About this file

This is a draft directional boring services contract between the City of Milton, Florida, and a selected contractor for the provision of horizontal directional drilling (HDD) services. The City seeks qualified contractors to perform directional boring work for the installation, maintenance, and repair of underground utility infrastructure, including water, sewer, and natural gas systems, on an as-needed, purchase order basis within the City of Milton and Santa Rosa County. The contract is structured as a unit-price, term-based agreement with an initial term of one year and renewal options for up to three additional one-year periods, contingent upon satisfactory performance, fund availability, and continued compliance with licensing and insurance requirements. No minimum or maximum quantities are guaranteed under the contract. The contractor must hold a valid Florida Certified Underground Utility and Excavation Contractor License pursuant to Chapter 489, Florida Statutes, and must maintain all required insurance and certifications throughout the contract term. The contract specifies mobilization requirements within five business days of purchase order issuance and twenty-four-hour emergency response capability on a seven-day-per-week basis.

Compensation is determined by fixed unit prices set forth in Exhibit B and applies only to actual quantities of work completed, inspected, and accepted by the City Representative. Payment is due upon successful completion and acceptance of each directional bore, with no compensation provided for failed, abandoned, or incomplete bores unless the failure is solely attributable to differing site conditions. The contract requires performance and payment bonds if the total anticipated contract value exceeds $200,000 and mandates comprehensive insurance coverage including $1,000,000 commercial general liability per occurrence, $1,000,000 automobile liability, statutory workers' compensation, and $1,000,000 contractors pollution liability. The contract is funded solely by City funds with no state or federal funding sources. The Contractor is responsible for all labor, equipment, drilling fluids, materials, cleanup, and restoration, though the City may furnish pipe materials and obtain permits in some instances. Liquidated damages apply for mobilization delays, emergency response failures, and schedule non-compliance, with rates ranging from $250 to $500 per calendar day or per hour, capped at $7,500 to $15,000 per incident.
