HSCG44-12-R-P13005 Amendment A00003
NDGPS RFP HSCG44-12-R-P13005
List of Questions and Concerns with Response Contractor Question/Concern:
Question 70:
1. The following instruction is given: The Small Business sub-contracting plan will not be rated. It will only be reviewed. We believe that this statement does not encourage small business participation on this specific NDGPS program.
Government Response: RFP Paragraph E.8 spells out the evaluation criteria. Large business will work with Small business due to the scope and geographic reach of this requirement to develop its Small Business sub-contracting plan.
2. What happens if a large business proposes doing all of the NDGPS work internally without the use of ANY (small or large business) sub-contractors? That means that the large business will submit a samll business sub-contracting plan that shows zero sub-contract dollars as related to the NDGPS program. Since this zero dollar sub-contract plan 'will not be rated only reviewed', what incentive does a large business have in developing a meaningful small business sub-contracting plan specifically for the NDGPS program? Will this zero dollar sub-contract plan be approved?
Government Response: Large business is required to submit a sub-contract plan in the format found in Attachment VII. Sub-contract plan shall be submitted in Volume III. The narrative submitted for Volume I and III should address how a company will utilize Sub-contracting to meet the requirements set forth in the RFP. A proposal will not be evaluated should an Offeror fail to submit a subcontracting plan as instructed. A zero dollar sub-contracting plan will be construed as “No Sub-contracting plan” which will not be negotiated or approved.
3. Another clause that concerns us as a small business is: If the Offeror has no previous contracts requiring a subcontracting plan, please include a statement to that effect in the proposal. We believe this statement does not encourage small-business sub-contracting as related specifically to NDGPS.
Government Response: The statement, “If the Offeror has no previous contracts requiring a subcontracting plan”, informs the evaluator to the level of effort required to prepare for sub-contracting plan negotiation.
4. The above criteria also means that proposals or teams that propose small business sub-contracting plans specific to the NDGPS program will not be given credit for small business sub-contracting specific to NDGPS during the evaluation process since the plans 'will not be rated only reviewed'.
Government Response: Please refer to Government response in question 2.
5. We believe the following statement needs some clarification: No award will be made to a Large Business without an approved subcontracting plan. What is the criteria for an approved subcontracting plan? Does the plan have to be specific to the NDGPS Program?
The subcontracting plan shall be specific to the NDGPS RFP, HSCG44-12-R-P13005 requirement. Subcontracting plan goals not in line with goals for this requirement will be negotiated between the apparent awardee and Contracting Officer prior to award. Note the evaluation criteria for this RFP is in section E.8.
Sub Contracting Goal for this requirement is:
Small Business Subcontracts 33.5%;
Small disadvantaged business concerns 10 %;
Women-owned small business concerns 5 %;
HUBZone small business concerns 3.8 %;
Service Disabled Veteran-Owned small business concerns 3 %.
