About this file

This is a Local Business Preference submittal form for the City of Austin, Texas, related to a contract opportunity for capacitor banks and associated parts for Austin Energy's electrical distribution system. The form outlines the City of Austin's Local Business Preference Procurement Program, which encourages local businesses to participate in municipal solicitations. The program defines a Local Business as any person or corporate entity with headquarters located within the Austin-Round Rock-San Marcos Metropolitan Statistical Area, encompassing all areas within Bastrop, Caldwell, Hays, Travis, and Williamson counties. Participation in this program is optional, and completion of the Local Business Preference form is not required to submit an offer for the solicitation.

The form requires offerors to certify their headquarters address and confirm whether their headquarters serves as either the location of owners or leadership providing direction and management of the entity, or the entity's Administrative Center where important business and operational activities are managed. The City of Austin reserves the right to request additional information and confirm the offeror's headquarters location using available resources. Misrepresentation of headquarters information may result in the withholding of any available preference, disqualification from the resulting contract if the error is determined to be intentional, or contract voidance if the misrepresentation is discovered after contract award. This submittal form is not subject to federal funding restrictions regarding local preference provisions.

LOCAL BUSINESS PREFERENCE – OPTIONAL

To encourage Local Businesses to participate in City solicitations and to increase the opportunities to do business with the City, the City of Austin maintains a Local Business Preference Procurement or “Local Preference” Program.

Note: Local Business Preference may not be allowable, and will not be provided, in solicitations subject to federal funding.

1. Instructions. Offerors meeting the following criteria (both) are encouraged to complete this form and include it with their Offer. Participation in this program or completion of this form is not required to respond to this solicitation.

A. Local Business. The City defines a Local Business as any person or corporate entity with Headquarters located within the Local Area. 3. Misrepresentation. If the City determines any of the Offeror’s information regarding their Headquarters is incorrect, the City may withhold any available preference. If the City determines the error was intentional, the City may disqualify the Offeror from any resulting contract as being non-responsible.
