Questions & Answers H92222-10-R-0018

TCCC

1. Electronic medical equipment is part of the Transport kit (except portable suction which is part of Sustainment kit, see Performance Spec para. 4.1.5.2.7…however, the Performance Spec Matrix includes suction under the T-6 module?), which is comprised of six modules below (with accompanying general Performance Spec reference), for which detailed specs are in Annex 1 of the Performance Spec.

It is included in T-6 for mounting purposes, as is all the equipment to be mounted on the litter.

2. Period-of-Performance (POP) to August 2011 to deliver three (3) Product Demonstration Models (PDMs), including refurb and replacement of consumables … so no large procurement for about 18 months. Note, per Page 64, deliveries “Beginning 90 days after receipt of initial order, and every 30 days thereafter” … but if there are only 3 PDMs being delivered, are all due on initial shipment or one every 30 days? Also, the refurb items are delivered “Beginning 30 days after receipt of order” … but this suggests the refurb items are delivered before the PDMs are delivered?

The period of performance for the PDM phase which includes Contract Line Items Numbers (CLINs) 0001 thru 0009 is from time of award NTE August 2011. Award for PMD will be immediately following notification to Offerors of the winning proposals Note; required delivery of 3 PDM's is 90 days after receipt of the delivery order. The Government intends to award a delivery order under the refurbishment CLIN upon completion of each mission scenario testing cycle on an as needed basis. The required delivery schedule for Refurbishment CLN is 30 days after receipt of order (ARO).

3. For CLIN 6 “the contractor will provide qualified field representation for initial kit instruction and training, calibration of equipment, field assessment, and related guidance” … could/should this be subcontracted to suppliers/manufacturers? It’s limited to 4 days and $3,000. Does this include rep travel, or is that covered under CLIN 7?

The Qualified Field Representation can be from the prime or subcontractor. Government communication will be to the prime contractor only. The requirement is for qualified Field Representation.

The Field Representation CLIN 0006 Not To Exceed dollar amount is $3,384.00 per offeror. The contractor may send as many personnel as he/she desires. The Government will only fund up to said amount. The required length of time is Two days for each mission location.

The Travel CLIN 0007 is for travel per diem associated with each mission and contract related travel. The Not To Exceed dollar amount is $90,000.00 per contractor PDM phase.

4. For CLIN 9, CDRLs are not separately priced…so how do we represent their cost?

All costs of CDRL performance should be included in the end item pricing. DoD requires estimates of the prices of data in order to evaluate the cost to the Government of data items in terms of their management, product, or engineering value in order to determine price reasonableness and to evaluate the cost to the Government of data items in terms of their management, product, or engineering value of the estimated data prices. In accordance with DFARS 215.470 the offeror shall provide estimated data prices for each data item set forth on the DD Form 1423 "Contract Data Requirements List."

5. Option 1001 is for 28 kits…does this follow after August 2011? Delivered over what timeframe … one year?

The Contract Line Items are numbered to represent each ordering period of the contract (i.e., Contract Line Item Number (CLIN) 1001 = first ordering period, 2001 = second ordering period, 3001 = third ordering period, etc.). The maximum quantity for each item that may be purchased throughout the life of the contract is depicted in year one, specifically CLINs 1001 through 1023. The maximum quantity will be adjusted at the beginning of each year by taking the balance of what was actually purchased during the previous year and moving it to the current year thus reflecting a revised maximum quantity. For example: CLIN 1001 identifies a maximum quantity of 28. If seven (7) are ordered in ordering period one, CLIN 1001 will be adjusted to reflect the actual quantity of 7ordered in ordering period one and CLIN 2001 will reflect a maximum quantity of 21.

The minimum quantity that shall be purchased at time of contract award is 3 Tactical Combat Casualty Care (TCCC) Casualty Evacuation (CASEVAC) Sets. No order is guaranteed above the stated minimum quantity.

6. Options 1010 through 1015 calls for 81 each of the Transport modules. Does this follow immediately after August 2011? Delivered over what timeframe – one year?

No, the total maximum order quantity of 81 for the transport module CLIN will be ordered over the life of the contract. The required delivery schedule for Transport Module CLINs are 90 days after receipt of order (ARO).

7. Option 1019 is “qualified field representation for kit instruction and training, calibration of equipment, field assessment and related guidance”… could/should this be subcontracted to the supplier/manufacturer?

Yes, the Field Representation can be from the prime or subcontractor.

It’s limited to $80,000 for Ordering Period One … when is this period?

Ordering period One begin after the conclusion of the PDM Phase. Note: The $80,000.00 is for the life of the contract.

How long is this period – one year?

The ordering period is one year And like CLIN 6, is there a limit to the number of days?

The PDM phase is limited to 2 days each mission scenario. There is no limit on the number of days during remaining Production periods of the contract.

Does this include rep’s travel, or is that part of CLIN 1020?

No, this does not include travel.

Also, it says, “Maximum amount is for the life of the contract”… does that mean for the option contract? For Ordering Period One?

Yes, the maximum amount is for the life of the contract

8. Option 1020 is Travel, and is limited to $45,000 for Ordering Period One. Also, it says “Maximum amount is for the life of the contract” … does that mean for the option contract? For Ordering Period One?

The first ordering period has the maximum not to exceed dollars amount $45,000.00 listed for the life of the contract. As orders are placed the maximum not to exceed dollar amounts will be deducted from the maximum listed. Orders will be executed when required Travel is needed. This CLIN has four (4), 12 months concurrent ordering periods.

9. Option 1021 is for ECPs and is limited to $1,000,000 for Ordering Period One. Also, it says “Maximum amount is for the life of the contract” … does that mean for the option contract? For Ordering Period One?

The first ordering period has the maximum not to exceed dollars amount $1,000,000.00 listed for the life of the contract. As orders are placed the maximum not to exceed dollar amounts will be deducted from the maximum listed. Orders will be executed when required changes are approved. Engineering Change proposal will be submitted for evaluation, approval, negotiation, and execution.

10. Option 1022 is for spares and is limited to $5,900,000. Also, it says “Maximum amount is for the life of the contract” … does that mean for the option contract? For Ordering Period One?

The first ordering period has the maximum not to exceed dollars amount $5,900,000.00 listed for the life of the contract. As orders are placed the maximum not to exceed dollar amounts will be deducted from the maximum listed. Orders will be issued when required Parts are needed.

11. Option 1023 is for CDRLs and is not separately priced. Like CLIN 9, how do we represent their cost?

All costs of CDRL performance should be included in the end item pricing. DoD requires estimates of the prices of data in order to evaluate the cost to the Government of data items in terms of their management, product, or engineering value in order to determine price reasonableness and to evaluate the cost to the Government of data items in terms of their management, product, or engineering value of the estimated data prices. In accordance with DFARS 215.470 the offeror shall provide estimated data prices for each data item set forth on the DD Form 1423 "Contract Data Requirements List."

12. All of the items are repeated in Ordering Period Two, Three and Four, but without quantities identified nor dollar limits specified. How long is each period (the Synopsis suggests 1 year), and when will the quantities/dollar limits be defined such that an adequate proposal can be generated? Page 85 indicates this is an Indefinite Quantity type contract. Page 86 indicates it won’t exceed 5 years. Page 98 para. 1 says it will be IDIQ.

The contract has four (4) 12 month concurrent ordering periods. Reminder PDM phase will not exceed August 2011.

To propose out year CLINs review 2.3.6, Total Evaluated Price (TEP) maximum quantities Chart. The chart lists estimated year quantities orders. These quantities are to be used for pricing the out years.

13. It appears from Para. 8.0 product(s) will require NSNs. If we do not have them yet, will SOCOM assist in acquiring them?

National Stock Numbers will be assigned by the Government.

14. Why does Page 66 replicate the delivery schedule immediately prior, but without any dates?

Federal Acquisition Regulation Clause 52.211-8, Schedule, lists the Government’s required delivery schedule. The Offeror can propose an alternative delivery schedule that is more advantageous to the Government following the format of the delivery schedule in the second schedule.

15. Page 73 para. 1.1.8 says P&Ds must have a shelf life of 24 months … what’s a P&D?

P's and D's are Potency and Dated Items.

16. Statement of Objectives (SOO) - Note para 1 clearly states a spiral development program, and 3.2.1.3 says the purpose is to get the kit closer to the objective requirements.

Medical equipment changes and evolves in implementation and relevancy every 18 months. Once the government has baselined the required equipment, it will be up to the Program Management Office and Integrator to advance the capabilities within the CASEVAC Set to meet all required objectives. Changes will be conducted thru the ECP process, evaluated and assessed against the requirement and current /projected resources. A determination will be made at that time to implement the change. .

17. Para. 3.1.3 indicates the Integrator can remain as an observer during the eval … could this include IMS?

If, IMS is the Integrator selected for evaluation? Yes, the contractor can observe the kit provided being utilized in the field at its own expense.

18. Para. 3.1.3 says the eval is Nov 2010 to March 2011, but the draft RFP says the POP runs through August 2011?

The estimated testing missions are scheduled between Nov 2010 and March 2011. Upon completion of testing, a down-select decision will be made to carry one contractor forward to production through the exercise of contract options. Offerors receiving an award for the PDM Phase will be permitted to submit a revised technical proposal, performance information, and revised pricing upon notification of consideration for award of the production requirements. The revised proposals will be evaluated by the Government against the evaluation criteria listed in Section H Production Down-Select Criteria of the Solicitation.

The PDM period of performance is scheduled not to exceed August 2011.

19. Para. 4.0 says we need, among other things, AWR and a training video whereas the Performance Spec para 4.1.1.2.3 says they prefer an interactive training CD? Which is correct?

The solicitation response will include the development of an interactive CD, to be developed with the PMO and User community to detail the proper implementation and safety required when using/operating components of this Set. It will cover safety, use, care and general maintenance.

20. Para. 4.2.6 covers warranty, but does not mandate a warranty period?

Normal commercial warranty applies to commercially available equipment. Identify items and provide duration of the commercial warranty.

21. Can we get a copy of the Capabilities Production Document (identified in the header for column 3)?

The Capability Production Document (CPD) is not available for view. The Government’s requirements are detailed in the solicitation.

22. This matrix includes more specs than in the Performance Spec document.

The Matrix is derived from the Key Performance Attributes and is to be used as a guide for evaluators to ensure offeror proposal has met all desired performance requirements as specified in the Performance Specification, the Statement of Work.

23. A few questions specific to the application of the Berry Amendment and the Buy American Act: Because my understanding of the kit is that it will be used for a location outside of the US in support of combat operations and seemingly for emergency situations and activities outside of the US for US personnel, am I correct that the kits fall under the exception category regarding the application of the Berry Amendment that the Berry Amendment does not apply to emergency acquisitions by, or for, activities located outside the United States for personnel of those activities?

No. The TCCC requirement doesn’t fail under any of the exceptions to the Berry Amendment.

Additionally, my understanding of COTS as defined by DFAR is as follows:

(a) any item of supply that is (i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101); (ii) sold in substantial quantities in the commercial marketplace; and (iii) offered to the Government, without modification, in the same form in which it is sold in the commercial marketplace. COTS items do not include bulk cargo, as defined in section 3 of the Shipping Act of 1984 (46 U.S.C. App. 1702), such as agricultural products and petroleum products.

Could you please explain the context of the "Commercial Off-The-Shelf" reference in the TCCC synopsis referenced below for your convenience?

The current Synopsis doesn’t reference COTs.

However, the extent to which individual programs will use commercial items will vary. Some programs will integrate a few commercial items within a largely custom-built DoD system. Other programs will find a commercial item from a single vendor that can largely replace a custom DoD system. Still other programs will build systems that are integrated from multiple commercial items purchased from different vendors. The TCCC intends to use commercial items as build systems that are integrated from multiple commercial items purchased from a prime integrator.

24. Is this solicitation subject to any trade agreements?

No. This solicitation is a Small Business Set-A-Side and it is not subject to any Trade Agreements. Reference, FAR 25.401 Exceptions.

25. Provide clarification for 4.1.3.3.6 “The M-2 Module shall have the capability to carry additional initial TCCC medical supplies to include TCCC Form One (US Army Medical Material Agency provided) 1.” Could you please provide the description to be provided by USAMMA for TCCC Form One referred to in footnote 1?

This is the TCCC Combat Casualty Card and is added to every Individual First Aid Kit by SOFSA. The exact card contents are in flux as the Rangers have their own card. Because of this uncertainty, the government is not asking this item to be vendor provided.

33. Section Title/Name: Section I Contract Clauses, Page #: 77 of 109, Paragraph #: 252.225-7012

My understanding of the kit is that it will be used for location(s) outside of the US in support of combat operations and seemingly for emergency situations and activities outside of the US for US personnel.

Will the kits fall under the exception category regarding the application of the Berry Amendment that the Berry Amendment does not apply to emergency acquisitions by, or for, activities located outside the United States for personnel of those activities?

There are no exceptions under DFARS 225.7002-2 Exceptions that are known to apply to this procurement. If an offeror believes that an exception applies, this shall be noted in the offeror’s proposal as an exception to the application of DFARS 252.225-7012, for consideration by the Government. Offerors are cautioned that absent the application of an exception, an offeror’s proposal that does not comply with the requirements of 252.225-7012 may not be considered for award.

34. Section Title/Name: Section I Contract Clauses, Page #: 77 of 109, Paragraph #: 52.244-6

My understanding of COTS, as defined by DFAR, is any item of supply that is:

(i) a commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) sold in substantial quantities in the commercial marketplace; and

(iii) offered to the Government, without modification, in the same form in which it is sold in the commercial marketplace.

NSN related questions:

How does NSN assignment work relative to the TCCC program?

Government will assign NSNs Are NSN’s assigned at the kit level or the kit-component level?

Both At what point in the process are the NSN’s assigned?

NSN’s will be assigned after the production award.

35. Section Title/Name: 2.1 Technical Area Proposal, Page #: 99 of 109, Paragraph #: 2.1.1 Factor 1: Technical Proposal

The Offeror’s submission shall include a Statement of Work (SOW). The Statement of Work (SOW) shall include but not be limited to detailed tasks, requirements, and discussion regarding the items in paragraphs 2.1.1.1 thru 2.1.1.4: (1) Operational Effectiveness and Suitability Potential, (2) SOW and Specification Compliance, (3) Contents and Sustainability of the Set, and (4) Modularity and Compatibility with current and evolving Special Operations Forces (SOF) Equipment and Platforms.

Will the Government consider allowing contractors to place the SOW in an Annex that does not count against the page limit?

This document shall be included on disc 2 / Technical and Management. The page count remains 100.

36. Section Title/Name: Section B – Supplies or Services and Prices, Page #: 3-6 of 109, Paragraph #: Item 0002, 0003, 0004 and 0005 Kit Refurbishment

Replenishment/Refurbishment: During testing and employment of the Casualty Evacuation Kit, much of the equipment will be consumed, fail, or break during the testing events and will require replenishment prior to the next test phase. IAW the Statement of Objectives (SOO), the Government will return each Kit to the contractor for refurbishment and replacement of consumables, and replacement of failed/broken items.

Will kit damage, breakage, or rapid consumption be a negative factor during kit evaluation?

The kit will be used in scenarios that best represent actual combat rescue missions in different environments. The kits will be assessed on how well they perform in those environments and if an item fails during its intended use, then yes, it will impact negatively. Consumption is identified thru this process and weighed against resources, is it acceptable or expected, or does the item not meet threshold requirements. The contractor may have the opportunity to replace an item at no cost to the government.

37. Section Title/Name: General Question, Page #: No Reference Page, Paragraph #: No Reference Paragraph. Will there be efforts to convert this from a SOCOM requirement to an Army/Division/BCT requirement?

At this time TCCC is a SOCOM specific requirement. At anytime SOF equipment can become service upon service adoption.

38. Section Title/Name: General Question, Page #: No Reference Page, Paragraph #: No Reference Paragraph. Are contractors only allowed 1 Field Representative?

Offerors can provide as many qualified personnel Field Representatives they feel the need too. The NTE amount is listed in the contract. Under this contract the amount listed will not be exceeded. Any amount over the limit will be at the contractor’s expense.

39. Section Title/Name: General Question, Page #: No Reference Page, Paragraph #: No Reference Paragraph. Must it be the same individual for all evaluations?

Contract requirement states qualified Field Representation. For consistency, no start and restart, the Government’s preference is for same personnel throughout.

40. Section Title/Name: Section B – Supplies or Services and Prices, Page #: 3-6 of 109, Paragraph #: Item 0002, 0003, 0004 and 0005 Kit Refurbishment

Replenishment/Refurbishment: During testing and employment of the Casualty Evacuation Kit, much of the equipment will be consumed, fail or break during the testing events and will require replenishment prior to the next test phase. IAW the Statement of Objectives (SOO), the Government will return each Kit to the contractor for refurbishment and replacement of consumables, and replacement of failed/broken items.

Can we expect certain consumables will already have service familiarity and not be evaluated or used? (Combat Gauze, Chest Seals, etc.)

All items proposed will be evaluated.

41. Are Small Business primes allowed to contract with a large business for amount smaller than 51% of the contract?

Yes, a Small Business may team with a large business provided they comply with FAR 52.219-14 Limitations on Subcontracting. On a Small Business Set-A-Side for Supplies (other than procurement from a nonmanufacturer of such supplies). The concern shall perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials.

42. Section Title/Name: 2.1 Technical Area Proposal, Page #: 101 of 108, Paragraph #: 2.1.1 Factor 1: Technical Proposal

Is the Government saying that the Performance Matrix (attachment #4) is to be included in the Statement of Work? If the answer is yes, please refer to Questions #1 and #10 from our 4/20/2010 questions submission.

No. The Performance is stand alone document to be submitted in the Technical Proposal Disc 2.

“The Technical proposal will also include the packed weight and cube of each module, digital breakdown of the kit, components and a spec sheet for each individual item offered. (The Digital Catalogue does not count against the proposal page count).”

Does the Government mean that all of the specific items (packed weight, cube, components and specification sheets) in the above sentence are to be placed in the Digital Catalogue?

Yes. The Technical proposal will also include the packed weight and cube of each module, digital breakdown of the kit, components and a spec sheet for each individual item offered.

44.Section Title/Name: 2.2 Past Performance Area Proposal, Page #: 102 of 108, Paragraph #: 2.2.1

If a contractor does not provide information on “problems encountered” and “corrective actions” on past performance citations will they receive a “higher risk” score in the Past Performance Area?

IAW FAR 15.305 Proposal evaluation.

The solicitation shall also authorize offerors to provide information on problems encountered on the identified contracts and the offeror's corrective actions. The Government shall consider this information, as well as information obtained from any other sources, when evaluating the offeror's past performance. The source selection authority shall determine the relevance of similar past performance information.

45.Section Title/Name: 2.3 Price Area Proposal, Page #: 106 of 108, Paragraph #: 2.3.2

Where and/or how would the Government like contractors to provide estimates of the prices of data?

All pricing information shall be submitted in the price proposal/CD (Disc 1) only. The data information is basically the offeror basis of estimates that support its cost proposal. The Data element of cost should be explained in one of the Basis of Estimate supporting documents. The Offeror must have a consistent practice for all cost estimates and accumulation of actual cost.

What detail does the Government expect in these estimates of the prices of data?

The information should contain a breakdown of how the cost is derived.

46. QUESTION: Because of the placement of the semi-colons in this paragraph we are unclear as to exactly what you are requiring. Specifically, how many different types of items are you requesting and what are each of their desired characteristics?

The requirement is comprehensive...subject headlamp must have all capabilities listed

47. Reference Attachment 1, para. 4.1.4.7.3 – this paragraph states “…The device shall mount anywhere on a standard NATO litter and be capable of holding portable medical equipment, including a ventilator, suction, monitor, infusion pump, power supply and steel and carbon-fiber oxygen cylinders. Electronic Casualty Cards or Personal Digital Assistant (PDA’s) can be ruggedized wireless handheld computers capable of recording an injured soldier’s name, vital statistics, and the initial medical treatment to be quickly transmitted to follow-on casualty care providers.”

QUESTION: Is this paragraph requesting we provide Electronic Casualty Cards or PDA’s?

Or is it only providing us with a description of the Electronic Casualty Cards or PDA’s so that we ensure our mounting device is capable of holding them?

Yes, the Government is requesting the Offeror provide Electronic Casualty Card or PDA.
