2.0 - Purpose
Naval Support Activity (NSA) Mid-South does not exceed the oil storage criteria of 40 CFR
112.20 (EPA), and oil transfer criteria of 33 CFR 154 (USCG), so a Facility Response Plan (FRP) is not required. However, OPNAV Instruction 5090.1D, section 39-3.2.a(2), requires any Navy facility or property, which stores petroleum oil and/or hazardous substances, and is not required to have a FRP, shall maintain a Spill Contingency Plan (SCP).
This SCP was tailored to the specific size and operations at NSA Mid-South. This SCP format was modeled after the Emergency Response Action Plan requirements of 40 CFR 112.20(h)(1).
Figures, diagrams, or maps needed to support this SCP, will be included in the NSA Mid-South Spill Prevention, Control, and Countermeasure (SPCC) Plan.
This SCP is intended to be supplemental procedure to the SPCC Plan as required by 40 CFR 112.7(a), and it will identify the following:
• Key personnel with training and expertise to manage a spill.
• Required notifications that must be made in the event of a spill.
• Immediate actions to be taken in the event of a spill.
This SCP is not intended to identify every type of oil and hazardous substance that is used on the facility, or to list all the possible spill scenarios, or to address specific health and safety precautions. The personnel identified in this SCP are intended to be knowledgeable about these matters, and should be relied upon in the event of a spill.
In the event of an oil or hazardous substance spill, that is caused or discovered by personnel at the facility, this SCP serves as the jump start for initiating notifications and response actions at the earliest possible time.
At a minimum, this SCP shall be reviewed annually in accordance with OPNAV Instruction 5090.1D, section 39-3.2. These updates may consist of merely updating the list of telephone numbers assigned to positions.

3.0 – Spill Notification Criteria
National Response Center (NRC):
A facility should report all spills or discharges which exceed the applicable reportable quantity to the NRC at phone number (800) 424-8802. The NRC is located at US Coast Guard headquarters in Washington DC, and is the federal government’s centralized reporting center, which is staffed 24 hours per day.
40 CFR 110 requires that if a facility discharges any kind of oil in any quantity, which causes the presence of a visible film or sheen or discoloration on the surface of navigable waters or adjoining shorelines, or causes a sludge or emulsion to be deposited beneath the water surface or on adjoining shorelines, or which may affect natural resources, then this discharge must be reported to the NRC. These criteria are not based on any number of gallons.
Navigable waters are defined as all inland or coastal surface waters, currently in use, or used in the past, or susceptible to future use. This includes all waters which are subject to the ebb and flow of tides, seas, lakes, rivers, creeks, tributaries, intermittent streams, mudflats, wetlands, and impoundments.
If an oil spill enters a facility storm drain, then it shall be assumed there is a threat or potential for the oil to reach navigable waters, in sufficient quantity to cause a visible oil sheen. This spill must be reported to the NRC, by estimating the quantity of oil which entered the drain.
The facility owner or operator (or environmental representative) must notify the NRC immediately when they have knowledge of a reportable oil spill or hazardous substance release, which should be within 30 minutes of discovery. Information to be reported to the NRC shall be listed on the spill response reporting form in this plan.
The reportable quantities for spills or releases of hazardous substances (other than oil), hazardous materials, and chemicals are listed in 40 CFR 302.4, based on the name of substance spilled.
Environmental Protection Agency (EPA):
40 CFR 112.4 (SPCC rule) requires that certain quantities of oil discharges from facilities must be reported to the applicable EPA Regional Administrator office, in Dallas TX or Atlanta GA, in addition to the NRC reporting criteria above. The facility owner or operator (or environmental representative) must notify the EPA in writing whenever there is an oil discharge of:
• More than 1,000 gallons of oil in a single discharge, that reaches navigable waters or adjoining shorelines; OR
5 March 2016
• More than 42 gallons of oil in each of 2 discharges, that reaches navigable waters or adjoining shorelines, occurring within any 12 month period.
The following information must be collected and provided in the oil discharge report to the EPA within 60 days:
• Name and location of facility, owner or operator name.
• Maximum storage and handling capacity of facility and normal daily throughput.
• Corrective actions and countermeasures taken, including descriptions of equipment repairs and replacements.
• Adequate description of facility, including maps, flow diagrams, and topographical maps, as necessary.
• Cause of oil discharge to navigable waters.
• Failure analysis of system where oil discharge occurred.
• Additional preventive measures taken or planned to take to minimize oil discharge reoccurrence.
State of Tennessee:
The facility owner or operator (or designated environmental representative) must notify the Tennessee Emergency Management Agency (TEMA), and Tennessee Department of Environment & Conservation (TDEC), whenever there is an oil spill or discharge of the following:
• Any quantity of oil that causes a sheen on surface waters
• Greater than 25 gallons of oil into ground / soil / grass.
TEMA Nashville Operations Center call: (615) 741-0001 TDEC Memphis Environmental Field Office call: (901) 371-3000

Mailing address: TEMA, 3041 Sidco Drive, Nashville, TN 37204
Chief of Naval Operations:
Internal Navy spill reporting requirements are from OPNAV Instruction 5090.1D, section 39-3.6.
Commanding Officers (CO) shall immediately report the fact and nature of a spill from Navy vessels or facilities that meets the following criteria:
• Any spill reported to the NRC, State or local authorities.
6 March 2016
• Any spills that may endanger critical water areas, or have the potential to generate public concern, or become the focus of an enforcement action, or pose a threat to public health or welfare that warrants an OPREP-3 special incident report.
Reports shall be made to the Navy chain of command and cognizant Navy On-Scene Coordinator (NOSC) as follows:
• By telephone immediately upon discovering the spill. Call the Navy Southeast Regional Operations Center (ROC) at (904) 542-3118, 24 hours a day.
• By official Navy message in format provided in OPNAV Instruction 5090.1D, Appendix C, as soon as practicable.
• By updated Navy message as soon as the reporting activity becomes aware of new information concerning the origin, quantity, type, operation under way, root cause, or lessons learned of the spill.
• Similarly, if the final estimate of amount released differs substantially from amount initially reported, the reporting activity must send an updated Navy message to all action and info addresses on the original spill message.
If you call the NRC, send a Navy message. If you call the State or local authorities, send a Navy message. If you are in doubt, send a Navy message.

5.0 - Emergency Notification Phone List
Following is a prioritized list of emergency notifications that must be made in the event of a reportable spill. Generally, the Environmental Director is responsible for making these notifications (unless delegated to a subordinate). The Environmental Director is responsible for determining the reportable quantity for any oil or hazardous substance. However, it is imperative that all notifications be completed with one (1) hour of an incident, if required. The individual assigned the responsibility for making notifications must complete this form (recording date and time of each call) and provide a copy to the Environmental Director upon completion.
The individual assigned the responsibility for making notifications must be aware that 911 calls made from a government phone will be routed to Naval Facilities Engineering Command Southeast (NAVFAC-SE) Region Emergency Dispatch. When 911 calls are made from a non-government phone, the caller must notify the emergency operator of their location at a government facility, so their call can be routed to NAVFAC-SE Region Emergency Dispatch.
