In accordance with FAR 6.302-1(c)(1)(ii), a brand name description to specify a particular brand-name, product or feature of a product peculiar to one manufacturer “shall be justified and approved in accordance with FAR 6.303 and 6.304.”

4. Authority Cited:
10 U.S.C. 2304(c) authorizes contracting without providing for full and open competition, in certain circumstances. This justification meets the requirements of FAR 6.302-1(c)(2), which require that the use of brand name product descriptions be documented in accordance with FAR 6.303.
FAR 6.302-1(c)(1)(ii) identifies that a justification is required to only cover the portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer; and the approval level required will only apply to that portion of the requirement. Please see Brand Name Components table within paragraph 3 for specific brand name items and descriptions. The required traffic controller system & traffic and pedestrian signals have an estimated total value of and represents less than of the total contract value. As such, the contracting officer for the procuring activity is the authorized approval, in accordance with FAR 6.304(a)(1).
5. Reasons for Authority Cited:
a. Background: This is a new construction requirement to repair Barnes Blvd.
Bridge (J84004) on JBLM, WA. This is not a consolidated requirement.
b. Justification: The listed equipment is currently compatible with the system in operation of the JBLM Department of Public Works. The new system must match and function together with existing DPW equipment as part of the existing traffic monitoring system. No other systems are currently compatible. The brands noted in Paragraph 3 are of a high industry standard and are the chosen service material brands used by the larger transportation management system currently in place on JBLM and maintained and serviced by the DPW. Planning and maintaining and operating a large military base operation traffic management system requires electronic equipment to be fully compatible in function and remote controls. It also requires having equipment that service technicians are familiar with to keep all systems in service and working together.
c. Alternatives: As stated in the above paragraph b., only those products that are associated with traffic system are expected to be considered fair and reasonable based on competition of the overall solicitation. Certified cost or pricing data will not be required as the contract in which these included manufacturer/brand name items will be awarded based on competition.
10. Other Factors:
a. Procurement History: This is a new acquisition for the repair of Barnes Blvd Bridge
(J84004) on JBLM, WA.
b. Acquisition Data Availability: Not applicable.
c. Unusual and Compelling Urgency: Not applicable.
d. Subcontracting Competition: Requirement will be 100% set-aside for a small business concern (solicited to 8a firms), IAW FAR 19.702(b)(1), a subcontracting plan and competition is not required.
