About this file
This is a Proposal Bond form for RFP 26-0082MC issued by the Lee County Port Authority in Florida. The bond requirement applies to proposals submitted for the Aircraft Rescue and Fire Fighting (ARFF) F3 Foam Transition project, which involves transitioning ARFF vehicles and equipment from aqueous film-forming foam (AFFF) to synthetic fluorine-free foam (SFFF) at two stations: Station 91 at Page Field (FMY) and Station 92 at Southwest Florida International Airport (RSW). The scope includes removal of AFFF storage tanks and associated piping, draining and removal of AFFF from seven ARFF vehicles, cleaning and rinsing of foam tanks and appurtenances, FAA-required testing of ARFF vehicles with SFFF, and disposal of waste materials including AFFF concentrate, rinsate, and bulk items from tanks and piping.
The proposal bond must be submitted by the Principal (bidder) and a surety corporation licensed to do business in the State of Florida. The successful proposer must provide an acceptable Performance and Payment Bond and other insurance as required by the Authority within ten calendar days from the issuance of the Notice of Intent to Award. The surety's liability is limited to the penal sum of the bond plus expenses and reasonable attorney's fees incurred by the Port Authority. If the bidder fails to execute the contract or provide required bonds and insurance within the specified timeframe, the surety must pay the difference between the proposal amount and any higher cost to the Authority for engaging another contractor, along with associated expenses and legal fees.
