In lieu of submitting the full text of those provisions, the offeror may identify the provision by paragraph identifier and provide the appropriate information with its quotation or offer. SECTION 00110 – PROPOSAL PREPARATION

1.1 OVERVIEW

Those offerors short-listed in Phase One are invited to submit a Phase Two proposal, as indicated below. The Government will evaluate the Phase Two proposals in accordance with the evaluation criteria described herein, using the evaluation rating systems outlined below. Price information will be evaluated for fairness, reasonableness, and for material unbalancing, as described herein. The Phase Two evaluation will be conducted in accordance with FAR Part 15.

1.2 BASIS OF AWARD

The Contracting Officer will award one firm fixed-price contract to that responsible Phase Two Offeror whose proposal the Source Selection Authority determines conforms to the solicitation, is fair and reasonable, and offers the best overall value to the Government, considering the price and non-price factors described herein. All evaluation factors, other than price, when combined, are considered significantly more important than the price. However, the importance of price will increase if Offerer’s non-pricing proposal factors are considered essentially equal in terms of quality/technical merit or if the price is so high or low as to significantly diminsh the value of a proposal’s technical superiority to the government. After the Government individually evaluates and rates each proposal, the Contracting Officer/Source Selection Authority will compare proposals to determine which proposal represents the best value. The Government reserves the right to accept other than the lowest priced offer or to reject all offers. If there is a lower priced, conforming offer(s), the Contracting Officer/Source Selection Official must determine that the added value of a more expensive proposal would justify award to that Offeror.

As part of the evaluation, the Government will evaluate betterments in proposals relative to the minimum standards in the RFP to determine if they offer additional value to the Government. In addition, innovations in proposals will be evaluated to determine if creative ideas of the Offeror are a better value to the Government compared to the minimum criteria.

2.0 GENERAL PROPOSAL PREPARATION INSTRUCTIONS

2.1 Offerors are advised that the following proposal preparation instructions are applicable to Phase Two RFP requirements.

2.1.2 Copies of the solicitation will be available only to short-listed firms. Phase Two is an all-electronic solicitation release including amendments. All documents will be posted on two electronic websites and will require permission prior to access.

You must notify the Contracting Officer of the individual who shall be the point of contact for access to the websites. Only one individual from your firm will be granted access to both FBO and a secondary secured SharePoint technical data site.

The designated individual must complete a Sensitive But Unclassified (SBU) Form and return to the Contracting Officer prior to requesting access to either website. Access to either site will not be granted until a signed SBU form has been submitted to the Contracting Officer. Hard copies will not be made available.

2.1.2.1 Federal Business Opportunities (www.fbo.gov): The RFP ("front end") and any associated amendments will be posted to the Federal Business Opportunities (FBO) website at: www.fbo.gov using the “non-FBO” (formerly “Federal Technical Data Solutions (FedTeDs)) application. Access to the Phase Two documents posted to FBO will be restricted. As a result, you will be required to register at the FBO website using the “non-FBO” functionality and request access (through the site) to the documents prior to accessing/downloading the Phase Two RFP package. The Contracting Officer will grant access to the individual indicated on the SBU document only. Once permission is granted, the designated individual will be able to access the RFP documents on the FBO website.

2.1.2.2 Secured SharePoint Site: The designated individual will be granted access to a secondary technical data (SharePoint) website where additional technical documents that supplement the RFP can be downloaded. Instructions on accessing the secured SharePoint site and unique log on credentials will be provided separate from the FBO access by the Contracting Officer's Representative (secured website owner) after approval of the completed SBU document.

2.1.3 This solicitation does not commit the Government to pay any costs incurred in the preparation and submission of the initial and any subsequent proposals or for any costs incurred prior to execution of a formal contract. Stipends for proposal costs incurred during Phase Two shall not be paid by the Government.

2.1.4 PRE-PROPOSAL MEETING/SITE VISIT: A pre-proposal meeting/site visit will be conducted with the owner (and other stakeholders) at the Federal Center South Campus, Seattle, Washington, individually with each firm invited to participate during Phase Two. The Contracting Officer will arrange the site visits individually with each firm. It is anticipated that the Phase 2, pre-proposal meetings will be scheduled for the week of December 14 – 18, 2009 and will last approximately 3 hours. This meeting will provide an informal venue for the selection committee to share their vision of the facility, allow for an in-depth site visit and conduct a questions and answers session.

2.1.5 POST PRE-PROPOSAL MEETING/SITE VISIT QUESTIONS: Questions and Answers raised during the pre-proposal meeting/site visit will be documented and posted on the FBO website via Amendment at the conclusion of all meetings. Additional questions post meeting shall be submitted in writing to the Contracting Officer (dawn.ashton@gsa.gov) with copy to the Project Manager Duane Allen (duane.allen@gsa.gov) within five (5) workdays following the pre-proposal meeting/site visit. Offerors shall submit all other inquires related to this RFP in writing to the CO with a copy to the PM.

This solicitation will remain unchanged unless it is specifically amended in writing. All amendments will be posted to the FBO website. If an amendment is issued, an offeror will be required to acknowledge the amendment by completing Block 19, on the SF 1442.

Notice to Offerors: Offerors are encouraged to submit all general questions and requests for clarification no less than 10 days prior to the RFP closing date. The decision whether to respond to questions and requests for clarifications made after that date shall be at the sole discretion of the Contracting Officer.

2.1.6 Proposal must be complete, self-sufficient, and respond directly to the requirements of this solicitation. Any commitments made in the proposal may become a part of the resultant contract.

3.0 PROPOSAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS:

3.1 Mandatory Responsibility Requirements: Proposal shall conform to the requirements of the Request For Proposals (RFP), including, but not limited to: (1) Completed Reps and Certs verified on-line (https://orca.bpn.gov/) and current CCR Registration, and (2) Completed Bid Guarantee as required in Block 13(B) of the SF1442 and FAR Clause 52.228-1 in Section 00700. Offerors not meeting all of the minimum responsibility criteria may be eliminated from further consideration.

The Contracting Officer will make the determination as to offer responsiveness, and submit only those offers deemed responsive to the Source Selection Evaluation Board (SSEB) for full evaluation.

3.2 PHASE TWO EVALUATION FACTORS: Phase Two proposals will be evaluated as set forth in the Request for Proposals (RFP). All responsive proposals shall be evaluated and rated against the following price and non-price factors from which the SSA (CO) will make a best value source selection determination:

Factor 1: Design Solution (preliminary concept) Factor 2: Project Management Plan Factor 3: Phase I Overall Proposal Rating Factor 4: Price

The Phase Two Evaluation Factors are listed in descending order of importance. Factor 1 is significantly more important than Factor 2. Factor 2 is significantly more important than Factor 3. While price is an important consideration, all non-price evaluation factors when combined are significantly more important than price. However, as proposals become more equal in their technical merit (as determined by the evaluation of the non-price evaluation factors set forth below), the evaluated price becomes more important and may become the determining factor for award. See below for detailed evaluation factor and rating criteria information.

Instead, the SSEB will include the overall technical rating assigned during Phase One for each Offeror submitting a proposal in Phase Two. The overall Phase One rating will be used in determining the overall Phase Two rating when reviewing non-price factors.

3.2.4 FACTOR 4 – PRICE.

Offerors shall submit a complete price proposal in the provided format at Exhibit 1. Price will not be rated or scored, but will be evaluated for fairness and reasonableness through the use of a price analysis. Offerors are cautioned to distribute direct costs, such as material, labor, equipment, subcontracts, etc. and to evenly distribute indirect costs, such as job overhead, home office overhead, bond, etc., to the appropriate contract line items. Both parties shall presume that field overhead costs through the proposed contract duration are inclusive in the offered price for the contract. As price is an indicator that the Offeror understands the scope and level of effort, price will be evaluated for reasonableness and used in performing the best value trade off decision. The Government may use various price analysis techniques and procedures to determine price reasonableness.

3.2.5 SUBCONTRACTING PLAN (NOTE: This Requirement applies to Large Business Offerors only.)

If the Offeror is a large business concern, in accordance with the definition as identified in FAR Clause 52.219-1, “SMALL BUSINESS PROGRAM REPRESENTATION,” the firm must submit a small business subcontracting plan in accordance with FAR Clause 52.219-9 SMALL BUSINESS SUBCONTRACTING PLAN (Sep 2007), ALTERNATE II (Oct 2001).

If practical, the Offeror shall provide specific information on proposed subcontracted effort for this project and submit the firm’s subcontracting compliance on previous projects completed or underway within the past three years of the date of this solicitation. This requirement may be supported by using copies of the U.S. Government Standard Form 295.

While this is not an evaluation factor for Phase Two as described above, the Government will evaluate the Plan in accordance with the requirements of FAR Clause 52.219-9 Alternate II and will assign a GO/NO-GO rating. To be acceptable (“GO” rating), subcontracting plans must:

a. Adequately address the required statutory elements.

b. Provide sufficient information to enable the CO to accept the plan.

c. Those areas where the plan is deficient will be reviewed with the Offeror with the goal of correcting deficiencies.

d. As part of the evaluation, the Government will compare the small business subcontracting opportunities in the plan with the goals established in the solicitation with additional consideration given for a proposed subcontracting plan that exceeds the goals established in this solicitation. The Government will review the plan for specific proposed subcontracting opportunities for the Small Business Community (Small Business (SB), Small Disadvantaged Business (SDB), Woman-Owned Small Business (WOSB), HUBZone Business (HUBZone), and Service-Disabled Veteran-Owned Small Business (SDVOSB)).

(a)(1) The Offeror certifies, to the best of its knowledge and belief, that—

(i) The Offeror and/or any of its Principals—

(A) Are ( ) are not ( ) presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(D) Have ( ), have not ( ), within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed.

A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples.

(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement…
