Compensation is based solely on unit prices submitted in the bid schedule for installation of city-furnished pipe and materials, with pricing to include all labor, equipment, drilling fluids, contractor-furnished consumables, and incidentals. The City furnishes pipe and appurtenances; contractors must furnish all other materials unless otherwise specified. Bid evaluation will be based on the overall level and consistency of unit pricing across all bid items, with the City evaluating the totality of pricing structure rather than total lump sum amounts. Bidders must be Florida-licensed Certified Underground Utility and Excavation Contractors (CUC) with three years of relevant HDD experience and must provide minimum insurance coverage including $1 million commercial general liability, $1 million auto liability, and $1 million contractors pollution liability. Performance and payment bonds are required when anticipated work value exceeds $200,000. 8.1 Basis of Award
This Solicitation is issued as a competitive sealed bid pursuant to Florida Statute
255.20.
Award, if made, shall be to the lowest responsive and responsible Bidder whose
Bid conforms in all material respects to the requirements of this ITB.
This is a unit-price, Purchase Order-based contract. No quantities, frequency of
Work, or total contract value are guaranteed.
8.2 Evaluation Methodology
Bids will be evaluated based on the unit prices submitted in the Bid Schedule.
Because this is a unit-price, as-needed contract with no guaranteed quantities, the City will not determine the lowest Bidder based on a total lump sum or extended price.
Instead, the City will evaluate each Bid as a whole, considering the totality of the Bidder’s unit pricing structure.

2026.05 ITB Directional Boring Services (HDD) | Page 21 of 54
In determining the lowest responsive and responsible Bidder, the City will consider:
• The overall level of unit pricing submitted;
• The consistency and proportionality of unit prices across all bid items;
• The relationship of unit prices to the scope and anticipated types of Work;
• Whether pricing presents an unreasonable risk of increased cost to the
City.
The City’s evaluation will be conducted in a manner that is reasonable, non-arbitrary, and consistent with the requirements of this ITB and applicable law.
8.3 Unbalanced, Front-Loaded, or Nominal Pricing
A Bid may be rejected as non-responsive if the City determines that:
• Unit prices are materially unbalanced, including disproportionate pricing among bid items;
• Pricing is front-loaded, nominal, or structured in a manner that could result in increased cost to the City;
• Pricing is inconsistent with the Work such that it creates an unacceptable financial or performance risk.
The determination of whether a Bid is materially unbalanced or presents unacceptable risk shall be made by the City in its reasonable discretion.
8.4 Responsiveness
The City will review each Bid to determine whether it is responsive to the requirements of this ITB.
A responsive Bid is one that:
• Conforms in all material respects to the Solicitation Documents;
• Includes all required forms, certifications, and acknowledgments;
• Is properly executed and submitted in accordance with the ITB requirements;
• Does not contain material deviations, conditions, or qualifications.
Failure to comply with material requirements may result in the Bid being deemed non-responsive.
8.5 Responsibility
The City shall determine whether the lowest responsive Bidder is responsible.
In making this determination, the City may consider factors including, but not limited to:
2026.05 ITB Directional Boring Services (HDD) | Page 22 of 54
• Experience with horizontal directional drilling (HDD) and similar underground utility work;
• Demonstrated ability to perform Work under varying site conditions;
• Availability of qualified personnel, equipment, and operational capacity;
• Safety record, including history of utility damage or regulatory violations;
• Past performance on public or utility-related projects;
• Financial capacity and ability to obtain required bonds;
• Compliance with applicable statutory requirements.
The City may request additional information to evaluate responsibility. Failure to provide requested information within the time specified may result in a determination of non-responsibility.
8.6 Clarifications
The City may request clarification of information submitted in a Bid for the purpose of:
• Resolving ambiguities;
• Confirming compliance with the requirements of this ITB; or
• Verifying information provided.
Clarifications shall not:
• Constitute negotiations;
• Permit modification of price or material terms;
• Cure a material defect or omission.
8.7 Rejection of Bids
The City reserves the right to:
• Reject any or all Bids;
• Reject any Bid determined to be non-responsive or non-responsible;
• Reject any Bid that is materially unbalanced or poses unacceptable risk;
• Waive minor irregularities that do not affect price, competition, or substantive rights;
• Verify all information submitted;
• Conduct investigations as permitted by law;
• Take any action determined to be in the best interest of the City, as authorized by law.
The City’s determinations shall be made in good faith and in accordance with applicable law and the requirements of this ITB.
