About this file
This document is a Justification and Approval (J&A) for the use of a proprietary item, the WaveTronix microwave vehicle detection system, in Solicitation N4008524R2716 for the P1584U Design-Bid-Build (DBB) Parachute Tower Road Upgrades project at Marine Corps Base Camp Lejeune, North Carolina. The project, valued at approximately $, will solicit proposals from the Civil/Paving Multiple Award Construction Contract (MACC), a 100% small business set-aside. The WaveTronix system is the only product used by the City of Jacksonville, NC, with which the base has a Memorandum of Agreement to operate and maintain traffic signals, in order to simplify maintenance and ensure interconnectivity of the traffic control system. The contracting officer will determine the price is fair and reasonable prior to contract award, and NAVFAC Mid-Atlantic has no plans to compete future contracts for this proprietary item unless another potential source emerges.

DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEERING SYSTEMS COMMAND, MID-ATLANTIC
9324 VIRGINIA AVENUE
NORFOLK, VIRGINIA 23511-3095
J&A No. ML-24-55
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
The contracting activity is Naval Facilities Engineering Systems Command, Mid-Atlantic
(NAVFAC ML).
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes and approves the use of a proprietary item for microwave vehicle detection system manufactured by WaveTronix to be used in Solicitation N4008524R2716, P1584U Design-Bid-Build (DBB) Parachute Tower Road Upgrades, Marine Corps Base, Camp Lejeune, North Carolina.
3. Description of Supplies/Services.
The intent of solicitation N4008524R2716 for P1584U Design-Bid-Build (DBB) Parachute Tower Road Upgrades is to provide improved traffic movement through the Parachute Tower Road / Birch Intersection, which includes signalizing the intersection at Marine Corps Base Camp Lejeune (MCBCL), North Carolina.
This acquisition will solicit proposals from the Civil/Paving Multiple Award Construction Contract (MACC), which is a 100% small business set aside. The estimated value of the work included in this construction solicitation is , and the estimated value of the proprietary item for microwave vehicle detection system manufactured by WaveTronix . The project will be funded by FY24 MILCON funds. The work under this contract is required to be completed within 649 days after award.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. Rationale Justifying Use of Cited Statutory Authority.
MCBCL has a Memorandum of Agreement (MOA) with the City of Jacksonville, NC to operate and maintain traffic signals on the base. The City of Jacksonville has selected a single microwave vehicle detection system manufactured by WaveTronix for all city-wide signals to simplify costs of maintenance and streamline operations across the metropolitan area. As part of
J&A No. ML-24-55 the MOA, MCBCL also utilizes a common system to the City of Jacksonville to expedite maintenance and ensure a seamless interconnectivity within a traffic control system.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
For the overall procurement, competitive proposals will be received from multiple contractors under the Civil/Paving MACC. No other sources for the traffic signal detectors were considered, as the WaveTronix product is the only system utilized by the City of Jacksonville.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will determine that the price for this acquisition is fair and reasonable in accordance with FAR Part 15 prior to contract award. Analysis will be performed by one or more of the following techniques: (1) Comparison of proposed prices received in response to the RFP; (2) Comparison of proposed prices with the Independent Government Cost Estimate (IGCE); (3) Comparison of proposed prices with available historical information; and/or (4) Comparison of market survey results. The fair and reasonable determination will be made based on the total price of the project. This proprietary item is not an individual line-item price in the solicitation.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVFAC Mid-Atlantic has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC Mid- Atlantic will assess whether competition for future requirements is feasible.
