About this file
This justification and approval document specifies the sole source procurement of a KNOX lockbox for a new Type II Fuel Hydrant System project at Wright Patterson Air Force Base in Ohio. The U.S. Army Corps of Engineers Louisville District will issue a firm-fixed-price solicitation to construct the new fuel system project, which includes two 5,000-barrel aboveground storage tanks, a 2,400 GPM pump house, 12-inch hydrant loop, truck offload stand, product recovery tank, and other associated facilities. The project magnitude is estimated between $10-25 million. Offerors must register in the System for Award Management to be eligible. The single-phase solicitation will use a best value tradeoff source selection considering past performance, technical, and price factors. The government may conduct discussions but intends to award without them if determined to be in its best interest.

DEPARTMENT OF THE ARMY
U.S. ARMY CORPS OF ENGINEERS, LOUISVILLE DISTRICT
600 DR. MARTIN LUTHER KING JR PL
LOUISVILLE, KY 40202
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Agency: US Army Engineer District, Corps of Engineers, PO Box 59, Louisville, KY 40201-0059
2. Description of Action: Approval is requested for brand name specification of a lock box to be used in the solicitation for the construction of the new Type II Fuel Hydrant System at the West Ramp on Wright Patterson Air Force Base, OH (WPAFB), on behalf of the Defense Logistics Agency (DLA) following the USACE Petroleum, Oils and Lubricants (POL) Mandatory Center of Expertise (MCX) standards. This action would permit the Government to specify KNOX as the sole source supplier of a lockbox at the main entrance to the pump house. The estimated amount for the KNOXBox is . MILCON funding will be used to fund the prime contract, including the line items that will fund these purchases by the prime contractor.
3. Description of the Supplies/Service: the KNOXBox is a lock box for keys to gain access to the building by emergency personnel. The KNOXbox will be used at the main entrance to the pump house to ensure that only authorized personnel may enter.
4. Authority Cited: The statutory authority permitting acquisition of the requirement by other than full and open competition is 10 U.S.C. 2304 (c)(1) as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This authority is applicable to brand name acquisitions in accordance with FAR 6.302-1(c).
5. Reason for Authority Cited: The base wants to match their current infrastructure and use a
KNOXBox at the main entrance of the pump house to prevent use of a new system that could impact emergency response time and life safety. All facilities at WPAFB use KNOXBox cases to ensure that first responders only need a single key to enter any of these facilities in case of an emergency. Use of various keys could result in delayed entry in case of a fire or other accident, which could put lives and safety of base personnel at risk.
6. Efforts to Obtain Competition: This justification and approval will be posted with the solicitation, as required under FAR 6.302-1(c). No other notices have been posted.
7. Actions to Increase Competition: None, for the reasons cited above.
8. Market Research: The technical and requirements personnel undersigned discussed the base’s system-wide preferences and existing systems with personnel who had knowledge of these pre-existing systems. It is known that there are other lock box systems available, however none can be keyed to match the proprietary keying of the KNOXBox and would cause additional emergency access keys to have to be utilized by emergency responders.
They do not want that to be a concern for response time at this facility as it is a hazardous material facility with extremely large quantities of jet fuel.
9. Interested Sources: None.
10. Other Facts: N/A
11. Technical Certification: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.
12. Requirements Certification: I hereby determine that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.
13. Fair and Reasonable Cost Determination/Contracting Officer Certification: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable based on comparison with existing contract prices and/or established catalog prices for similar items. I further certify that this justification is accurate and complete to the best of my knowledge and belief.
14. I have reviewed this J&A and find the justification adequate to support other than full and open competition.
