About this file

This modification to a federal solicitation requests proposals for the manufacture and delivery of Wired in the Defense Marine Analog Tactical Telephone systems. Offerors must provide pricing using the Contract Line Item Number structure, with a total evaluated price calculated as the sum of extended prices across all CLINs. Proposals will be evaluated based on operational effectiveness and supportability demonstrated through a requirements traceability matrix, past performance, and subcontracting or small business participation plans. The deadline for proposals is November 16, 2020 by 2:00 PM local time. Award is intended to be made on initial proposals but discussions may be held if determined necessary by the Contracting Officer. Skylla Engineering assisted in requirements development and is excluded from competing.

The following have been added by full text:

Delivery Schedule:

F-1. The Period of Performance- The period of performance for this contract will be from date of contract award through a period of not to exceed 36 months (3 years). However, the Government reserves the right to extend the contract in accordance with FAR clause 52.217-7.

F-2. Delivery or Performance

F-2.1. CLIN 0001: Initial Marine Analog Tactical Telephone Systems shall be delivered no later than 5 months After Date of Contract (ADC) for testing.

F-2.2. CLIN 0002: Additional Marine Analog Tactical Telephone Systems shall be delivered either at a rate of 500/month, or all 2000 at once After Option Exercise (AOE), in accordance with (IAW) clause 52.217-7. This option will not be exercised until testing has been completed on CLIN 0001 systems.

F-2.3. CLIN 0003: Additional Marine Analog Tactical Telephone Systems shall be delivered either at a rate of 500/month, or all 7920 at once After Option Exercise (AOE), IAW clause 52.217-7. This option will not be exercised until the CLIN 0002 systems have been delivered.

The following have been modified:

52.211-8 TIME OF DELIVERY (JUN 1997)

(a) The Government requires delivery to be made according to the following schedule:

The Government requires delivery to be made according to the schedule in Section F.

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

OFFEROR'S PROPOSED DELIVERY SCHEDULE

Within Days

After Date

Item No. Quantity of Contract

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.

52.217-7 OPTION FOR INCREASED QUANTITY--SEPARATELY PRICED LINE ITEM (MAR 1989)

The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of completing testing (for CLIN 0002), and within 150 days of completing testing (for CLIN 0003). Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

1.0 INSTRUCTIONS FOR THE SUBMISSION OF PROPOSALS

1.1 INTRODUCTION

a. A single, concise and comprehensive proposal is required. Organization, clarity, accuracy of information, relevance, and completeness are of prime importance. The proposal shall be complete and clear in all respects without the need for additional explanation or information. The proposal shall be in sufficient detail and scope to permit the Government to evaluate it with respect to the evaluation factors specified in Section M of the solicitation.

b. Unnecessarily elaborate submissions beyond that sufficient to present a complete and effective proposal are not desired. Offerors shall confine their submission to essential matters, sufficient to define their offer, and provide an adequate basis for evaluation. Likewise, offerors are cautioned against general, vague, or unsubstantiated statements, which prevent or render difficult the Government’s evaluation of the proposal. Statements such as "will comply," or "noted and understood" without supporting narrative to define how compliance will be achieved may be deemed insufficient and cause an offeror to be evaluated as unacceptable. Moreover, the Government may not assume that an offeror possesses any capability, understanding, and/or commitment that is not specifically delineated and supported in its respective proposal.

c. As prescribed by 52.215-1, the Government may award on the basis of initial offers received, without discussions. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint.

d. Proposals submitted for consideration for award must address the full scope of the solicitation. Proposals which address only part of the solicitation will be considered unacceptable. Multiple proposals from an offeror will not be accepted.

e. Sealed proposals shall be hand delivered to the location listed below by 1400 Local Time on 16 Novermber 2020. Any proposal received after such time and date will be considered a late submission. Late submissions will be treated in accordance with FAR 52.215-1(c)(3). Facsimile or e-mail submissions are not acceptable and will not be considered for award. Proposals shall be valid for a period of at least 6 months from the closing date listed above.

Offerors shall prominently mark all containers used for delivery of proposals with the following:

“SOLICITATION M67854-21-R-2053”

Proposals shall be hand delivered to the address listed below. Hand carried proposals shall not be delivered to the MCSC security desk.

Commander Marine Corps Systems Command 105 Tech Pkwy Stafford, VA 22556

NOTE: The building is secure, so offerors are instructed to contact either the Contracting Officer, at 703-432-8726, or Contract Specialist, at 703-432-8728, when arriving at the building so the individual delivering the proposal can be met in the lobby.

1.2 QUESTIONS

Questions regarding the solicitation documents are due by 10:00 AM local time on 16 October 2020 and must be submitted via email to lisa.burns@usmc.mil and catherine.opsahl@usmc.mil in the format listed in the following table. Please do not bundle multiple questions into one. Questions received after the above time and date may not be answered. Questions (particularly multiple, duplicate or similar questions) may be edited and, as deemed appropriate by the Contracting Officer, posted on beta.Sam.gov along with Government responses.

1.3 CONTRACTOR SUPPORT

The following vendor assisted in the development of the requirements for this solicitation and are excluded from competing for, or subcontracting on, this effort: Skylla Engineering.

2.0 PREPARATION OF PROPOSALS

Proposals shall be prepared using “Times New Roman” 12 point font style on 8½ x 11 inch white paper, with each side counting as one page. Tables and illustrations may use a reduced font style not less than 8 point. Foldouts are allowed for schematics and schedules only and shall be treated as 2 pages, impacting the pagination. Margins shall be 1 inch on all sides. All material submitted must be no less than single-spaced. Offerors shall ensure that each page provides identification of the submitting offeror in the header or footer, which may be within the 1 inch margin. Number all pages sequentially. A limit on the number of pages in the proposal has been imposed, as indicated in the sections below. In the event an offeror exceeds the maximum page limit, the Government will only evaluate the pages that comply with the maximum page number prescribed for the respective volume. All pages, or any other material in excess of the maximum number of pages stated will not be evaluated. Any proposal that is prepared inconsistently with the intent of these instructions, that appears to be designed to avoid or circumvent the page limits, or that in any way frustrates or renders more difficult the Government’s ability to evaluate offers on an equal basis may result in portions of the proposal being ignored, or the entire proposal being rejected as non-conforming.

Offeror shall submit one electronic “soft” copy (one copy of the business volume and one copy of the technical volume, on separate discs) of the full proposal using the Microsoft Office for Windows suite of applications, submitted on CD-ROM, formatted for a personal computer. Schedules shall be in MS Project or compatible format. An original and one copy of the Technical Volume in “hard’ (paper), as well as “hard” original and copy of the Business Volume, shall also be submitted.

In the event that there is a conflict between the written “hard” copy of the proposal and the electronic “soft” copy of the proposal, the soft copy will take precedence. Such conflicts may be considered as a weakness during the evaluation of the Offeror’s proposal or, depending upon the conflict’s significance, may be deemed a basis to reject the proposal.

2.1 ORGANIZATION OF THE PROPOSAL

Each Offeror shall submit their hard proposal materials in three-ring binders. Individual sections shall be removable and replaceable within the volumes. Each volume shall contain a title page, table of contents, acronym list, and list of tables and figures for that volume. Use tab separators to divide required sections within a volume. The title page, table of contents, acronym list, list of tables and figures, and tab separators do not count against the page count. Only material allocated to a specific section shall be in that section. Business and Technical Volumes shall be submitted in separate binders and, for the soft copy, on separate CDs.

The Technical Volume shall include the completed RTM showing the proposal paragraph number where an evaluator will find the narrative for any P-Spec or SOW requirement requiring discussion. The RTM will not be included as part of the page count. Appendix B shall contain any specification sheets for the proposed system as well as any empirical data including safety and testing documentation available. Appendix B shall not be used to avoid page limits by putting information there that should be provided in a different part of the proposal. The Government reserves the right to ignore portions of Appendix B that it deems excessive, beyond the desired information, or inconsistent with other portions of the proposal or the proposal instructions. The following instructions apply to the format:

*In the event an offeror provides a proposal that is printed or copied double-sided on paper pursuant to FAR clause 52.204-4, each side of the paper shall be numbered and will represent one page.

2.2 CONTENT OF THE PROPOSAL

The following instructions are provided for the relevant portions of the proposal:

Business Volume:

Executive Summary: This section shall include a brief summary of the Offeror’s capability to accomplish the requirements of the contract. Any exceptions, deviations, conditions, understandings and/or waivers taken to any aspect of the RFP shall be identified in the Executive Summary. Keep in mind that exceptions, deviations, conditions, understandings may make a proposal unacceptable and that a waiver may not be granted. The Executive Summary shall list the offeror’s cognizant DCMA, DCAA, and DFAS payment office.

Part I. Price.

This part shall include the model contract with all proposed pricing, including a completed copy of the Standard Form 33, acknowledging any solicitation amendments, signed by a person authorized to enter into the proposed contract on behalf of the Offeror. Pricing shall be submitted in the same format as the CLIN structure in Section B and the Pricing Worksheet (Attachment 3).

For bundled costs, the phrase “Not Separately Priced” (NSP) shall be indicated for the corresponding CLIN/SLIN. The term “N/A” or Not Applicable shall only be used when the described items in the applicable CLIN/SLIN are NOT being provided.

Part II. Subcontracting/Small Business Participation.

This part shall also include the offeror’s Subcontracting Plan in accordance with FAR 52.219-9. The plan should detail how the offeror intends to meet the subcontracting goal of 30% for this contract. Furthermore, 5% of the small business subcontracting should go to small disadvantaged business(es). If the plan does not meet the small business goal of 30% or 5%, respectively, the offeror shall provide a detailed explanation as to why the goals cannot be reached. Small businesses submitting a proposal are not required to submit a subcontracting plan.

Technical Volume:

Part III. Past Performance.

The offeror shall document its most relevant past performance by identifying a maximum of three contracts for itself, or its major subcontractors (meaning one who will perform work representing at least 25% of the proposed price), with 12 months of performance occurring during the 36 months preceding proposal submission. Offerors shall provide a detailed explanation of the relevance of the listed contracts to the requirements of the solicitation. Relevance is defined as the degree of similarity between the contracts, generally with respect to—at a minimum—size, scope, and complexity.

The proposal shall contain accurate and concise information for each prior contract cited, including:

•Title of Contract, Contract Number, and Sponsoring Organization;
•Name, mailing address, telephone and email address for the Technical POC or COR, and the Contracting Officer;
•Type of Contract, Value, Award and Completion Dates;
•Brief description of the supplies delivered and services performed, problems identified and corrective action taken, awards/recognition received; and
•Cure/Show Cause notices received, and reasons.

Offerors are advised that notwithstanding what is discussed above, the Government may use and evaluate independently obtained past performance data, including CPARs and other sources, as appropriate.

Part IV.

Operational Effectiveness and Supportability.

Offerors shall describe their ability to meet or exceed each of the technical requirements set forth in the P-Spec (using the RTM) and the SOW. The offeror must complete the “Met/Not Met” column for each specification to indicate whether its proposed product meets the specification, and the “Proposed Value” column to indicate the value proposed (e.g., 12 ounces, for a weight requirement). Additionally, the offeror must complete the “Proposal Reference” column of the RTM, indicating the paragraph of the proposal where an evaluator will find the detailed discussion of each PSPEC requirement requiring additional information, explanation, or discussion. Lastly, the offeror must complete the “Additional Info” column to reference any documentation or substantiation (such as analysis or test data) of its ability to meet the specification, whether included in that column or in Appendix B, Test Data. Additionally, offerors shall provide a schedule to demonstrate their ability to produce and deliver the WID MATT quantities within the required 180 day time frames. The schedule shall address production readiness and lead time for delivery. Because this is a non-developmental item, offerors should address any activities required to establish an open production line.

The technical volume shall not include any cost/pricing data.

3.0 INTENT TO INCORPORATE CONTRACTOR’S PROPOSAL

All or part of the successful offeror’s proposal may be incorporated in any contract resulting from this solicitation, including any proposed capability that exceeds a P-Spec requirement. Nothing contained in the successful offeror’s proposal shall constitute a waiver to any requirement of the contract. In the event of any conflict between the successful offeror’s proposal and other requirements of the contract, the conflict shall be resolved in favor of the contract requirements.

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision. Additional copies will be issued for a fee.

(2) Most unclassified Defense specifications and standards may be downloaded from the following ASSIST websites:

(i) ASSIST (https://assist.dla.mil/online/start/).

(ii) Quick Search (http://quicksearch.dla.mil/).

(iii) ASSISTdocs.com (http://assistdocs.com).

(3) Documents not available from ASSIST may be ordered from the Department of Defense Single Stock Point (DoDSSP) by--

(i) Using the ASSIST Shopping Wizard (https://assist.dla.mil/wizard/index.cfm);

(ii) Phoning the DoDSSP Customer Service Desk (215) 697-2179, Mon-Fri, 0730 to 1600 EST; or

(iii) Ordering from DoDSSP, Building 4, Section D, 700 Robbins Avenue, Philadelphia, PA 19111-5094, Telephone (215) 697-2667/2179, Facsimile (215) 697-1462.

(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.

(j) Unique entity identifier. (Applies to all offers exceeding the micro-purchase threshold and offers at any dollar value if the solicitation requires the Contractor to be registered in the System for Award Management (SAM).) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

SECTION M - EVALUATION FACTORS FOR AWARD

EVALUATION FACTORS FOR AWARD

1.0 Basis of Award

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered.

The Government will evaluate proposals using the stated evaluation criteria. Vendors are responsible for submitting proposals that adequately demonstrate how well the offered products meet the specifications. Award shall be made to the responsible vendor that provides the best value, considering all factors and using tradeoff procedures. The non-price factors, when combined, are significantly more important than price.

The evaluation factors follow:

1. Operational Effectiveness and Supportability

1. Price

1. Past Performance

1. Subcontracting/Small Business Participation

1.1 Evaluation Process.

The Government shall review proposals as follows:

Operational Effectiveness and Supportability: evaluators will use the WID MATT Requirements Traceability Matrix (RTM) and proposal to evaluate the operational effectiveness and supportability of the proposed solution, as well as the schedule for prooduction, assigning an adjectival rating from the Combined Technical and Risk Ratings table below.

Price: Evaluators will determine the total evaluated price as the sum of the extended prices proposed for all CLINs. The Government reserves the right to halt evaluations if it determines that none of the proposals have an acceptable price.

Past Performance: Evaluators will use past performance submitted and any other past performance information gathered to assign a rating from the Performance Confidence Ratings table below.

Subcontracting/Small Business Participation: assigning a rating of acceptable or unacceptable.

The Government intends to award on initial proposals but reserves the right to conduct discussions if the Contracting Officer determines them to be necessary. Also, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

The Business Volume will be evaluated separately from the Technical Volume. Relevant information in either the Technical or Business Volumes will be exchanged between panels as needed to support informed decision making. The Technical Ratings table that follows uses combined ratings that include technical capability and the risk associated with the technical approach proposed.

Combined Technical and Risk Ratings

Color Rating
Adjectival Rating
Description
Blue
Outstanding
Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Purple
Good
Proposal indicates a thorough approach and understanding of the requirement and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Green
Acceptable
Proposal indicates an adequate approach and understanding of the requirements, and the risk of unsuccessful performance is no worse than moderate.
Yellow
Marginal
Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Red
Unacceptable
Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies, and/or risk of unsuccessful performance in unacceptable. Proposal is unawardable.

A rating of Unacceptable or Marginal in any factor will render the proposal unacceptable. Unacceptable proposals are ineligible for award without discussions and a subsequent, acceptable rating.

Past Performance Rating. The evaluation of past performance will result in a rating from the Performance Confidence Rating table below. The Government will evaluate past performance to determine whether the offeror’s recent, relevant past performance creates an expectation that the offeror will successfully perform the required effort.

Performance Confidence Ratings

Adjectival Rating
Definition
Acceptable
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Neutral*
The offeror’s performance record is not available or is so sparse that no meaningful past performance rating can be reasonably assigned; therefore, the offeror has unknown past performance and the Government’s confidence is “neutral.”
Unacceptable
Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

*An “Acceptable” past performance rating may be deemed better than a “Neutral” one, and a “Neutral” one will generally be deemed better than an “Unacceptable” one.

2.0 Specific Evaluation Procedures

Operational Effectiveness and Supportability. The Government will evaluate the offeror’s documented ability to meet or exceed the specifications listed in the P-Spec and the SOW. An offeror’s failure to meet any of the specifications in the RTM may render the proposal unacceptable for award.

Past Performance. The Government will consider the past performance information submitted and, as deemed appropriate, consider the offeror’s record in CPARS and elsewhere. In the case of an offeror without a sufficient record of recent, relevant past performance, the offeror will not be evaluated favorably or unfavorably with regard to its past performance history.

Only recent efforts of some relevance that are sufficiently substantiated will be considered in determining a performance confidence rating. To be recent, an effort must have 12 months of performance occurring during the 36 months preceding the proposal submission date. Relevancy will be determined based on the prior effort’s similarity to the solicited effort. For recent, relevant efforts, the government will consider how well the offeror performed on each contract, including the delivery schedule compliance, product quality, and overall customer satisfaction. Lastly, the quality of performance on each relevant effort will be considered to determine the Government’s overall level of confidence in the offeror’s ability to successfully perform the solicited effort.

Subcontracting/Small Business Participation. For other than small business offerors, the PCO will evaluate the small business subcontracting plan for compliance with the requirements of FAR 52.219-9 and for the extent of participation of small businesses in performance of the contract. The plan will be evaluated as acceptable or unacceptable. Offerors that submit a plan compliant with the requirements of FAR 52.219-9 that include an overall small business subcontracting goal of at least 30% and a small disadvantaged business goal of 5% will receive an "acceptable" for this area of evaluation. Offerors whose plan is non-compliant with these requirements will receive an “unacceptable” for this area of evaluation and will not be eligible for award.

Small Business Ratings

Rating
Description
Acceptable
Proposal meets small business objectives.
Unacceptable
Proposal does not meet small business objectives.

Price. The price proposed by the offeror will be evaluated by calculating the total evaluated price, which is the sum of the “Total Amount” of all priced CLINs. The price evaluation will determine whether each offeror’s proposed price to the Government is reasonable using one or more of the methods cited in FAR 15.404-1(b)(2). The total evaluated price will be utilized in conducting a best value analysis.

An offer may be rejected if the prices proposed are materially unbalanced between line items, sub-line items or years, and this lack of balance poses an unacceptable risk to the Government (see FAR 15.404-1 Proposal Analysis Techniques). Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of cost or price analysis techniques. The Government reserves the right to request whatever cost and pricing data is necessary for analysis when unbalanced pricing is suspected.
