CLIN/

Clause/Appendix/A ttachment/Other

QUESTIONS/COMMENTS/RECOMMENDATIONS GOVERNMENT OFFICIAL RESPONSE

1 21 1.6.10.1 General Information Key Personnel - Are Key Personnel required to be direct employees of the company or can they be subcontractor personnel?

Key Personnel can be employees of either the prime contractor or the proposed subcontractor. However, if the KP must meet the same qualifications as if they were employed by the Prime.

2 22 1.6.11.1 General Information

Technicians - The PWS states that "Contractor's technician shall respond to emergency calls within two

(2) hours." Is this correct, and is it in addition to the Project Managers responding and being on site within 2 hours?

Project Manager(s) shall call-in the appropriate technician to respond within two (2) hours to the emergency service call. Per Section 1.6.10.2.5, "At least one project manager must be on-site for all corrective maintenance and service call work."

3 43 5.11.4.1 DCS

Electricians/Technicians - The PWS states that "Contractor's technician shall respond to emergency calls within two (2) hours." Is this correct, and is it in addition to the Project Managers responding and being on site within 2 hours?

DUPLICATE - See Response #2

4 32 5.3.2.1 Cost - Invoice

Service Call Routine Response - The PWC says that "Upon receiving a routine call, the Project Managers shall respond within one (1) hour with a plan of action and be available to walk the job with the

Government." Is this correct? Does this turnaround time also apply to after hours, weekends, and holidays?

Yes, this is correct. No, it does not apply to after hours, weekends, and holidays.

5 32 5.3.2.2 Cost - Invoice

Service Call Emergency Response - The PWC states that "Project Managers shall respond with a call back in 30 minutes, and shall be on site wihin two (2) hours." Does this mean that both Project Managers are to show up on site when they are called in?

No, only one Project Manager is required to respond to and be on-site for an emergency service call.

6 33 5.3.3.2.2 Service Calls Tickets

Service Call Estimates - Routine estimates are required to be developed within 48 hours; Emergency estimates are required to be developed within 6 hours. These turnaround requirements are more aspirational than practical. While we would act with urgency to achieve these services as quickly as practical, factors outside our control (complexity, reaching vendors, obtaining pricing, delivery of parts) may make the 48-hour or 6-hour timeframe unreasonable and unattainable. While this task would be performed with urgency, we request that these timeframes be revised to reflect historic data from

MCDean and use a more practical timeframe.

Timeframes will be not revised. Routine Response Service Call ticket cost estimates shall be developed within 48 hours. Emergency Response Service Call ticket cost estimates shall be developed within 6 hours.

7 40 5.8.2 Chilled Water System

Chilled Water System - Are the tasks in the identified sections considered as part of the "all-inclusive package" referenced in 5.8? We would expect that this would be a maintenance inspection item, with repair costs to be bid with the estimate. Please confirm if this is the intent and if the wording needs to be revised to reflect that.

The Contractor shall provide an all-inclusive package (including all material, parts and labor). Per Section 5.8.2.1, "The Contractor shall perform all preventative maintenance, corrective maintenance and service call tickets on all ten (10) PH&RP chillers."

8 N/A

Insulation - Please confirm that the existing insulation on piping and other components will only be what is disturbed during work/repairs on this contract and that no wholesale replacement of existing deteriorated insulation is to be included in the bid.

Replacement of insulation shall not be included in the bid. Any replacement of insulation shall be issued through a service call or corrective maintenance ticket.

9 65 H-11 e.

H-11 Invoicing

Instructions -

Supplementary

Labor Category Deductions for Leave - The subject paragraph under Invoicing Instructions seems to require that contractor personnel on leave, training, etc. have their pay rates deducted when they are in that status. This seems to reflect terms of a Time & Materials Contract, rather than acknowledging that

Union agreements include fringe benefits and leave in their hourly rates and cannot be withheld when the employee is on leave. Additionally, key personnel are on call 24/7/365 and have to travel and come in for additional hours outside the defined core hours. This will incur additional costs at overtime & holiday rates, but the contract does not address the additional labor costs of on-call or after-hours services. Can this requirement be revised to account for the contractor's risk and cost of providing these services?

The example is how you will calculate partial billing in the event there is a lapse in contract coverage. Paragraphs 1.6.10.2.5 and 5.3 address on-call and after-hours services.

10 65 H-11 g.

H-11 Invoicing

Instructions -

Supplementary

Deduction of Labor hours on services that do not conform - In this paragraph, the government is said to be able to decrease the costs of expended labor hours, if the work is not fully in conformance of the requirements when invoice is submitted. Due to the nature of troubleshooting, and the requirements of full coverage of staffing and labor costs, labor hours may be expended even if first attempts at repairs may not be successful. The hours will still have been expended, and presumably the contractor will justifiably be entitled to labor hours worked. Please confirm that actual expended labor hours will not be subject to non-payment.

There will not be a decrement to hours for work justifiably entitiled to labor hours worked. However, if the work is not performed an adjust invoice must be submitted.

11 32 5.3 Cost - Invoice

Service Calls Approvals by COR/KO - In this section, and several others, it is stated that the COR/KO must be notified to coordinate work, approve parts, pricing, and estimates of labor & materials. With short turnarounds of 6-hour of 48-hour estimates and other tasks during after hours, weekends, holidays, etc., will the COR/KO be available to respond and provide the needed coordination or approval for the contractor/subcontractor to perform their required tasks?

Yes, the COR/KO will be available.

12 33 5.3.3.4 Service Calls Tickets

Method of Procedure Requirments - This paragraph states that "The Contractor shall include a Method of

Procedure (MOP) for all work, including contingency plans in case any unexpected problem/failure occurs that could affect/impair said piece of equipment for a period of time5.3.3.4 longer than 24 hours."

We question the reasonableness of being able to predict "any unexpected problems/failures" and have concerns about the practicality and cost-prohibitive nature of preparing an MOP for ALL work. Please confirm that this is what the government is requesting or revise the wording to a more practical, cost-effective standard.

Yes, the Government is requesting a Method of Produre per Section 5.3.3.4.

13 35 5.5.5.1 PPMI Plan

Spare Parts Inventory Management - This paragraph requires that within 60 days of NTP the Contractor provide a complete parts list with extensive descriptions, quantities, and expected lead/delivery time. Is there an existing spare parts inventory that can be used and revised for this purpose?

No, Contractor shall develop spare parts list for all equipment based on Equipment

Nameplate Data and field verification.

14 36 5.6.1 PPMI Plan

Asset Data & Maintenance Records - This paragraph requires the Contractor (within 90 days of award) to provide all asset data, job plans, PM schedules, and associated costs for all planned maintenance activities in MAXIMO. Since MAXIMO is currently being used as the CMMS, will the Contractor be provided with current asset maintenance data, records, historical info for schedules and costs?

After award, the Contractor will be provided with the most current asset data that is available.

15 29 4.5

Contractor Furnished

Items and

Responsibiliites

Contractor Furnished - The Contractor is required to provide the COR with SDS for each material in use or stored on the Pentagon Reservation and (within 30 days of award) provide approximate quantities

(within 10%) and locations of all materials requiring an SDS. Additionally, the Contractor is required to update this information whenever there is more than a 10% change within the volume/quantity of these items. The fluctuation in volume/quantity of such items will make it nearly impossible to track changes of

10%. Is there a current inventory of such materials that will be on hand or left behind? And can this quantity requirement be eliminatied or alternately be reported as a maximum volume/quantity?

No, there is not a current inventory that will not be on hand or left behind. This section of the PWS refers to only materials brought and stored on site by the

Contractor, not a requirement for the entire plant.

This requirement cannot be eliminated it is required by WHS Safety. The

Government is also required to follow this requirement.

16 31 5.1.6 Specific Tasks

Access - The PWS states that there is no permanent parking available nor included and that temporary parking request will be handled by the COR on a case-by-case basis. This restriction will have an impact on the Contractor's ability to provide a timely response to routine and emergency service calls with the personnel that are required to respond or perform work. What provisions can be made to address this conflict?

Permanent parking shall be provided to (7) key personnel. All other personnel shall be provided limited temporary parking requests approved by the COR on a case-by-case basis.

17 20 1.6.8.9 General Information

OPSEC Requirements - Contractors and their personnel are required to have OPSEC awareness and education training initially and annually as required by the Government. What are the details for how this training will be provided?

OPSEC training is provided annually by the Government, free to the Contractor.

Only Contractors with CACs are required to complete OPSEC training.

18 30 4.8

Contractor Furnished

Items and

Responsibiliites

Uniforms - This paragraph requires the Contractor to provide uniforms and require that all employees, supervisors, and subcontractors wear said uniforms. We find the requirement to provide these to

(sometimes unknown or emergency responding) subcontractors impractical and cost-prohibitive. We request that the subcontractor uniform requirement be eliminated for this reason.

Concur. The key personnel and subcontractor shall wear distinguishable clothing that identifies their respective employer.

19 42 5.11 DCS

Boiler Plant Maintenance - The requirement to support boiler controls PLC and Iconics is not currently available to MCDean and are they are not able to provide this service. Please address how access will be provided or the responsibility assigned to another agent.

Conduct market research. The Governement cannot provide or recommend another agent.

20 43 5.11.9 DCS

Upgrades to Software or Licenses - Since the software belongs to the Government, we cannot provide this service. Please address this issue and how this can be provided.

Per Section 5.11.9, "PLC System software support. Any regularly released patches and version upgrades by the Allen Bradley, or other PLC manufacturer shall be provided as a part of this service contract. Labor to install and support software shall be included."

The intent is that the Contractor install the released patched and version upgrades provided by the Governement.

21 48 5.2 Cost - Invoice Equipment/System Warranty Management - Please provide a list of all warranties and dates. List of all warranties and dates shall be provided after award.

22 3, 4 Section B CLIN 0001

Please provide a guideline to estimate the off-hours work to be required under CLIN 0001. These employees would be covered under SCA or DBA depending on the work being performed, so these are not salaried positions and would be in addition the regular duties performed by the key personnel in CLIN

0001 during normal working hours

Off-hours work is not required per CLIN 0001. Only a service call ticket can authorize off-hours work per CLIN 0003 or CLIN 0004.

23 3, 4 Section B CLIN 0001 Please verify that the personnel under CLIN 0001 may perform services under CLINS 0002-0004, even though they cannot separately charge for these services under CLINs 0002-0004 Concur.

24 32 5.3 CLIN 0003

Please verify that the costs of materials for the Preventative Maintenance and Services Calls under $2000 is to be covered under CLIN 0003. If so, then please provide a guideline to estimate these costs.

Costs of materials for Preventative Maintenance and Service Calls under $2000 shall be covered under CLIN 0002.

25 32 5.3.1

CLIN 0002 & CLIN

If the contractor is to be responsible for Preventative Maintenance and Services Calls under $2,000, then what safeguards are in place to protect the contractor from the Government making incremental requests under the $2,000 limit?

Typically twenty-five (25) service call repairs with a value less than or equal to

$2,000 per year would be expected.

Typically seventy-five (75) corrective maintenance repairs with a value less than or equal to $2,000 would be expected.

26 3 Section B CLIN 0002

During the site walk, was there equipment identified that was not on the Equipment Nameplate Datasheet that needs to be covered in CLIN 0002 Preventative Maintenance. If so, please identify this equipment so we may adequately price this FFP requirement.

The Equipment Nameplate Data list adequately covers the Preventative Maintenance that will be required for this contract.

27 32 5.3 Service Calls Tickets

Service Call Tickets - please provide the process the government intends to use to confirm and approve costs for service calls and corrective maintenance identified by the contractor. How is fair and resonable pricing determined by the government?

Costs associated with corrective maintenance tickets under $2,000 are to be included in CLIN 0002.

30 21 1.6.10.2.5 Key Personnel

Please clarify the following clause: "The Project Managers’ time or “Labor Rate” is carried as a firm fixed priced, as they are identified as Key Personnel and required to be on-site during core hours, and therefore will not be included in any additional cost estimates for service calls and corrective maintenance. The only exception being if the repair work takes place during off-hours, e.g., emergency service call.". This statement seems to be in contrast with other statements that say the Key Personnel's time is not billable. Is Key Personnel labor for off-hours or emergency service calls billable?

Key Personnel labor is only billable for off-hours on service calls or corrective maintenance tickets.

31 16 1.4 Scope

"This contract scope covers all associates equipment, including but not limited to cables, sensors, dampers, and transmitters necessary for proper operation of the equipment and systems even if not specifically identified in the Equipment Nameplate Data Attachment."

Please identify any equipment and systems not specifically identified in the Equipment Nameplate Data

Attachment so that we can include it in our our bid. A definable scope is necessary for a Firm Fixed

Price bid.

The Equipment Nameplate Data list adequately covers the Preventative Maintenance that will be required for this contract.
