Summary of ITB Bidder Questions with Responses

This document is a comprehensive Q&A compilation issued by the Oregon Department of Environmental Quality (DEQ) in response to bidder inquiries regarding the Former St. Helens Fiberboard Facility Lowland/In-Water Operable Unit Interim Removal Action Measure (IRAM) project. The ITB addresses environmental remediation services, including removal of approximately 52,000 cubic yards of contaminated soil, sediment, and wood waste from a former industrial site. The project encompasses water treatment system management, sediment stabilization, ecological restoration, and vegetation replanting across multiple subareas. A mandatory pre-bid conference was held on November 14, 2025, with the original bid due date of December 11, 2025, subsequently extended to December 17, 2025. Site visits are available by request through the project's single point of contact. The work will be executed over two primary construction seasons (2026-2027) with potential for a third season dedicated to restoration planting, with completion targeted to coincide with specified in-water work periods (July 1 to October 31 of each construction season).

The project is estimated at $50 million and is funded through settlement funds administered by DEQ. Key bidding requirements include documentation of three projects completed within the past 10 years, with at least two demonstrating sediment remediation experience exceeding $10 million in value and involving removal of at least 50,000 cubic yards of contaminated materials. Mandatory insurance requirements include $10 million pollution liability coverage, workers' compensation, commercial general liability, and professional liability insurance. No value engineering or alternative construction methodologies are permitted; contractors must adhere strictly to the prescriptive technical specifications and drawings provided. The ITB specifies prevailing wage requirements per Oregon Department of Labor and Industries rates, excludes builder's risk insurance requirements, and mandates an apprenticeship goal of 12 percent of all work hours. Liquidated damages of $5,400 per calendar day apply if Construction Season 1 interim completion milestones are not met, with additional penalties if in-water work period variances are not granted by permitting agencies.

The maximum track load of a stationary excavator while digging [shall be] 2,100 psf.” Please confirm that this requirement can be waived if the Contractor can demonstrate that the excavator loads are adequately distributed using supplementary BMPs.

Answer: No

47) Please clarify the difference between the “Daily RML (6-inch layer)” called for in Section 03

12 16-3.5,F of the Specifications and the “sacrificial cover for excavations” called for in Section 31 05 16-2.7,B of the Specifications.

Answer: Sacrificial cover is daily cover material to stabilize open excavations that would be removed to continue work the following shift.

48) Please clarify the approved anchoring method for the Coir Mat called for in Section 32 900 00-

3.3,A. If wooden stakes are required, please provide the acceptable dimensions and spacing for the stakes.

Answer: Wooden stakes are required. Wood stakes shall be constructed of new, sound, unused and untreated, 2x4 lumber from two and one-half foot (2 ½’) long sections, each cut diagonally across the 4-inch face to make two stakes of the correct length. Use a minimum of two stakes per square yard in staggered rows.

49) What is the minimum acceptable overlap for adjacent rolls of the Coir Mat?

Answer: Adjacent rolls should be overlapped a minimum of 8 inches. Where overlaps occur mid slope, place the mat such that the upslope layer overlaps the downslope layer 1-foot.

50) Section 31 23 16-3.1,A of the Specifications requires the Contractor to “provide excavators that are less than 5 years old (Model year 2021 or newer) and have less than 5,000 operating

ITB: S-10700-00014831

Reponses to Questions as of December 11, 2025 (FINAL Answers to Questions# 1-160) hours.” If an excavator is older than five years but has fewer than 5,000 hours, is in good working condition, is plumbed for the required environmental clamshell bucket, and is instrumented with the required GPS equipment, can it be used at the Site?

Answer: Equipment must meet the specifications.

51) I had a question regarding the treated water discharge point. I was not able to find in the plans the exact location for it. Can you clarify where the discharge point is?

Answer: The discharge point is under the dock towards the river end of the dock.

Drawings will be revised to show discharge point location.

52) Specifications read - "Proof of contractors or its subcontractors active asbestos abatement license under Oregon revised statute ("ORS") 468A.720 is required to be submitted to DEQ before the notice to proceed is issued. Project documents go on to say “hazardous waste is not anticipated to be within the excavation area. If such waste is encountered, the contractor shall immediately notify the engineer to determine the course of action to be taken. Contractor shall continue to work outside of area where believed hazardous waste was encountered while situation is evaluated by engineer and DEQ.” Additionally, materials that were tested in the upland area are not described as being asbestos contaminated materials.

a. If hazardous waste is not expected to be encountered, please consider changing the asbestos abatement licensing requirement to be performed by a licensed contractor/subcontractor only if encountered and not as a requirement for notice to proceed.

Answer: Asbestos containing material (ACM) was found. ACM with asbestos >1% included tar paper, pipe wrapping, and valve paint. Most ACM occurs along the banks between the uplands and the IRAM Area. Sampling is planned to delineate extent of ACM in soil.

53) The current design is very prescriptive and dictates all means, methods and even equipment that can be used to complete the project. Contractors have the experience and specialized equipment to provide a more cost effective approach to achieve the same outcome and could save the state money, reduce schedule, and reduce risk. Will the state accept value engineering options and, if so, can an alternative bid be presented?

54) 02 61 00 part 3 states that contractor may add solidifying agents (ZapZorb or equivalent) to excavated sediment as required to meet the paint filter test. Were any treatability studies performed to evaluate the use of ZapZorb or other materials, such as Portland cement or fly ash?

ITB: S-10700-00014831

Reponses to Questions as of December 11, 2025 (FINAL Answers to Questions# 1-160)

Answer: Yes. See IRAM Investigation (GSI, 1/27/2025) Section 4.2.6 Admixture Testing Results. The IRAM Investigation Report is available with the other E-2 documents at https://ordeq.org/ECSI0091ITB

a. To provide an accurate quote, contractors will need to know the percentage of material required.

Answer: See IRAM Investigation Section 4.2.6 Admixture Testing Results.

b. Disposal facilities have strength requirements ranging from 1,000 to 1,500 PSF.

ZapZorb absorbs moisture but does not improve strength of the sediment/material.

Portland cement offers both moisture absorption and adds strength. Please list Portland cement as an approved alternative.

Answer: No

55) 02 72 00 Section 2.2.A states “pumps, fittings, discharge hoses, conveyance for dewatering and conveying water from the IRAM area shall be designated to a water type (construction contact or drawdown) and used only for that water type for the entirety of the project.

a. Please consider allowing flushing of the system/lines between water types and allowing the contractor to reduce the number of pumps, hoses, etc. This would drastically reduce costs through reduction in equipment, labor, and materials.

Answer: No, requirement retained.

56) 02 72 00 Section 2.2.E states “Conveyance pipe shall be 4 inch diameter HDPE and may be fused or bolted as necessary to convey water by type to the appropriate destination.”

a. Please confirm that the contractor may determine HDPE pipe size as necessary to most efficiently operate their own systems.

Answer: Contractors may propose alternate pipe sizes appropriate to their system requirements.

57) Amphibious equipment would offer a more efficient and cost effective approach to the project objectives. Please consider eliminating the haul road requirement, exclusion of amphibious equipment, and general prescriptive method being described and allow the contractor to determine the best approach. Allowing contractor proposals describing means and methods to achieve the same outcome could save project owners time, money and reduce risk.

Answer: No. Amphibious equipment was evaluated and eliminated as a viable option.

Contractors must follow the technical specifications and drawings provided.

58) The specification has excavator requirements that, among other things, states that excavators shall not be more than 5 years old and have less than 5,000 operating hours. Please strike this requirement. Equipment and schedule are at contractors’ risk. The equipment used should not https://gcc02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fordeq.org%2FECSI0091ITB&data=05%7C02%7CKatie.DAUGHERTY%40deq.oregon.gov%7Cff14897c4fe74cf3c7ba08de1e4910f7%7Caa3f6932fa7c47b4a0cea598cad161cf%7C0%7C0%7C638981496635402045%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&sdata=UFWgH6XK7G%2Bv84giGe4%2BArVRjwWsFpuXB4Y08l%2Bm8NE%3D&reserved=0

Answer: No, requirement retained.

59) 01 57 19 Section C.8 reads “all work will be done using a clamshell bucket during periods of low tide to the extent practicable. Water levels may require some excavation work to be performed during inundated conditions. Contractor shall provide BMPs as necessary to reduce turbidity during tidal inundation.

a. Please clarify that work can take place regardless of the tide and by use of contractors choice of equipment assuming deployment of BMPs as necessary.

Answer: Work must be performed with required environmental clamshell bucket and during periods of low tide to the extent practicable.

60) There is information for bulk water and dredge elutriate test analytical results for water in attachment E-1 IRAM Final Design Report, but is sediment sample analysis available? The information will be needed by disposal facilities to provide accurate pricing.

Answer: See the IRAM Investigation Report (GSI, 1/27/2025) and Data Gaps Investigation Report (GSI, 6/29/2023) available with the other E-2 documents at https://ordeq.org/ECSI0091ITB

61) 31 23 16 Section C. “Engineers Interaction with Excavator Operator and Excavation Foreman”

– Please further explain the nature of the Engineers interactions with the excavator operator including: What equipment they will be using to determine whether excavator operators are meeting objectives. Actions that would cause, at the sole discretion of the engineer, excavator operators to need to be immediately replaced. Engineer proximity to excavator operators, etc.

Furthermore, the section would allow the Engineer to dictate means, methods and even production. If the Engineer will be dictating any of the three, please provide production rates at which the contractor can assume the Engineer will direct our employees to work at.

a. 31 23 16 section C, in its entirety, makes assigning production rates, maintaining efficiency, and ensuring a safe workplace for contractor employees nearly impossible. Please consider striking this portion of the specifications as it does not guarantee a better project outcome for the owner. Project objectives can and will be achieved without the extra expenditure and are monitored by other means, such as third party survey, construction verification as described in 01 11 00 section 1.8, and progress meetings as described in 01 11 00 section 1.9.

Answer: Contractors must follow the technical specification.

62) In the ITB for the project the qualification section states the following:

Reponses to Questions as of December 11, 2025 (FINAL Answers to Questions# 1-160)

Bidder shall provide the information below for 3 different projects completed within the last 10 years that demonstrate Bidder’s experience with projects of similar size, scope, and complexity to the Project that is the subject of this ITB. To this end, two of the three projects must be sediment remediation projects with a construction value of over $10 million and required removal of at least 50,000 cubic yards of contaminated soil/sediment, or otherwise similar to the complexity of the Project to demonstrate that Bidder has completed contracts of a similar nature with a satisfactory record of performance.

Furthermore, on the next page it has a project description check boxes of these requirements as shown below.

• Completed removal of over 50,000 cy of contaminated sediment

• Contract value over $10,000,000

• Work conducted in an intertidal waterway or wetland

• Included wetland restoration requirements

• Required managing water treatment system in conjunction with sediment removal work to achieve numerical water quality criteria for discharge to surface water

• Required dewatering of open excavations using drawdown pumps, conveyance, booster pumps, or similar

• Required managing, dewatering, and stabilizing contaminated sediments using geotubes, presses, sediment basins or other suitable means

• Required installing and maintaining turbidity curtains, silt fences, berms, or other means to effectively isolate the work area We have a clarification question based on these project qualification documents.

1. If the contractor meets a majority of these requirements, but not all on one project, would the contractor still be considered qualified? Example:

a. Project #1 meets 4 out of the 8 bullets in the criteria.

b. Project #2 meets 5 out of the 8 bullets in the criteria.

c. Project #3 meets 3 out of the 8 bullets in the criteria.

d. If the contractor can demonstrate through multiple projects successful completion of similar to the complexity with satisfactory performance, as stated above in underline, would this be acceptable?

Answer: The Record of Satisfactory Performance section of Attachment A Form A-1 in the ITB provides instructions for completing the form including the number of projects required to meet each criterion.

63) Due to the upcoming holiday and the short bid cycle, we are requesting that the bid due date be extended to Monday, December 22, 2025.

68) Is there pre bid meeting attendance list available? We are a wetland restoration contractor looking to discuss opportunities with the interested primes. Thank you.

69) Can you please share the list of bidding general contractors? I do not see the plan holders list on OregonBuys.

70) There are no electrical specifications in the tech specs dated 10/17/25 . Can we assume the associated electrical installations for the water treatment system are to abide by NEC 2023 applicable codes, with no additional requirements?

Answer: Contractor to meet all local and relevant fire, plumbing, electrical, and building codes.

71) When the excavation boundary provided in Drawing C-47 and the overdredge allowance (.25 feet) are used, the cut volume within Subarea 1 is approximately 36,000 cubic yards. The contract quantity for Bid Item 028 IRAM Excavation, Loading, and Hauling to SPA is 52,000 cubic yards. There appears to be a discrepancy between these values. Was a factor used for Bid Item 028 to produce the 52,000 cubic yards contained in the Bid Form? Or does the volume https://gcc02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fordeq.org%2FECSI0091ITB&data=05%7C02%7CKatie.DAUGHERTY%40deq.oregon.gov%7C6cdf4de0d5174326e48f08de27834fbd%7Caa3f6932fa7c47b4a0cea598cad161cf%7C0%7C0%7C638991642080702393%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&sdata=UT661DQHwRLXFuxP5NwM9I1vq4g8%2BZY8cKM3z6NfTy8%3D&reserved=0

Reponses to Questions as of December 11, 2025 (FINAL Answers to Questions# 1-160)

(52,000 cubic yards) correspond to the expanded area shown in the ISO EB vs REQUIRED WITH SLOPES.1 Volume Surface?

Answer: Excavation volume was estimated by including the following sources:

• Lowland sediment, soil, and wood waste: Calculated using the existing grade survey and maximum allowable overdepth surface.

• Sacrificial waste materials that will need to be removed as part of remedial excavation process and include estimated volumes for the following:

o Crushed rock for work area isolation increment berms o Sacrificial RML cover

• Subarea 2 ramp footprints: Grubbing and minimal soil removal required for construction of the two ramps into the lowland IRAM Area.

72) A similar issue is encountered for the SW Quadrant. The volume for Bid Item A-12a is 8,800 cubic yards. The largest verified quantity is 4,850 cubic yards. Please address this potential discrepancy.

Answer: Like question 71, volume includes removal of increment berms and sacrificial RML as part of the remedial excavation process.

73) The 2025-02-03 Required Excavation + .25 OD CAD file provides a design file that depicts approximately 2,000 cubic yards of cut within Subarea 2. Will there be any excavation within Subarea 2?

Answer: “2025-02-03 Required Excavation +.25 OD.dwg” is not part of the bid documents. It is a relic file that was incidentally included with the additional transmit of sheets per bidder's request.

74) If the quantity for Bid Item 028 (52,000 cubic yards) is accurate and no factor was used to increase the neat cut volume, should the boundary provided in Drawing C-47 be expanded or moved westward to correspond to the ISO EB vs REQUIRED WITH SLOPES.1 Volume Surface?

Answer: See response to Question 71.

75) Can we get a copy of the mandatory pre-bid meeting sign in sheet please?

76) We are a subcontractor that specializes in the supply and installation of geosynthetics. We are looking forward to submitting a proposal for the liner scope of the referenced project. Could you please share with us the plan holders' list?

77) I am a supplier of irrigation materials and one of my customers is requesting a quote for irrigation material. It is unclear what is to be irrigated. Could you provide some clarity so I know what to have our design team irrigate?

ITB: S-10700-00014831

Reponses to Questions as of December 11, 2025 (FINAL Answers to Questions# 1-160)

Answer: Specification Section 32 90 00 – Restoration and Planting, Subparts 1.4 and 3.6 detail the requirements for temporary irrigation. From Subpart 3.6: “A temporary, aboveground irrigation system that provides complete coverage of Subarea 2 and the portion of Subarea 1 that is not regularly inundated (above elevation 8.5 feet NAVD88)...”

Sheets C-83 and C-84 of the Contract Drawings show the plant material palettes and plant material spacing.

78) Detail A in Drawing C-33 shows the profile for the ramp at the Turning Pad Area. In this detail, does the solid black line represent the top of subbase material or top of base material?

Answer: The ramp should be built from Imported Structural Fill or Stabilization Material up to the Turning Pad and Ramp Area boundary per the typical haul road cross section detail. In the turning pad area, the solid black line represents the finish grade with the section as called out in Detail C on Sheet C-40.

79) Note 7 on Drawing C-45 states “Once all sediment removal and initial backfill placement is

Subarea 1 is complete for CS1, complete grading, habitat material placement, and planned restoration work.” Note 11 on Drawing C-45 states “at Contractor’s discretion (in Construction Season 2), begin placement of any remaining restoration fill materials and planting in CS1 Area. For liquidated damages, please clarify what constitutes interim completion for Construction Season 1. Is it the completion of the excavation and initial backfill placement?

Answer: Yes it is the completion of excavation and backfill below OHW.

80) Section A.8 in the ITB document states “If Contractor fails to complete the Work required to be completed in Construction Season 1 by the Construction Season 1 interim completion date, and an in-water work period variance is sought and granted by the appropriate permitting agency(ies), Contractor shall pay to DEQ, not as a penalty, but as liquidated damages, $5,400 per calendar day for each day Work is performed beyond the CS1 Interim completion date.

Assessment of liquidated damages will stop when CS1 Work is complete. If in-water work period variance is sought and not granted, the Contractor shall pay to DEQ, not as a penalty, but as liquidated damages, a single assessment of $2,000.” Please explain what an “in-water work period variance” is, how it would be sought, and which agenc(ies) would be responsible for granting it.

Answer: An In-Water Work Period (IWWP) variance is formal authorization from the permitting agencies that extends the previously stated IWWP. It is sought by the permit holder (DEQ) from the USACE and involves additional coordination with other applicable resource agencies, such as the NMFS. The contractor would be responsible to provide DEQ all the necessary information needed to request an IWWP variance including but not limited to: an explanation of the proposed changes to the project, rationale regarding why an extension is needed, timing and duration of project activities, alternatives considered prior to requesting an extension, best management practices or conservation measures proposed, forecasted water levels, contingency plans, project

81) The ITB document does not address consequential damages. Please confirm that the only applicable damages are those addressed in Section A.8 of the ITB document.

Answer: Damages are addressed in Section A.8 of the ITB Document, Section 4 of the Sample Public Improvement Agreement (Attachment D-1 of the ITB Document), SGC-12 of the Supplemental General Conditions (Attachment D-4 of the ITB Document), and Section G.1.2. and G.1.3 of the General Conditions (Attachment D-4 of the ITB Document).

82) Drawing C-87 contains a note that reads “The Top 1 Ft, or as directed by the Engineer, of rock at the truck turn around pad and ramp to the SPA is removed and disposed of.” Will this rock be replaced at the beginning of Construction Season 2? If so, how will the Contractor be compensated for this?

Answer: Replacing the top foot at the turn-around and ramp is included under Alternative Item A-09 for IRAM haul road repairs. See Question 45 for out of scope conditions.

83) There is a call out on Drawing C-33 indicating “Contractor to cut utility pole to existing grade and remove overhead line prior to subareas 1 and 2 excavation.” Is the overhead line still energized?

Answer: The property owner, Upland Data Center, has stated that there is no power to that line. Contractor is to verify for themselves that the line is deenergized prior to performing the work.

84) There do not seem to be any references for in-situ density testing. Please confirm that density testing will not be required for any aspects of the project, including the Uplands scope.

Answer: Insitu density testing will not be required for the project as presented; however, if replacement of permanent asphalt is required, testing requirements per Oregon Standard Specifications shall be followed.

85) Drawing C-75 depicts the dimensions for the intertidal channels for the final restoration. Is RML to be placed within this channel? And if so, should the channel be dug deeper to have final dimensions of 6’x2’?

Answer: The bottom of the channel should have RML placed on it post excavation. The channel should be dug to 6’x2’ and a foot of RML added to both the surrounding grade and the bottom of the channel.
