new bridge.
In addition the town of Madawaska is completing new water and sewer projects that will require coordination with the project site.
The DB Contractor is one contract and entity. The DB Contractor may consist of separate firms, such as an independent architect and engineer and an independent contractor, agreeing to work together on the project.
Please see the OPR for additional project overview information.

1.4. Project Background Information
The project background information is provided to assist the DB Contractor. Additional background information is contained in the appendices of the statement of work.
The existing Madawaska LPOE is an outdated facility located on a very small site wedged between the St. John River, an active railroad line, and a paper mill of the Twin Rivers Paper Company. The 8,990 square foot facility was constructed in 1959 on 0.9 acres. The facility connects Madawaska with Edmundston, New Brunswick, Canada, via the nearly 100-year old International Bridge over the St. John River. The existing site, building, canopies, and booths have significant deficiencies and do not meet the current mission and operational standards of the U.S. Customs and Border Protection (CBP).
The Madawaska Land Port of Entry is a 24-hour, 365 days-per-year mission critical operation, processing both commercial and non-commercial vehicles entering and exiting the United States.
In January 2016, GSA was informed that MaineDOT intended to undertake a study for a new international bridge, with the goal of study completion by February 2018.
GSA entered into a Cooperative Agreement with MaineDOT and the New Brunswick Department of Transportation (NBDTI) as a party to MaineDOT’s Madawaska- Edmundston International Bridge & Border Crossing Feasibility Study (the “MaineDOT Study”) that began on November 7, 2016, and expired on December 31, 2018. GSA undertook a concurrent Feasibility Study (FS), the “Phase 2 FS”,for a new U.S. LPOE and provided to MaineDOT an evaluation, analysis, and conceptual site plans of site locations to be considered as part of the MaineDOT Study. The Parties worked cooperatively on the MaineDOT Study, and upon conclusion of the MaineDOT Study, the parties determined to advance a final conceptual bridge alternative forward into preliminary and final design based on identified needs and an assessment of resources available for such a new facility between Maine and New Brunswick. The Study was completed on June 5, 2018. The preferred alternative with a bridge landing on the GSA Property and siting of the new LPOE, formed the basis for GSA’s Phase 2 FS and concept design through Bridging Contract Documents (BCDs).
1.5. Project Delivery Approach- Work Sequence and
Restrictions
This project may be delivered in phases to meet schedule constraints.
Schedule and Milestone requirements are provided in the OPR.
In addition, the following facts are provided as items of particular interest that the DB Contractor must work with-
● The LPOE’s interface with the bridge landing, and the exact location was influenced by the Phase 2 FS, and Concept Design and finalized in MaineDOT’s plans and GSA’s Final Concept Design & BCDs submission.
● MaineDOT has requested four (4) phased construction access and laydown areas on the GSA-owned property to construct the bridge abutment and wingwall infrastructure, and bridge, the plan to date is provided in the OPR.
● A number of elements (including design of the guardrails and fencing; crosswalks with entrance and exit permit, construction access and phasing) must be coordinated with MaineDOT.
● MaineDOT will be installing GSA/CBP specific items (3 lightposts, 2 overhead gantry signs, utility conduits for security cameras, lighposts, overhead gantry signage, and flagpole lighting) under the bridge on behalf of GSA/CBP per MaineDOT’s plans. The coordination, final connections, and completion of these items shall be coordinated by the DB Contractor team with MaineDOT, GSA, and
CBP;
● Location and construction of bridge landing and the LPOE must be done without impacting Twin Rivers or RR land and operations to the north/northeast of the USA Property. All site construction shall occur only on GSA owned land, without temporary construction easements on the Twin Rivers or RR land to the north/northeast of the USA Property;
● Temporary construction and permanent easements between MaineDOT and GSA are in development for construction, and for continued operations and maintenance of the bridge;
● The GSA has acquired 91 and 93 Vital Drive, Madawaska, Maine. The GSA will be demoing the property and all corresponding utilities and structures prior to Spring 2021 under a separate contract. GSA will be leaving the pavement on the parcel, it will need to be demoed by the DB contractor.
● The GSA is in the process of acquiring 170 Main Street, Madawaska, Maine. The DB Contractor shall be responsible for the “Demolition of the existing residential building, foundation, impervious surfaces & utilities.
● The GSA is in the process of acquiring 180 Main Street, Madawaska, Maine (aka “McDonald’s). The DB Contractor team is responsible for the demolition and is required to coordinate with the GSA the timing and phasing of the Demolition of the existing commercial building, foundation, impervious surfaces & utilities.
● The GSA is in the process of disposal of the former Aztec building on the USA property, and the GSA will be demoing the existing foundation, impervious surfaces and utilities (typ) prior to the Spring 2021 under a separate contract.
● Twin Rivers has already removed the “overhead propane line” and demolished the existing propane tanks and shed, foundation, impervious surfaces, and appurtenances.
● The Town of Madawaska’s water and sewer upgrade project’s design and construction, through the USA site and on Mill Street, is concurrent with & interfacing with the design & construction of the new bridge and LPOE.
● Pursuant to the requirements of the following acts and guides (the National Environmental Policy Act of 1969 (NEPA), the Council on Environmental Quality Regulations, the GSA Public Buildings Service NEPA Desk Guide, and the FHWA Policy Guide), GSA, PBS, the Federal Highway Administration (FHWA), and MaineDOT, in cooperation with the U.S. Coast Guard and in coordination with the U.S. Customs and Border Protection (CBP), have released the Final Supplemental Environmental Impact Statement (FSEIS) and Record of Decision (ROD) in the Federal Register on March 2, 2020. This Record of Decision (ROD) completes a thorough and careful planning and environmental decision-making process of the FSEIS / Final Programmatic Section 4(f) Evaluation for the New U.S. LPOE and International Bridge Project and documents the specific components of the decision and the rationale for that decision. Following the circulation of the DSEIS / Draft Programmatic Section 4(f) Evaluation, LPOE Alternative C was identified as the Selected LPOE Alternative and Bridge Alternative 2 was identified as the Selected Bridge Alternative. This milestone for MaineDOT and FHWA allows these agencies to apply for a final bridge permit with the USCG, and for the GSA to begin site acquisition, as needed. The FSEIS & ROD may be viewed at gsa.gov/madawaskalpoe.
● The furniture design, furniture product & equipment procurement, and installation will be in coordination with the design and construction of the new LPOE and will need to be coordinated with the DB Contractor. 2.6. Program of Requirements (POR)
GSA and CBP’s Program of Requirements (POR) are provided in the OPR. The POR consists of PDFs of an Excel spreadsheet that describes the GSA and CBP’s associated Space Requirements. The matrix identifies rooms and square footages for each area, and http://www.gsa.gov/portal/getMediaData?mediaId=155166 http://www.gsa.gov/portal/getMediaData?mediaId=155166 http://www.wbdg.org/ccb/browse_doc.php?d=5434 http://nvlpubs.nist.gov/nistpubs/SpecialPublications/NIST.SP.800-82r2.pdf http://nvlpubs.nist.gov/nistpubs/SpecialPublications/NIST.SP.800-82r2.pdf http://nvlpubs.nist.gov/nistpubs/TechnicalNotes/NIST.TN.1922.pdf http://nvlpubs.nist.gov/nistpubs/TechnicalNotes/NIST.TN.1922.pdf https://www.dhs.gov/isc-policies-standards-best-practices https://www.dhs.gov/isc-policies-standards-best-practices http://www.nsps.us.com/?page=ALTAACSMStandards https://www.wbdg.org/FFC/FED/OMB/OMB-Circular-A94.pdf https://www.wbdg.org/FFC/FED/OMB/OMB-Circular-A94.pdf http://www.nps.gov/history/local-law/arch_stnds_9.htm http://nvlpubs.nist.gov/nistpubs/SpecialPublications/NIST.SP.800-53r4.pdf http://nvlpubs.nist.gov/nistpubs/SpecialPublications/NIST.SP.800-53r4.pdf https://www.pmi.org/learning/library/construction-industry-project-definition-rating-7114 https://www.pmi.org/learning/library/construction-industry-project-definition-rating-7114 https://www.pmi.org/learning/library/construction-industry-project-definition-rating-7114 http://wbdg.org/FFC/DOD/UFC/ufc_3_310_04_2013_c1.pdf http://wbdg.org/FFC/DOD/UFC/ufc_3_310_04_2013_c1.pdf https://www.gpo.gov/fdsys/pkg/USCODE-2010-title42/html/USCODE-2010-title42-chap61.htm https://www.gpo.gov/fdsys/pkg/USCODE-2010-title42/html/USCODE-2010-title42-chap61.htm http://www.ecfr.gov/cgi-bin/text-http://www.ecfr.gov/cgi-bin/text-http://www.faa.gov/news/fact_sheets/news_story.cfm?newsId=20516 http://www.faa.gov/news/fact_sheets/news_story.cfm?newsId=20516 facility functional performance requirements and expectations.
The DOR conducted a design charrette contained in the appendices of the OPR that provides additional detailed requirements for each space identified in the POR including:
function, finishes, adjacencies, equipment, security, circulation, servicing and other performance characteristics.
The DB Contractor shall review, revalidate, and update the POR (living document) throughout all stages of this contract, and shall ensure that the project is in compliance with the POR. The POR space quantities are to be measured in accordance with the GSA National Business Space Assignment Policy.
Additional requirements for the POR are found in the OPR.
2.7. Spatial Data Management Requirements
The GSA Spatial Data Management (SDM) Program is a national effort to measure, record, and maintain federally owned and leased space assignments to support rent bills and provide transparency to all stakeholders. The DB Contractor shall refer to the GSA Pricing Guide and the National Business Space Assignment Policy Guide for the spatial data management requirements. The DB Contractor shall coordinate with the CO for the revalidatation and development of the area tabulation, space reconciliation and space assignment reports.
As noted in the P100, at each design submission stage, the DB Contractor shall provide an IFC BIM and 2D CAD plans, one for each level of the facility, with assignment data and space boundaries in compliance with the National Business Space Assignment Policy. The DB Contractor shall submit area plans in CAD (.dwg format) derived from the building model (BIM) and including space boundary polylines or polygons at all design phases. The P100 and GSA BIM Guide 02 contain additional requirements for SDM.
Also per P100, the DB contractor is to submit a spatial reconciliation report at each design phase submittal. It should include tabulations of the usable, rentable and gross areas of the project. The reconciliation report shall ensure that the programmatic areas are fully defined, that circulation factors are properly applied, that allowances are included for support areas and that volumetric implications and options of the design program are accounted for.
Furthermore, at the close-out phase after Construction, 2D CAD assignment plans are required based on the final as-built floor plans. These will be submitted by the DB Contractor and reviewed by the DOR for compliance.
In addition to adhering and validating the space program, the DB Contractor’s design must not exceed gross square feet of the approved project as defined in the OPR.
Additional requirements for SDM are found in the OPR.
2.8. Budget
The DB Contractor is to provide a firm fixed price to complete the project.
2.9. Project Delivery and Schedule Milestone Dates
The Project must be operational by November 2023 to coincide with the
International Bridge Completion.
Additional requirements for schedule are found in the OPR and agreement.
2.10. Construction Excellence Peer Reviews (CE PR)
The DB Contractor is required to attend, in person in Madawaska, Maine three (3) CE PR reviews - typically conducted at 15%, 65%, and 95% of construction completion.
Background: The GSA construction excellence program provides guidance to the GSA construction projects through collaboration with leaders of the private sector construction community. This partnership allows for the development and implementation of innovative approaches to project management and execution to provide the Federal government and client agencies the highest quality construction within budget and schedule.
Construction Excellence in the Construction Stage: includes managing the construction to ensure that the project remains within the established budget, conducting Project Delivery Team partnering sessions, facilitating timely construction communications utilizing a web-based project management system, performing construction peer reviews, and encouraging the use of alternative dispute resolution methods to resolve disputes.
2.11. Art in Architecture (AiA)
GSA’s Art in Architecture program entails commissioning artists to create publicly scaled and permanently installed works of art that are appropriate to the diverse uses and architectural vocabularies of new and substantially modernized federal buildings, courthouses, and Land Ports of Entry. The GSA selects and commissions the artist(s) for each project during the Design Concept Phase. The intent is to achieve integration of art and architecture, to such extent that the artist(s) may become involved in the design of building or sitework elements. This project includes the commissioning of artist Ralph Helmick who will create artwork to be installed on site. The program requires the active participation and support of the DB Contractor lead designer, and the Design Build team - Architect of Record and the General Contractor.
The DB Contractor will participate in collaboration…
