INSPECTION AND ACCEPTANCE (BLOCK 7) 3

Regardless of the method of transmittal, the Contractor shall initiate a zero-cost receiving report 4 in Wide Area Workflow (WAWF) for each Contract Data Requirements List (CDRL) delivered 5 to the Government (initial, draft, final, update, etc.). 6

GOVERNMENT APPROVAL (BLOCK 8) 7

Block 8 for each DD-Form 1423-1 that accompanies an individual order for services issued 8 against the Multiple Award Task Order Contract (MATOC) will specify whether advanced 9 written approval by the Government is necessary before distribution of the final data deliverable. 10 For data deliverables that require advance approval, an ‘A’ will be annotated in Block 8 of the 11 DD-Form 1423-1. 12

3.1 PROCEDURES 13

The Government may elect to designate a single activity that both reviews and accepts data 14 presented for Government inspection and acceptance. On the other hand, the Government may 15 choose to identify a reviewing activity, distinct from the accepting activity, to perform in 16 process, or final reviews of the data to be delivered against the MATOC. The accepting activity, 17 and when applicable a distinct reviewing activity, will be identified in Block 14.a of the DD-18 Form 1423 that accompanies an order for services issued against the MATOC. When used, the 19 reviewing activity will notify the accepting activity of their recommendation for acceptance or 20 rejection of the data deliverable. Untimely or deficient delivery of data deliverables from the 21 Contractor to the Government may serve as the basis for withholding contract payment(s). The 22 accepting activity will notify the Contractor of the acceptance or rejection of data deliverables 23 presented for inspection and acceptance by the Government. Final acceptance of the data 24 deliverable will be accomplished through Government approval of the WAWF receiving report 25

- 4 -

UNCLASSIFIED

after timely delivery of the approved data deliverable (see paragraph 2). Such acceptance does 26 not constitute a waiver of any Government entitlements regarding data rights, including, but not 27 limited to, DFARS §252.227-7037. If the data deliverable is rejected by the Government, the 28 accepting activity will notify the Contractor of the reason(s) for rejection. In cases where data 29 deliverables do not conform to contractual requirements, or result in late or missed deliveries, 30 formal notification will be provided to the Contractor by written notice from the Contracting 31 Officer. In addition to providing the reasons why the data deliverable was not accepted, the 32 Contracting Officer will direct the Contractor to correct the deficiencies, replace the non-33 conforming data deliverable, or, when permitted by the contract, elect to receive an equitable 34 adjustment in contract price in lieu of correction or replacement. 35

DISTRIBUTION AND MARKING (BLOCK 9) 36

4.1 GENERAL 37

A DoD distribution marking system for technical data has been established by DoD Instruction 38

5230.24 - Distribution Statements on Technical Documents. The Contractor shall mark all 39 distribution statements and export-control statements, supplemental to any security markings, on 40 all data submissions. 41

Distribution statements, as specified in Block 9 of the DD-Form 1423-1 that accompanies an 42 individual order for services issued against the MATOC, shall be included where applicable and 43 as defined in paragraph 4.2. If the Contractor is of the opinion that a particular data deliverable 44 requires a different distribution statement than the one specified in Block 9 of the DD-Form 45 1423-1, then the Contractor shall request clarification from the Contracting Officer’s 46 Representative or Contracting Officer. The Government will review the request and determine 47 which statement is the most appropriate and provide the Contractor with a response that accepts 48 the change or provides the reason for not accepting the Contractor’s request for change. 49

The Contractor shall mark all data deliverables, regardless of its medium, with the required 50 distribution statement as specified in Block 9 of the DD-Form 1423-1 that accompanies an 51 individual order for services issued against the MATOC. This includes technical data, 52 noncommercial computer software and computer software documentation, data that is not 53 technical data, technical manuals, instructions, film, technical papers, photographs, etc. If the 54 data is determined to contain export-controlled technical data (See 22 CFR, §120.10 for the 55 definition of ‘technical data’ as it relates to ITAR), the data shall be marked as shown in Figure 56

1. 57

When FOUO information is contained in media or material (including hardware and equipment) 58 not commonly thought of as documents (e.g., computer files and other electronic media, 59 audiovisual media, chart, maps, films, sound recordings), the requirement remains to identify, as 60 clearly as possible, the information that requires protection. The main concern is that holders and 61 users of the material are clearly notified of the presence of FOUO information. The markings 62 required shall be applied on either the item or the documentation that accompanies it. 63

4.2 DISTRIBUTION STATEMENTS 64

One of the following distribution statements, as specified in Block 9 of the DD-Form 1423-1 that 65 accompanies an individual order for services issued against the MATOC, shall be displayed 66 conspicuously on all data delivered regardless of the media or format. For standard written or 67 printed material, the distribution statement shall appear on the front cover or title page. If the 68 delivered data is not prepared in paper form but is prepared digitally, or is in any medium that 69 does not have a cover or title page, the applicable distribution statement shall be affixed to all 70 physical and digital items by other means in a conspicuous position for ready recognition. 71

Classified data delivered against the MATOC (See paragraph 6.2) shall be marked in accordance 72 with DoD Manual 5200.01, Volume 2 - DoD Information Security Program: Marking Of 73 Classified Information and assigned Distribution Statement B, C, D, E, or F. Unclassified 74 documents marked with Distribution Statements B, C, D, E, or F shall be handled using the same 75 standard as FOUO material in accordance with DoD Manual 5200.01, Volume 4 - DoD 76 Information Security Program: Controlled Unclassified Information (CUI), and shall be 77 destroyed by any method that will prevent disclosure of contents or reconstruction of the 78 document (See paragraph 2.4.6). The text of the then current version of DoD Instruction 5230.24 79

- Distribution Statements on Technical Documents, shall take precedence over the statements 80 included in Table-2. 81

The Government requires that all unclassified data deliverables (initial, draft, final, update, etc.) 145 be distributed electronically to the addressees listed in Block 14.a for each DD-Form 1423-1 that 146 accompanies an individual order for services issued against the MATOC unless otherwise 147 specified. Three primary methods may be used (in order of preference): 148

1. Distribute unclassified data deliverable(s) that are not further restricted in their 149 dissemination to the Government personnel specified in Block 14.a for each DD-Form 150 1423-1 that accompanies an individual order for services issued against the MATOC via 151 email such as Outlook. The data deliverable would be an attachment in this case. 152

2. Distribute the unclassified data deliverable(s) to the Government personnel specified in 153 Block 14.a for each DD-Form 1423-1 that accompanies an individual order for services 154 issued against the MATOC via AMRDEC SAFE (safe.amrdec.army.mil). AMRDEC 155 SAFE shall be used for unclassified data submissions with a single electronic file 156 attachment or combined electronic file attachment size that exceeds 10 MB, or for any 157 unclassified data submission that contains Controlled Unclassified Information (CUI). 158

3. Distribution of unclassified data deliverables that cannot be transmitted electronically 159 shall be accomplished via shipment of the data deliverable(s) to the Government 160 personnel as specified in Block 14.a for each DD-Form 1423-1 that accompanies an 161 individual order for services issued against the MATOC. ‘For Official Use Only’ 162 (FOUO) information and material may be transmitted via first class mail, parcel post, or, 163 for bulk shipments, via fourth-class mail. Refer to DoD Manual 5200.01, Volume 4 - 164 DoD Information Security Program: Controlled Unclassified Information (CUI), for 165 additional information related to the protection of CUI data transported or transmitted to 166 the Government against the MATOC. 167

All electronic format submittals shall be word searchable (i.e., not scanned) where applicable. 208 For Microsoft Word documents, all comments and changes submitted with any updated or 209 revised data deliverables shall be captured using the “track changes” feature. For data 210 deliverables developed and updated in applications that do not have a track changes feature, a 211 record of changes or some other method shall be employed by the Contractor to document all 212 changes made between versions of a document. For MS Excel documents, all formulas must be 213 enclosed. All technical data and data that is not technical data must be submitted digitally and 214 shall be delivered virus-free. 215

The following software products/versions (or compatible) to prepare all data deliverables is 216 required. The versions of the software used shall remain compatible with program office 217 software. 218

1. MS Office 2013 219

2. Adobe Acrobat Reader DC 2018 or later “.pdf” format 220

All data submissions shall be in the native files (i.e., “.doc”, “.xls”, etc.). The Contractor shall 221 provide Adobe .pdf file format in addition to the native file format when requested by the 222 Government. Scanned .pdf files are not desired – only native .pdf files are desired. The 223 Government understands that sometimes only scanned .pdf documents are available; however, 224 the Contractor shall coordinate approval from the Government for the use of scanned pdf 225 formats. 226

Some data deliverables may require the use of software such as Adobe FrameMaker, or may 227 consist of a requirement to deliver software files such as databases in formats that are compatible 228 with modeling and simulation systems. In these cases the required file format for the data 229
