About this file

This is a Living Wage Submittal document for the City of Austin, Texas, applicable to a Mobile Container Purchase and Rental contract. The document establishes wage compliance requirements for all contractor employees and subcontractors directly assigned to the City contract. All workers, regardless of tier within the subcontracting structure, must be compensated at a minimum rate of $22.15 per hour. Contractors are required to submit a certification with their bid listing all employees and subcontractors assigned to the contract, along with their names, job titles, and confirmation of wage rates meeting or exceeding the minimum threshold. Individual Employee Certifications must be provided within 30 days of contract execution, with annual recertification required on each anniversary date of contract execution and upon any employee changes or additions to the contract.

The City of Austin reserves the right to review employee records at any time to verify compliance with living wage requirements as mandated by Fair Labor Standards Act documentation. Contractors must maintain basic employment and wage information for each employee throughout the contract term. Violations of the living wage provision, including willful or repeated breaches or fraudulent certifications, may result in contract termination for cause, suspension or debarment of the violating firm, or legal action. Non-compliant contractors are required to pay affected employees the full amount of wage deficiency for each day the violation continues. Contractors are also prohibited from retaliating against employees who report non-compliance with living wage provisions.
