SABER Questions

1. Will the government provide copy of the Unit Price Book as part of the RFP? And if not can the government provide the exact link for down loading / purchasing the book? The RS means web site contains so many different price books and we need to make sure that we are looking at the correct one. We also were not able to find the exact description stated in the SOW (R.S Means Master File) for the Unit Price book on their web site.

a. The government will not provide a copy of the Unit Price Book as part of the RFP.

b. e4Clicks is a software that uses RS Means, specifically designed for JOC and SABER types of work:

c. https://www.4clicks.com/products-services/software-features/e4clicks-project-estimator/

2. Will the contractor be able to submit different coefficients for the contract's base year and the four option years?

a. No, the contractor must submit a single coefficient for the entirety of the contract.

3. Will the current 2018 RS Means price book be the base for the entire duration of the contract or would it be changed for each calendar year as it gets updated by the developer?

a. The Unit Price Book (RS Means, e4Clicks) will be changed as the developer makes annual updates.

4. Will the Government require the contractor to furnish the pricing software for its personnel?

And if yes how many software licenses would be required for the Government use?

a. No. The contractor will not have to furnish pricing software for U.S. Government personnel. Software will be provided via different means to the USAF.

5. Project Pricing/Estimation: For this seed project(s) and future projects, the method for reaching the total evaluated cost of a project will be determined by using RS Means and then our coefficient applied to it. Is that correct?

i. Yes, that is correct.

a. If so, then the "Localization" coefficient will be neglected and as such can cause losses for the contractor. The reason being that certain "Bare Materials Cost" or "Bare Labor Cost" could be underestimated in RS Means.

ii. The contractor should account for this by incorporating his own area cost factor into his coefficient.

OR

b. Since E4clicks software will be used, does it mean that a local UPB specific to this location will be developed? As such, RS means will only be used as a guide and not indicator for price reasonableness?

i. E4clicks software is to be used. Any locational cost factors should be incorporated into contractor’s coefficient.

6. Are we allowed to provide a range of coefficients depending on the magnitude of the project or just one static coefficient? Ex. for project <500,000 (coefficient A), >500,000 (coefficient B)?

a. Offerors must submit one static coefficient regardless of magnitude of the project.

7. What is maximum allowable coefficient?

a. There is no maximum or minimum allowable coefficient. The offeror shall determine which coefficient is best suited for their company's proposal.

8. The repair of damaged tiles of swimming pool and modification of filter plant of swimming pool.

Need description of the jobs which need to perform. (See questions in attached drawings)

a. All job description information is included in the SOW.

b. Assume 10% of tiles will need replacing.

9. About 5 Open Sheds were visited and asked us to propose a ceiling to stop the resting of pigeons there, by which need to get rid of pigeon droppings and danger of pigeon hitting the aircraft. Need proper job description. (See questions in attached drawings)

a. All job description information is included in the SOW. Further information is detailed on the last page of this Q&A.

10. For firms applying as a Joint Venture, is it enough that both firms are active in SAM individually or shall the JV also be registered in SAM as one entity?

a. For offerors applying as a Joint Venture, it is not required that the JV is registered in SAM as one entity. However, our contract writing system only allows us to award to one CAGE code. Please explain in your joint venture arrangement details which CAGE code the contract should be awarded to in your submission.

11. Please provide updated page count limits for the Technical and Past Performance sections (Volumes I and II). The Past Performance questionnaire is 7 pages long and we are instructed to submit 10 projects, plus the Consent letters, plus any other pertinent Past Performance information relevant to this project. 35 pages will not be sufficient.

a. For the Past Performance (Volume II), the Past Performance Questionnaires (PPQ) and Consent letters will not be counted towards your total page count. Since the PPQ and consent letters do not count to total pages, there should be sufficient pages to explain any other pertinent past performance information.

12. For the Technical volume, 20 pages is not enough to adequately reply to two seed projects.

a. The solicitation has been amended to allow 40 pages to reply to the two seed projects.

13. Please confirm the Government will be providing one, standard RS Means price book to all contractors so we are calculating our coefficient based on the exact same data. Excel, PDF, or hyperlink to online source please.

a. The Government will not provide contractors RS Means price books. Contractors are to obtain RS Means themselves. The link for purchase is provided in question 1(c). RS Means is a standardized source for all divisions of construction costs.

14. Will we be providing one coefficient price for each contract year, or will we be using an updated

RS Means price data base each year to account for price fluctuations / inflation over the life of the contract?

a. Answers to questions #3 and 5.a. detail a response. RS Means updates based off of its own research.

b. The contractor must submit a single coefficient for the entirety of the contract.

15. Would the government provide a second contractor site visit for the 2 seed projects? Due to the RFP tight time constraints, we were unable to travel & attend the scheduled site visit on 19 July 2018.

a. Unfortunately due to strict badging restrictions, we are unable to hold another site visit during the solicitation period.

16. Can a professional bird control fabric mesh with steel guide wires be used in lieu of metal mesh netting?

a. No. Metal mesh netting is the requested material.

17. Will the chiller at the pool need to be replaced? Will the chiller be hooked up to the water?

a. Replacing those 3 large chillers is not part of the SOW, but they will need reconnecting to any new equipment and piping because they are cooling the pool water.

18. What is the power voltage used at the pool?

a. Per Electrical shop: Power feeding the transformer is from the QIT power plant (diesel, UK voltage) and what is feeding B10073 (pump house) is 240 phase-to-ground / 415 phase-to-phase.

19. Are all three motors working at the pool? Are there any standby motors if the other motors fail?

a. Motors=pumps? SOW says 2 normal operating duty and 1 standby.

b. This contract is requesting to have one standby pump (in line) as well an additional pump for repairs after warranty.

Memo / Drawing questions for CC Pool

1. Seed project #1 CC Pool Memorandum

a. Contractor is supposed to give us their design and specs based on what they calculated from pool capacity, required flow/refresh rate, environmental factors, etc.…

b. SOW says the Contractor shall provide us with their calculations justifying the equipment and piping selected for their quote/proposal.

2. Seed Project #1 Drawings

a. As-builts show 5.5 HP pumps but per Plumbing shop they are 7.5 HP existing.

i. Those items are hatched for removal on the demolition plan.

ii. Saline-chlorination unit is an all in one unit, so pumps and equipment should be pre-sized to meet the pool’s requirements based off of the Contractor's calculations of the pool’s capacity, environmental factors, etc.

3. Sheet Keynotes: “DO WE NEED TO REUSE ALL OTHER ITEMS WHICH ARE NOT REMOVED?”

a. Anything not in scope shall not be disturbed. Anything the Contractor has to remove that is not in scope must be returned or restored back to original or better condition.

Including any adjacent areas that are disturbed or damaged.

4. General Electrical Notes: The KTR is supposed to submit to us their proposed designs and specs.

ECES drawings you saw were concept drawings only.

a. Any deviations from final approved designs and specs must be reapproved by ECES an ECONS before constructing.

Drawing questions for Bird Netting

1. Welding will require hot-work permit. Structures are not under warranty, so pending hot-work approval and after a review of KTR drawings to specify what they propose, yes.

Additional Contractor Emails:

SEED 1:

1. May we obtain architectural and structural drawings detailing the dimensions of the pool? Also, any site plan showing the swimming pool and its immediate surroundings would be appreciated as well.

As-builts are 21MB. The Government can AMRDEC the As-Built's as requested. Please submit a request for the as-builts to 379econs.construction@auab.afcent.af.mil and the Government will AMRDEC the files to you.

2. Are there any existing Electrical plans along with the DB schedule?

See above #1

3. Are there any existing Mechanical plans (which include the drainage and domestic water system)?

See above #1

4. The file "6._Seed_Project_1_Form_66" states that a required submittal before acceptance is: Factory and Field Test Certificates, Logs and Test Results. What exactly are the tests required?

All of the below with an inspector on site for recording, preferably an ECES plumber on site as well:

o Pressure test all pipes for no leaks prior to energizing with refrigerant or water (and show results for recording) o Vacuum or PSI results of installed pumps and pipes with ECES member on site for recording o Electrical equipment op checks and volt/amp/etc... test results with inspector and plumber on site o Operational test flow rates of the pumps if possible o pH, salinity, and chlorine level results to ensure the new saline-chlorination unit is operating within BioEnv/Public Health standards o BioEnv, Safety, Public Health requests to conduct their own water tests at the pre-final inspection or whenever the pool is refilled and ready. Must be accomplished no later than the pre-final inspection date.

5. Is the roof of the pump house is sandwich panel? If yes, kindly provide the thickness of the sandwich panel.

Unknown.

SEED2:

1. Are there any available architectural and/or structural plans that show the facility as well as its immediate surroundings? (plan and site plan)

“As-builts” do not exist.

2. Since it is important that the metal netting not interfere with the lighting, ballasts and mass notification system, are there any electrical drawings that details these systems?

“As-builts” do not exist.

3. The file "7._Seed_Project_2_SOO_-_Install_Bird_Netting" includes "Required Submittals" as mentioned in the Statement of Objectives. Along with cost estimation and pricing of the project, are these the submittals required before acceptance?

Yes. Proposed materials, design, and how work shall be accomplished are also all required for the technical proposal and reviews from all competing contractors.

Additional Questions

As you know, traditional shipping costs cannot be used due to the current embargo, therefore additional costs are incurred for transshipping materials with shipping cost increasing 10 fold. We request guidance from your office on how to deal with the shipping costs for Qatar. Any assistance on this query would be greatly appreciated and beneficial to all bidding contractors.

a. Please include any additional shipping costs or costs of doing business in Qatar in your contractor coefficient as you see fit.

52.232-19 Availability of Funds for the Next Fiscal Year (Apr 1984)

Funds are not presently available for performance under this contract beyond FY2019. The Government’s obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. 52.232-34 Payment by Electronic Funds Transfer--Other Than System for Award Management (Jul 2013)

(a) Method of payment.

(1) All payments by the Government under this contract shall be made by electronic funds transfer (EFT), except as provided in paragraph (a)(2) of this clause. As used in this clause, the term “EFT” refers to the funds transfer and may also include the payment information transfer.

(2) In the event the Government is unable to release one or more payments by EFT, the Contractor agrees to either--

(i) Accept payment by check or some other mutually agreeable method of payment; or

(ii) Request the Government to extend payment due dates until such time as the Government makes payment by EFT (but see paragraph (d) of this clause).

(b) Mandatory submission of Contractor's EFT information.

(1) The Contractor is required to provide the Government with the information required to make payment by EFT (see paragraph (j) of this clause). The Contractor shall provide this information directly to the office designated in this contract to receive that information no later than 15 days prior to submission of the first request for payment. If not otherwise specified in this contract, the payment office is the designated office for receipt of the Contractor's EFT information. If more than one designated office is named for the contract, the Contractor shall provide a separate notice to each office. In the event that the EFT information changes, the Contractor shall be responsible for providing the updated information to the designated office(s).

(2) If the Contractor provides EFT information applicable to multiple contracts, the Contractor shall specifically state the applicability of this EFT information in terms acceptable to the designated office. However, EFT information supplied to a designated office shall be applicable only to contracts that identify that designated office as the office to receive EFT information for that contract.

(c) Mechanisms for EFT payment. The Government may make payment by EFT through either the Automated Clearing House (ACH) network, subject to the rules of the National Automated Clearing House Association, or the Fedwire Transfer System. The rules governing Federal payments through the ACH are contained in 31 CFR part 210.

(d) Suspension of payment. (1) The Government is not required to make any payment under this contract until after receipt, by the designated office, of the correct EFT payment information from the Contractor.

Until receipt of the correct EFT information, any invoice or contract financing request shall be deemed not to be a proper invoice for the purpose of prompt payment under this contract. The prompt payment terms of the contract regarding notice of an improper invoice and delays in accrual of interest penalties apply.

(2) If the EFT information changes after submission of correct EFT information, the Government shall begin using the changed EFT information no later than 30 days after its receipt by the designated office to the extent payment is made by EFT. However, the Contractor may request that no further payments be made until the updated EFT information is implemented by the payment office. If such suspension would result in a late payment under the prompt payment terms of this contract, the Contractor's request for suspension shall extend the due date for payment by the number of days of the suspension.

(e) Liability for uncompleted or erroneous transfers.

(1) If an uncompleted or erroneous transfer occurs because the Government used the Contractor's EFT information incorrectly, the Government remains responsible for--

(i) Making a correct payment;

(ii) Paying any prompt payment penalty due; and

(iii) Recovering any erroneously directed funds.

(2) If an uncompleted or erroneous transfer occurs because the Contractor's EFT information was incorrect, or was revised within 30 days of Government release of the EFT payment transaction instruction to the Federal Reserve System, and--

(i) If the funds are no longer under the control of the payment office, the Government is deemed to have made payment and the Contractor is responsible for recovery of any erroneously directed funds; or

(ii) If the funds remain under the control of the payment office, the Government shall not make payment and the provisions of paragraph (d) shall apply.

(f) EFT and prompt payment. A payment shall be deemed to have been made in a timely manner in accordance with the prompt payment terms of this contract if, in the EFT payment transaction instruction released to the Federal Reserve System, the date specified for settlement of the payment is on or before the prompt payment due date, provided the specified payment date is a valid date under the rules of the Federal Reserve System.

(g) EFT and assignment of claims. If the Contractor assigns the proceeds of this contract as provided for in the assignment of claims terms of this contract, the Contractor shall require as a condition of any such assignment, that the assignee shall provide the EFT information required by paragraph (j) of this clause to the designated office, and shall be paid by EFT in accordance with the terms of this clause. In all respects, the requirements of this clause shall apply to the assignee as if it were the Contractor. EFT information that shows the ultimate recipient of the transfer to be other than the Contractor, in the absence of a proper assignment of claims acceptable to the Government, is incorrect EFT information within the meaning of paragraph (d) of this clause.

(h) Liability for change of EFT information by financial agent. The Government is not liable for errors resulting from changes to EFT information provided by the Contractor's financial agent.

(i) Payment information. The payment or disbursing office shall forward to the Contractor available payment information that is suitable for transmission as of the date of release of the EFT instruction to the Federal Reserve System. The Government may request the Contractor to designate a desired format and method(s) for delivery of payment information from a list of formats and methods the payment office is capable of executing. However, the Government does not guarantee that any particular format or method of delivery is available at any particular payment office and retains the latitude to use the format and delivery method most convenient to the Government. If the Government makes payment by check in accordance with paragraph (a) of this clause, the Government shall mail the payment information to the remittance address in the contract.

(j) EFT information. The Contractor shall provide the following information to the designated office. The Contractor may supply this data for this or multiple contracts (see paragraph (b) of this clause). The Contractor shall designate a single financial agent per contract capable of receiving and processing the EFT information using the EFT methods described in paragraph (c) of this clause.

(1) The contract number (or other procurement identification number).

(2) The Contractor's name and remittance address, as stated in the contract(s).

(3) The signature (manual or electronic, as appropriate), title, and telephone number of the Contractor official authorized to provide this information.

(4) The name, address, and 9-digit Routing Transit Number of the Contractor's financial agent.

(5) The Contractor's account number and the type of account (checking, saving, or lockbox).

(6) If applicable, the Fedwire Transfer System telegraphic abbreviation of the Contractor's financial agent.

(7) If applicable, the Contractor shall also provide the name, address, telegraphic abbreviation, and 9-digit Routing Transit Number of the correspondent financial institution receiving the wire transfer payment if the Contractor's financial agent is not directly on-line to the Fedwire Transfer System; and, therefore, not the receiver of the wire transfer payment.

(End of clause)

52.232-39 - Unenforceability of Unauthorized Obligations (Jun 2013)

(a) Except as stated in paragraph (b) of this clause, when any supply or service acquired under this contract is subject to any End User License Agreement (EULA), Terms of Service (TOS), or similar legal instrument or agreement, that includes any clause requiring the Government to indemnify the Contractor or any person or entity for damages, costs, fees, or any other loss or liability that would create an Anti- Deficiency Act violation (31 U.S.C. 1341), the following shall govern:

(1) Any such clause is unenforceable against the Government.

(2) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOS, or similar legal instrument or agreement is invoked through an “I agree” click box or other comparable mechanism (e.g., “click-wrap” or “browse-wrap” agreements), execution does not bind the Government or any Government authorized end user to such clause.

(3) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement.

(b) Paragraph (a) of this clause does not apply to indemnification by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulation and procedures.

(End of clause)

52.236-7 -- Permits and Responsibilities (Nov 1991)

The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any host government and political subdivisions laws, codes, and regulations applicable to the performance of the work. The Contractor shall also be responsible for all damages to persons or property that occurs as a result of the Contractor’s fault or negligence. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract.

(End of Clause)

52.243-7 -- Notification of Changes (Jan 2017)

(b) Notice. The primary purpose of this clause is to obtain prompt reporting of Government conduct that the Contractor considers to constitute a change to this contract. Except for changes identified as such in writing and signed by the Contracting Officer, the Contractor shall notify the Administrative Contracting Officer in writing promptly, within 7 (to be negotiated) calendar days from the date that the Contractor identifies any Government conduct (including actions, inactions, and written or oral communications) that the Contractor regards as a change to the contract terms and conditions.
