FOR YOUR OBJECTION AND IDENTIFY SPECIFIC PORTIONS OF THE PROPOSAL YOU
OBJECT TO DISCLOSURE TO NON-GOVERNMENT, CONTRACTOR ADVISORS.
L-04. SOURCE SELECTION METHODOLOGY
L-04.1 Offeror The Offeror is to be the single U.S. contractor with the responsibility and authority for the overall performance of the contract, and any offer which does not consistently identify the single offeror as the entity to which a contract would be awarded may be rejected for failure to conform to the provisions of this solicitation. The Government anticipates the Offeror may form teams and/or develop other business relationships for this effort. While the Government recognizes teaming may be necessary, it discourages any business relationship or guaranteed work share agreement that may inhibit any Offeror's flexibility in meeting emerging and changing requirements or prevents any Offeror from introducing new technology, new sources or re-evaluating its procurement approach. Guaranteed work share, for the purpose of this source selection and any contracts resulting from the source selection, is defined as an agreement in writing or otherwise that guarantees anticipated dollars, a total dollar amount, a percentage of anticipated or actual dollars earned, and/or a percentage of anticipated or actual work to be performed. Guaranteed work share, for the purpose of this source selection and any contracts resulting from the source selection, does not include agreements that guarantee anticipated or actual work to be performed based on scope or type of work; and does not include agreements under which the prime and another team member agree a team member will be paid a fixed price for work defined in the agreement.
Exclusive teaming, exclusive teaming arrangements, and all agreements that include guaranteed work share are prohibited under the NGAM concept definition and planning program effort, both during the formulation of proposals and during execution of any resulting contract. Exclusive teaming arrangement, for purpose of this source selection and any contracts resulting from the source selection, is defined as an Agreement in writing or otherwise that excludes a teammate from being able to provide the same or similar services or product to another offeror competing for the NGAM concept definition and planning program.
All offerors will include an affirmative statement in Volume 1, Tab 1, that they have not entered into an agreement or attempted to enter into an agreement with any subcontractor, consultant, supplier, or other team member which is or would be an exclusive teaming arrangement or that contain any guaranteed work share, also stating affirmatively that in the process of forming teams with other team members that are or may team with other offerors, they are taking affirmative steps to identify and avoid conflicts of interest, inappropriate disclosure of information, and any anticompetitive practices to the offeror or prime. Failure to include the affirmative statement required by this paragraph will be grounds for a determination that an offer failed to conform to the requirements of the solicitation.
By submission of an offer, offerors agree to inclusion of this section in any awarded contract.
L-04.2 International Participation No individual who is not a U.S. citizen may participate in any way in writing or submitting a proposal for or on behalf of an offeror, contractor, member of a contractor's team, or any entity supporting or working with the offeror or contractor. No such individual may have dual citizenship of the U.S. and another country unless such individual unequivocally renounces the citizenship of the other country prior to beginning work on the offeror or the contract. No offeror, contactor, member of a contractor's team, or entity that supports or works with the offeror or contractor may have any contact with a foreign government, an international organization, a coalition partner, anyone who is not a U.S. citizen, or any immigrant alien about this RFP, any offer submitted under this RFP, any resulting contracts, or any subcontract or teaming arrangement at any time during this source selection or during performance of any contract. Offerors will include an affirmative statement in Volume 1, tab 1, of their proposals, acknowledging that they have read, understand, and will comply with this provision; that this provision will continue in force even if any business or sale or other conveyance of a business or sale or conveyance of its assets occurs; that during any process to seek approval of a novation they will bring to the Contracting Officers attention any non-U.S. citizen who may be involved in the conveyance; that they will cooperate fully should the Contracting Officer ever need clarification or affirmation of their compliance; and that should there be any issue, ensuring compliance with this clause will be the responsibility of the contractor and at the contractor's cost. Failure to comply with this provision may be grounds for determining an offer to be nonresponsive, or for termination for default of any contract awarded as a result of acceptance of an offer in response to this RFP.
L-04.3 Competitive, Best Value Source Selection The Government contemplates the competitive award of up to three Cost-Plus Fixed-Fee (CPFF) contracts resulting from this solicitation, but reserves the right to make fewer than three awards, more than three awards, or no award at all. The proposal instructions in this section are designed to assist Offerors in preparing a complete response that reflects a full understanding of the proposed approach to accomplish all contractual requirements. Section M provides further detail as to how the proposals will be evaluated.
This is a best value source selection based on proposals received from Offerors. The Government will select for award the most advantageous proposal(s) representing the best value to the Government based on the Source Selection Authority’s (SSA) integrated assessment of the stated factors, subfactors, and general considerations. Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors or subfactors to be eligible for award. By submission of its offer, the Offeror accedes to all solicitation requirements and identified constraints.
L-04.4 Offeror’s Best Terms The Offeror’s initial proposal shall contain the Offeror’s best terms for technical, past performance, management and cost/price. The Government reserves the right to award without discussions, and Offeror’s are encouraged to shape their initial proposal accordingly. However, if required, the Government may conduct discussions with Offerors in the competitive range in accordance with (IAW) FAR 15.306(c). Prior to discussions, the Offerors may be given the opportunity IAW FAR 15.306, to clarify certain aspects of their proposals (e.g., the relevance of an Offeror’s past performance information and adverse past performance information to which the Offeror has not previously had an opportunity to respond) or to resolve minor or clerical errors.
The Government reserves the right to consider as acceptable, only those proposals submitted in accordance with all instructions set forth or referenced in this solicitation, so Offeror’s are cautioned to ensure their proposal follows those instructions carefully. A proposal that omits material elements required of the solicitation may be omitted from further consideration. Failure to comply with the requirements of laws and regulations set forth or referenced in the solicitation may affect eligibility for award. The Government may reject any or all offers if such action is determined to be in the Government’s best interest.
The Government may reject any proposal that is evaluated to be unrealistic, including contract terms and conditions, or unrealistically high or low in cost/price when compared to the Government cost realism analysis, or such that the proposal is deemed to reflect an inherent lack of understanding/competence or failure to comprehend the complexity and risks of the NGAM requirement. The Government will consider, throughout the evaluation, the correction potential of any deficiency or problem. The judgment of such "correction potential" is within the sole discretion of the Government. If any aspect of an Offeror's proposal not meeting the Government's requirements is not considered correctable, the Offeror may be eliminated from the competitive range, if applicable. The Government will use this information to support competitive range and contract award decisions, as applicable.
At the Government's discretion, a competitive range determination may be utilized IAW FAR 15.306.
Offerors are hereby notified that IAW FAR 15.306(c) (2), the PCO may limit, with SSA approval, the number of the most highly rated proposals to a number at which an efficient competition can be conducted. The PCO will promptly notify any Offerors of any decision to exclude them from the competitive range IAW FAR 15.503, whereupon they may request and receive a debriefing IAW FAR 15.505.
L-04.5 Final Proposal Revisions Once discussions have been concluded with Offeror(s) determined to be in the competitive range, if conducted, the PCO will request the Offeror provide a Final Proposal Revision (FPR) in accordance with FAR 15.307. The Offeror is advised that any changes to the proposal in the FPR must be fully addressed and/or explained and reflected in the proposed cost/price. Failure to comply with this requirement can adversely influence the evaluation of the proposal. The PCO will establish a common due date and time for submission of the FPR.
When final proposal revisions are requested, any revisions or non-concurrence with contract terms and conditions submitted in the final proposal revision may not be subject to further discussion or negotiation and may render the offer unacceptable to the Government. This provision is not intended to restrict the Offeror’s opportunity to revise figures, (e.g., prices, discounts, or percentage rates). Rather, it is intended to preclude any misunderstandings by the Government, which could result if new or revised terms and conditions are submitted in the final proposal revision that have not been fully disclosed, discussed, and understood during discussions or negotiations. Hence, such new or revised terms and conditions are not solicited and, if submitted in the final proposal revision, may render the offer unacceptable to the Government.
L-04.6 Post Award Debriefing An unsuccessful Offeror will have three (3) business days from the date of Government notice of contract award to submit a written request for a post-award debriefing IAW FAR 15.506. An unsuccessful Offeror who fails to submit a timely request will not be entitled to a debriefing. IAW FAR 15.506, the PCO may elect to conduct the debriefing orally, in writing, or any other acceptable method. An Offeror will receive no more than one (1) debriefing.
L-04.7 Errors/Omissions If an Offeror believes the requirements in these instructions contain an error, omission, or are otherwise unsound, the Offeror shall immediately notify the PCO in writing with supporting rationale no later than five (5) business days after release of this solicitation. Also, the Offeror shall give written notification to the PCO of ambiguities in the solicitation no later than five (5) business days after the release of this solicitation. All comments must be submitted on the comment resolution matrix, Attachment 2.
L-04.8 Mistakes Mistakes in an Offeror’s proposal shall be handled IAW FAR 14.407-4 as referenced in FAR 15.508.
L-04.9 RFP Revisions/Amendments The Government reserves the right to revise or amend any portion of this solicitation. Such revisions or amendments will be posted to FedBizOpps using Standard Form (SF) 30. If such amendments require material changes, the proposal due date may be extended at the discretion of the PCO and by enough days to enable an Offeror to revise its proposal. In such cases, the amendment will include an announcement of the new proposal due date and time. The Offeror shall provide acknowledgement in Block 14 of the SF 33 of any solicitation amendments issued by the Government.

L-05. PROPOSAL PREPARATION INSTRUCTIONS
L-05.1 Classification and Presentation Each proposal volume shall be unclassified. Each volume shall be written in Standard English and be complete in itself (e.g. the Government will evaluate technical capabilities IAW Section M based solely on information in the Technical Volume. Do not include Technical information in other volumes unless required to support evaluation of the relevant Section M factor/subfactor for that volume. Unless otherwise specified, the Offeror may use any form of presentation, such as narrative, pictures, tables, graphs, schematics, logic, and other functional block diagrams to convey a concise description of information.
L-05.2 Completeness The Offeror's proposal shall include all data and information requested and shall be submitted IAW these instructions. Non-conformance with these instructions may result in an unfavorable proposal evaluation, or rejection of an Offeror’s proposal, rendering it ineligible for award.
The Offeror’s proposal shall be clear, concise, and include sufficient detail for effective evaluation by the Government and for substantiation of stated claims. The proposal shall not simply rephrase or restate the Government's requirements, but rather shall provide convincing rationale to address how the Offeror intends to meet the areas to be evaluated. Offerors shall assume that the Government has no prior knowledge of their experience and will base its evaluation on the information presented in the Offeror's proposal. The Offeror’s proposal shall respond to all factors and subfactors. The proposal shall demonstrate that the Offeror possesses the technical expertise, experience, and program management capability to plan, organize, and deliver the NGAM effort in a coordinated, technically competent fashion that is timely and cost efficient. Innovative management, technical, and business approaches to improve efficiencies and reduce costs are encouraged; but will not constitute an alternate proposal. The proposal shall include all of the information requested and must comply fully with these Section L instructions. Failure to do so may cause the proposal to be eliminated from consideration for award. Contingent or alternate proposals are not allowed and will not be considered or evaluated by the Government. Offerors are reminded to properly mark their proposal documents which contain proprietary or restricted information.
L-05.3 Due Date Proposals are due at the location specified in L-06.4 on 12 NOV 2010, 1500 hours (Central Time) except for Volume III Past Performance. Submit a technical approach to develop a fully defined and thoroughly characterized Next Generation Aegis Missile (NGAM) concept that meets NGAM constraints and performance guidelines. The Offeror’s proposed technical approach must address the following:
(1) (Tab 1a) Performance Work Statement (PWS): Submit a PWS for the NGAM concept definition and planning effort that uses “the contractor shall” language in the development of the PWS and refrains from the use of language such as “the contractor will” and “as required”.
Develop the PWS using performance based language. The PWS shall be inclusive of all required performance efforts, based upon the overall program objectives and constraints as stated in the SOO (Section J Attachment 1) and fully captures the discrete requirements of the Offeror’s Technical Approach. The PWS shall encompass the entire scope of work as stated in the SOO. Correlate the PWS with the Offeror’s Technical Approach and with the Offeror’s Integrated Master Schedule (IMS). The winning Offerors’ PWS will be incorporated into the contract at contract award.
(2) System Engineering: Describe a structured and systematic systems engineering process to perform missile system level trades, subsystem level trades, and determine performance drivers that include technology development and integration risk, schedule, and average unit production and lifecycle cost, as key trade parameters. Define trade studies that span the full range of missile concepts including, but not limited to, the System/Weapon System and Missile attributes in the SOO while ensuring functional and physical concepts, missile component technologies, and system interfaces which provide capability in the NGAM reference missions and are within the constraints of the Aegis Weapon System (AWS) (including the Aegis BMD 5.1 and Mk 41 Vertical Launching System (VLS)), shipboard qualification requirements and the BMDS architecture as defined by the Government.
(a) Describe the level of component and sub-component trade studies planned and the methodology for trading individual component capabilities with their impact on sub-system and system level capabilities. Describe how factors such as performance, cost, risk, and schedule are measured and used for making decisions. Identify the analysis and performance assessment tools that support the trade studies.
