1.0 SCOPE

The Contract Data Requirements List (CDRL) establishes the data to be delivered by the Contractor, including the submittal, approval and distribution requirements. This document provides instructions and clarifications which apply to all the CDRLs within the applicable contract, unless otherwise noted. CDRLs are accomplished on DD Form 1423-1.

2.0 GENERAL

The Data Item Descriptions (DIDs) specified in Block 4 of the CDRLs are available electronically at the Acquisition Streamlining and Standardization Information System (ASSIST) database website: http://quicksearch.dla.mil/.

3.0 DATA DELIVERABLES

3.1 Delivery Dates

Unless otherwise specified in Block 16 of the CDRL, all references to “days” will refer to calendar days. The data must be delivered by 2359 (11:59 pm) Central Time on the due date to be counted as on-time.

If a CDRL delivery date falls on a Saturday, the submittal must be delivered on the Friday prior to the Saturday delivery date.

If the CDRL delivery falls on a Sunday, the submittal must be delivered on the Monday following the Sunday delivery date.

If the CDRL delivery falls on a holiday, the submittal must be delivered on the day before the holiday.

Early CDRL delivery is permitted. The contractor must notify the Government of late CDRL deliveries.

3.2 Tailored Data Items

Tailoring of a DID will be reflected with a “/T” following the DID number in Block 4 of the DD1423. Tailoring instructions, when applicable, are described in Block 16 of each CDRL. If the data preparation instructions contained in Block 16 of the CDRL are different than the instructions contained in the DID, the CDRL shall govern.

3.3 Data Submittal Approvals

An "A" designator in Block 8 of the CDRL indicates the Government will formally reply to each data submittal with either: Approval, Rework, or Rejection.

The Government will Reject or request Rework of a data delivery if it is determined to be incomplete or inadequate to the point where a comprehensive review cannot occur.

http://quicksearch.dla.mil/

The Government will Reject or request Rework of a data delivery if, after a thorough review, it is determined it has not met DID requirements or the document is found not acceptable.

The contractor will formally respond to the Government within thirty (30) calendar days after receipt of any data that is disapproved and sent back for Rework, unless otherwise specified on the CDRL.

The Government non-response beyond forty-five (45) calendar days does not constitute approval. If approvals are required, the Contractor will be alerted to the Government response via the Lifecycle Management Process-Integrated Data Environment (LCMP- IDE) application or USG approved alternative application.

Any Engineering Change Proposals (ECP) or Contract Change Proposal (CCP) will be reviewed and briefed to the Government Configuration Control Board (CCB) for disposition.

If Block 8 contains an "N/A", Government approval of the content is not required;

however, compliance with data item format and content requirements, as specified in the DID, and as tailored in Block 16 of the CDRL, is mandatory. The government will not provide a formal response back to the contractor; however, the Government retains the right to disapprove any data submittal(s) not in compliance requirements of the contract, the DID, or the CDRL.

Data submittal requirements shall not be considered to have been met until the procuring agency has determined that all contractual requirements have been met regarding the identified data.

Draft submittals are not approval items. The contractor shall formally submit draft data item(s) (when required by the 1423-1) for review and shall mark them as “draft.” Draft submissions shall not alter the due date of first formal submission as specified in the

CDRL.

The Contractor is legally obligated to meet these requirements because the CDRL is a contractual document and, as such, is, therefore, binding in and of itself.

3.4 Resubmittal of Data

If resubmittal of a CDRL is required, it shall be resubmitted within 30 calendar days or less after the notification is received, unless noted in the notification or if noted in Block 16 of the CDRL. Should the Contractor disagree with the proposed resubmittal requirements, it shall submit its comments to the CO within 30 calendar days of notification.

Each page of a resubmittal shall have changes indicated by a vertical line down the outer right margin to designate any areas of the document (including figures and tables) that have been revised.

ELDER, STACEY C CIV USAF AFMC AFLCMC/WBNSC

Needs PCO review

The document revision number shall be indicated both on the title page of the data item and in the header of each page of the CDRL as well as any summary section of document changes.

Tracked changes or change bars shall be utilized to obtain Government approval of revised documents; however, final submittal will not contain revision markups.

3.5 Final Submittal of Data

For the final delivery of each data item in the contract/delivery order, the Contractor shall clearly state in its Letter of Transmittal (LT) that the last submittal is being made and that all contractual requirements concerning that data item have been fulfilled.

The proper format and required information for the Contractor’s LTs is covered in Section 5 below.

3.6 DD Form 250, Material Inspection and Receiving Report - Requirements Block 7 of the CDRL directs the method of submittal. Individual DD Form 250s are required only if indicated in Block 7. All other submittals shall be accompanied by a LT.

3.7 Classified Data

Any CDRL delivery containing classified data shall be submitted in accordance with the requirements established by the Contractor’s DD Form 254, Contract Security Classification Specification. The Contractor shall contact the CO for appropriate mailing addresses for classified data.

3.8 Modification of Data Requirements

During the performance of this contract, the CO may unilaterally increase or decrease the number of addressees and/or number of copies the T-6 Program Office requires. The CO may unilaterally make other administrative or clarification changes to the CDRL.

Any amendment to the number of copies shall be made at no change in contract price, provided the increase for an individual line item of data is not greater than 150 percent nor a decrease of less than 50 percent in the total number of copies initially specified in the CDRL. In the event of an increase greater than 150 percent or of a decrease greater than 50 percent, the parties will negotiate any equitable adjustment in accordance with the procedures of the “Changes” clause (FAR 52.243-1).

The CO may unilaterally make other administrative and/or clarification changes to the CDRLs. The contract price will constitute full satisfaction of any entitlement of equitable adjustment under the “Changes” clause (FAR 52.243-1), provided the Contractor agrees to accept such change at no change in contract price. Unilateral action shall be by the issuance of a CO's letter, which will reference this paragraph as its authority. The Contractor shall notify the CO of the estimated cost if the changes impact the contract price.

4.0 ELECTRONIC DATA TRANSMISSION

4.1 Submission

The Contractor shall submit electronic versions of all data deliverables in accordance with Block 14 of the individual DD 1423 forms, unless specified differently in Block

16. Any submittals by other means shall require T-6 Program Office approval prior to delivery of data.

The Contractor shall electronically deliver all contractual data using the Lifecycle Management Process-Integrated Data Environment (LCMP-IDE) application or USG approved alternative application. The Contractor shall ensure that at least two

(2) Contractor personnel have LCMP-IDE access throughout the period of performance. The Contractor shall complete LCMP-IDE training required by the

USG.

4.2 Alternative Delivery Formats

The Contractor shall inform the T-6 Program Office if any of their data deliverables cannot comply with the required electronic formats. In such cases the Contractor shall recommend, for Program Office approval, an alternative delivery format(s). A request for an alternative delivery format should not be considered an automatic approval for a late delivery of the data.

4.3 Financial Information Format

Any financial information provided in an MS Excel spreadsheet shall not be locked or password protected and be able to be manipulated.

5.0 LETTERS OF TRANSMITTAL (LT)

All data deliveries shall include a LT. The LT may be in the form of a letter or e-mail from the designated contractor representative. At a minimum, the LT shall contain:

• Contractor Point of Contact (POC)

• Contractor address

• Date

• Contract number and program name

• Letter control number

• Document control number

• Document revision level

• Document date

• CDRL sequence number

• DID Number

• Data Title/Subtitle

• Reason or frequency of submittal (monthly, draft, final, update, etc.)

• List of distribution addressees as identified in Block 14 of the CDRL

If a paper copy of the LT is prepared, a complete list of addressees shall be placed at the end of the LT, annotating the recipients (as identified on the DD Forms 1423-1, Block

14) including the transmittal-letter-only recipients.

7.0 MARKING DOCUMENTATION

7.1 Marking Technical Documentation

The contractor shall mark technical information as instructed by the Government program office. Some examples of technical information include research and engineering data, technical reports, blueprints, drawings, technical orders, technical manuals, plans, instructions, catalog-item identifications, process sheets, data sets, models, studies and analyses and related information, computer software, film, technical papers, and photographs.

7.1.1 Distribution Statement

A DoD distribution marking system for technical data is prescribed in DoD Instruction 5230.24, “Distribution Statements on Technical Documents.” The intent of the system is to identify the audience approved for secondary distribution of the data in order to stem the flow of military-related technical data to our adversaries, without inhibiting technological growth or appropriate exchange of technical data that is vital to progress and innovation. These markings are in addition to any security classification or other control markings.

Required distribution statements have been annotated in Block 9 of each CDRL and are defined in paragraph 8.2 below. If the Contractor feels a different statement is required, the Contractor must notify the CO with its recommended distribution statement. The Government will review the request, determine which statement is the most appropriate, and provide the Contractor with either an acceptance of its proposed change or the Government’s reason for not accepting the Contractor’s request for change.

Certain types of technical data preclude placing the entire notice on the document.

Abbreviated distribution statements must be approved by the program office and are to be used only when space precludes placing the entire statement on the document.

Wording for the distribution statements is shown below. The acceptable “reason(s)” for the distribution statements must be chosen from those listed in DoDI 5230.24. The following address will be used on all documentation for the “controlling DoD office” for this program:

AFLCMC/WLD

LEGACY TRAINING AIRCRAFT DIVISION

5316 S DOUGLAS BLVD., BUILDING 8400

OKLAHOMA CITY, OK 73150

Other requests for this document shall be referred to (insert controlling DoD office).

DISTRIBUTION STATEMENT D: (Secondary [optional]) Distribution authorized to the Department of Defense and U.S. DoD contractors only (fill in reason) (date of contract award). Other requests for this document shall be referred to (insert controlling DoD office).

DISTRIBUTION STATEMENT E: (Secondary [optional]) Distribution authorized to DoD Components only (fill in reason) (date of contract award). Other requests for this document shall be referred to (insert controlling DoD office).

DISTRIBUTION STATEMENT F: Further dissemination only as directed by (insert controlling DoD office) (date of contract award)) or higher DoD authority.

DFARS Subparts 227.71 and 227.72 stipulate control procedures for contractor controlled technical information in which the Government has limited rights. These procedures shall be followed as described in DoDI 5230.24.

7.1.2 Export Control Warning

Authority to withhold and control the export of certain technical data with military or space application is determined in accordance with Title 10, United States Code section 130, “Authority to withhold from public disclosure certain technical data,” and implemented by DoDD 5230.25, if such data may not be exported lawfully outside the United States without an approval, authorization, or license under the Export Administration Act of 1979 or the Arms Export Control Act (both cited in the Export Control Warning). Such withholding and export control applies to Defense items listed in the United States Munitions List (USML), (which is part of the “International Traffic in Arms Regulations (ITAR),” -22 CFR 120-130); and 15 CFR 730-774 (the “Export Administration Regulations (EAR)”).

If a technical document, whether printed or electronic/digital, contains export-controlled technical data, it shall be marked with the export control warning statement prescribed in DoDI 5230.24 and shown below. When it is not feasible to use the entire statement, the abbreviated warning may be used, and a copy of the full warning added to the “Notice to Accompany the Dissemination of Export-Controlled Technical Data,” which is Enclosure E5 of DoDD 5230.25. For assistance in determining what is export controlled, consult the controlling DoD office. The warning notice may be used in conjunction with distribution statements B, C, D, E, and F. Distribution statement A, which denotes public release, cannot be used in conjunction with the export-control warning notice.

WARNING - This document contains technical data whose export is restricted by the Arms Export Control Act (Title 22, U.S.C., Sec 2751 et seq.) or the Export Administration Act of 1979 (Title 50, U.S.C. App. 2401, et seq.), as amended.

Violations of these export laws are subject to severe criminal penalties.

Disseminate in accordance with the provisions of DoDD 5230.25.

7.1.3 Destruction Notice

All unclassified technical data marked with distribution statements B, C, D, E or F shall be marked with the following Destruction Notice:

DESTRUCTION NOTICE: Destroy by any method that will prevent disclosure of contents or reconstruction of the document.

Classified data, including classified controlled technical data, shall be handled and destroyed in accordance with the procedures in DoDM 5200.01, Volume 3_AFMAN 16- 1404, Volume 3 and DoDM 5220.22_AFMAN 16-1406 Volume 2.

Destruction Notice for classified technical information:

DESTRUCTION NOTICE: Follow the procedures in DoDM 5200.01, Volume 3_AFMAN 16-1404, Volume 3, Information Security Program: Protection of Classified Information and DoDM 5220.22_AFMAN 16-1406, Volume 2, National Industrial Security Program: Industrial Security Procedures for Government Activities.

7.1.4 Classified information

Documents containing classified information will be marked in accordance with DoDM 5200.01, Volume 2, “DoD Information Security Program: Marking of Information.”

7.1.5 Controlled Unclassified Information (CUI)

Unclassified information associated with a law, regulation, or government-wide policy and identified as needing safeguarding is considered CUI. CUI requires access control, handling, marking, dissemination controls, and other protective measures for safeguarding.
