About this file

This justification and approval document specifies the use of sole source procurement for two construction materials in a solicitation to construct a new Type II Fuel Hydrant System at Wright Patterson Air Force Base in Ohio. The solicitation will require the use of Honeywell Enraf Tank Gauging System as the sole source for the Automatic Tank Gauging System and VEEDER-ROOT as the sole source for the Product Recovery Tank Level System. These systems are required to maintain compatibility with the Defense Logistics Agency and Space and Naval Warfare Systems Command's existing fuel facility monitoring and control architecture.

The related federal contract opportunity is solicitation number W912QR21R0006 to replace and construct a Type III Hydrant Fuel System at Wright Patterson Air Force Base. The project scope includes construction of new storage tanks, a pump house, piping, and demolition of existing underground storage tanks and a pump house. The solicitation will be a firm-fixed-price contract set aside for full and open competition with a HUBZone 10% price evaluation preference. The selection process will use a best value tradeoff evaluation of past performance, technical, and price factors. The contracting agency is the Department of the Army Corps of Engineers Louisville District.

DEPARTMENT OF THE ARMY

U.S. ARMY CORPS OF ENGINEERS, LOUISVILLE DISTRICT

600 DR. MARTIN LUTHER KING JR PL

LOUISVILLE, KY 40202

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: US Army Engineer District, Corps of Engineers, PO Box 59, Louisville, KY 40201-0059

2. Description of Action: Approval is requested for brand name specification of two construction materials to be used in the solicitation for the construction of the new Type II Fuel Hydrant System at the West Ramp on Wright Patterson Air Force Base, OH (WPAFB), on behalf of the Defense Logistics Agency (DLA) following the USACE Petroleum, Oils and Lubricants (POL) Mandatory Center of Expertise (MCX) standards. This action would permit the Government to specify Honeywell Enraf Tank Gauging System as the sole source supplier for the Automatic Tank Gauging (ATG) System, VEEDER-ROOT as the sole-source supplier of the Product Recovery Tank (PRT) Level System. The estimated amount for the ATG is for the PRT Level System. MILCON funding will be used to fund the prime contract, including the line items that will fund these purchases by the prime contractor.

3. Description of the Supplies/Service:

The Honeywell Enraf is the monitoring device used to read and monitor the levels of the jet fuel storage tanks. Tank gauging is essential for the assessment of tank contents, tank inventory control and tank farm management. The Honeywell Enraf is compatible with Space and Naval Warfare Systems Command (SPAWAR and now referred to as Naval Information Warfare Systems Command (NAVWARSYSCOM)) and DLA’s existing monitoring systems.

This is a bid option in the bid schedule because DLA may fund SPAWAR to install when they are installing their other controls and monitoring devices for this project.

The VEEDER-ROOT PRT Level System is leak detection system to ensure that none of the piping or large storage tanks are leaking. Again, this is compatible with SPAWAR and DLA’s existing monitoring systems.

4. Authority Cited: The statutory authority permitting acquisition of the requirement by other than full and open competition is 10 U.S.C. 2304 (c)(1) as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This authority is applicable to brand name acquisitions in accordance with FAR 6.302-1(c).

5. Reason for Authority Cited: DLA and other POL facilities have standardized these gauges and level systems, and the use of this system is necessary to maintain compatibility with the overarching facility controls architecture within DLA. DLA requires component level hardware that will integrate seamlessly into its data interface system. Attempting to integrate gauges and controls from outside the current protocol would be infeasible, because it would result in substantial compatibility issues that would require a systematic rework of the foundational architecture that has been developed. This protocol is used to provide centralized control and oversight for all fuel facility systems on WPAFB and across all other DLA fuel facilities.

6. Efforts to Obtain Competition: This justification and approval will be posted with the solicitation, as required under FAR 6.302-1(c). No other notices have been posted.

7. Actions to Increase Competition: None, for the reasons cited above.

8. Market Research: The technical and requirements personnel undersigned discussed the base’s system-wide preferences and existing systems with personnel who had knowledge of these pre-existing systems. There are other systems that perform the same metrics, however, these systems will have to interface with other systems on the Base or within the DLA supply management system such that introducing a different manufacturer into the system creates the need for new software to be written to ensure the necessary data can be pull and incorporated with other results. This introduces the additional cost of writing/testing the software, while also opening the risk of cybersecurity lapses and software issues that interfere with successful operation.

9. Interested Sources: None.

10. Other Facts: N/A

11. Technical Certification: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.

12. Requirements Certification: I hereby determine that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.

13. Fair and Reasonable Cost Determination/Contracting Officer Certification: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable based on comparison with existing contract prices and/or established catalog prices for similar items. I further certify that this justification is accurate and complete to the best of my knowledge and belief.

14. I have reviewed this J&A and find the justification adequate to support other than full and open competition.
