As stated in Section M, paragraph M.2.D. 15. RFP reference: Attachment 1
Question: Attachment 1 contains job descriptions with minimum specific education and job experience. FAR 52.222-42 (pg 44 of 78) lists the equivalent GS levels for Federal Hires for each of these same labor categories. Both of these inputs appear to be inconsistent with the Service Contract Act (Attachment 13). Would the Government please clarify?
As stated in Section C, paragraph C.7, Attachment 1 provides a list of the types of labor categories, responsibilities, minimum education requirements, and minimum experience requirements that shall be provided in accordance with the specific requirements of issued Task Orders. These are the labor categories that are anticipated to be needed under this contract.
As stated in Section I, paragraph I.3.B., FAR 52.222-42 identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency. The table lists all of the labor categories that are anticipated to be needed under this contract and specifies the approximate wage and fringe benefits payable if they were employed by the Federal Government. This table is for information only and is not a wage determination.
As stated in Section L, paragraph L.7.E.1., offerors shall be responsible for ensuring compliance with the Service Contract Act as prescribed in FAR 52.222-41. For those labor categories that the offeror determines to be SCA applicable, the contractor shall use Attachment 13 as a reference to ensure payment of their employees of at least the wages and fringe benefits found by the Department of Labor to prevail in the locality or, in the absence of a wage determination, the minimum wage set forth in the Fair Labor Standards Act, as per FAR 22.1002-2 Wage determinations based on prevailing rates.
16. RFP reference: Attachment 1
Question: Will the Government consider equivalency substitutions for Experience and Education requirements (e.g. 2 years of directly relevant experience is equivalent to 1 year of formal education)?
No, the education and experience levels outlined in Attachment 1 are the minimum levels required for each labor category. As stated in Section L, paragraph L.7.2, offerors are given the opportunity to submit additional labor categories if necessary to achieve successful performance of any or all task areas. Any additional proposed labor categories shall be added directly to Attachment 1 and shall include a labor category title, responsibilities, minimum education level, and minimum experience required. Any additional proposed labor categories shall also be added directly to Attachment 10 and shall include on-site and off-site labor rates for the term of the contract.
17. RFP reference: Attachment 10
Question: Reference Attachment 8 Question 124. Should the contractor assume that overtime rates will be established after contract award and not included in Attachment 10?
In accordance with FAR 22, contractors shall perform all contracts, so far as practicable, without using overtime, particularly as a regular employment practice, except when lower overall costs to the Government will result or when it is necessary to meet urgent program needs. Any approved overtime, extra-pay shifts, and multi-shifts should be scheduled to achieve these objectives.
In the event overtime is required, FAR 22.103-3 procedures shall be followed and the applicable clause FAR 52.222-2 will be incorporated into the applicable task order.
18. RFP reference: Attachment 10
Question: The table appears to be requiring a single fixed rate for each labor category applicable to the prime contractor and all subcontractors. Does the Government expect to request discounted rates for the performance of the individual task orders?
Offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, this does not preclude the Government from entering into negotiated task orders in accordance with Section G, paragraph G.4 and G.5 and Section B, B.1 Schedule.
19. RFP reference: Attachment 11
Question: For purposes of providing the fixed unit price for the 3 listed training classes, will the Government provide an estimate of the total number of students required to be trained by the contractor for each class type for the base and option periods?

The projected number of students requiring training for the option years is not available. Task Orders will provide more clearly defined requirements for specific training when issued.

(2) What basis should be used to determine the Price Per Student entry; i.e. below the minimum range or above the maximum range?
