01 00 00 General Requirements

– Task Order Participation

• Contractors will be required to propose on all task orders unless written approval is received from the contracting officer before the proposal due date

– TO Proposal Preparation

• The cost of preparation of basic contract and TO offers shall be the responsible of the contractor and not directly reimbursable. The contractor shall furnish all project management, planning, estimating, labor, transportation, materials, equipment, tools, supervision, design if applicable, and all other associated costs necessary to fulfill the requirements of the basic contract and TO

• Contractor will typically have 2 weeks from date of the site visit to submit an offer.

01 00 00 General Requirements

• Key Points

– Construction Wage Rate Requirements Statute

• The most current Construction Wage Rate Requirements Statute (formerly

Davis-Bacon Act) wage determinations for each potential work location will be incorporated into the contract at award and updated when the option periods are exercised

• Wage determinations will apply to all task orders the entire year

– Performance/Payment Bonds

• Contractors shall furnish Performance and Payment Bonds (Standard Form

25/25A) to the Government on all TOs regardless of dollar value

– Performance Evaluations

• Will be completed annually to encompass all TOs below reporting threshold and the contractor’s compliance with the overall program requirements

• Will be completed on each TO over $700K

• The Government reserves the right to complete performance evaluations on TOs below $700K at the ACO’s discretion.

01 00 00 General Requirements

• Key Points

– Work in Special Security Areas

• Escorts may be required for access to restricted/controlled areas, while working on construction

• Escorts will be provided by the Government or through a separate contract

• Contractor will not be required to have a security clearance, but will be required to comply entry requirements (e.g. certain areas do not allow foreign nationals to enter)

– Delays in entering and leaving work area

• While delays at the inspection gates are typically minimal, in certain circumstances, the Contractor may encounter multiple hour delays while awaiting inspections

• No compensation will be granted for delays caused by normal operations of the Security Forces Squadrons and contractors should consider the potential for delays when preparing offers

– REAL ID

• Contractors will be required to comply with the REAL ID act requirements to enter the installations

– Safety and Health

• Contractor shall comply with all pertinent provision of the most current version of the Unites States Army Corps of Engineers Manual, EM 385-1-1

Technical Capability

• Sub-factor 1: Program Management Plan − IAW SABER Master Specifications Section 01 31 00 para 1.5.

− Key personnel, as a minimum, shall meet the requirements of the positions listed in SABER Master Specifications Section 01 31 00 para

1.1.1.1 thru 1.1.1.8.

− Organizational Chart & Narrative detail the roles, responsibilities, qualifications, and levels of authority of personnel within organization – identifies positions that will be accomplished by subcontractors.

− Narrative detailing approach to recruiting, training, and retaining sufficient qualified staff; project planning, execution info flow, reporting, Gov’t interface; selection, integration, and management of subcontractors; and ability to successfully manage multiple (5-10), concurrent projects through life of program.

Technical Capability

• Sub-factor 2: Quality Control Plan − IAW SABER Master Specifications Section 01 45 00 para 1.2.

− QCP identifies, but is not limited to, the following:

• Personnel, procedures, instructions, tests, forms, and records to be used

• Personnel identified as the Quality Control Officer

• Authority and responsibilities of Quality Control personnel

• Procedures for review/approval of all shop drawings, product data samples, or other submittals before submission to Contracting Officer to include procedures for obtaining field measurements

• Method of documenting Quality Control ops, inspection, and testing of both prime and subcontract work including form samples

• Method of documenting and tracking deficiencies including responsibilities and procedures for correcting deficiencies

Price/Cost

• Coefficients are factors multiplied against the standard unit prices in the Unit Price Book (UPB) to calculate the overall price of a Task Order (TO).

• Coefficients remain fixed for the life of the contract.

• Offerors propose coefficients for costs to include but not limited to overhead, profit, minimum design costs, General &

Administrative (G&A) expenses, bond premiums, gross receipt taxes, and RSMeans Training.

• Any costs included in the coefficient cost pool shall not be separately priced in the RSMeans Cost Estimates provided for individual task orders.

Proposed Coefficient for Evaluation

Overall Proposal Evaluation Step 1. Perform compliance review on all proposals to assess compliance with terms and conditions of the solicitation. Non-compliance with the terms and conditions of the solicitation may result in an unfavorable proposal evaluation and may be grounds to eliminate the proposal from consideration for contract award.

Step 2: Perform price evaluations on all proposals not eliminated from consideration in Step 1 and rank them in price order from lowest to highest based on their Total Evaluated Price.

Step 3: Conduct technical evaluations beginning with the lowest priced offeror. If the lowest priced Offeror is determined to be technically unacceptable, then the next lowest priced Offeror will be evaluated. This process will be repeated until the government has identified the three lowest priced technically acceptable offerors. The government reserves the right to open discussions. Only those offerors determined to be technically acceptable, either initially or as a result of discussions, will be considered for award.

Overall Proposal Evaluation

Step 4. Perform a responsibility determination on the three lowest priced technically acceptable offerors. In order to be determined responsible an offeror must meet the standards identified in FAR 9.104-1; possess an active California General Contractors License Type A or Type B, registered in the prime contractor’s name; and provide evidence that it is able to obtain a minimum single project bonding capacity of $3M and minimum aggregate bonding capacity of $10M from an approved corporate surety whose name appears on the list contained in Treasury

Department Circular 570 found at the website:

http://www.fms.treas.gov/c570/ or other authorized bonding source

IAW FAR 28.102. If one or more of the three lowest priced technically acceptable offerors are determined non-responsible, the Government will resume technical evaluations as detailed in Step 3. Technical evaluations will continue until the Government has identified the three lowest priced technically acceptable responsible offerors.

Overall Proposal Evaluation

• Following the completion of Steps 3 and 4; the Contracting Officer, with the approval of the Source Selection Authority (SSA), will determine if it is in the Government’s best interest to open discussions. If the determination is made to open discussions, the Government will conduct discussions with all offerors included in the Competitive Range. If the offeror’s proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the Final Proposal Revision are subject to evaluation and may introduce risk that the offeror’s proposal be determined unacceptable and ineligible for award. The Government reserves the right to award without discussions. The Government also reserves the right to perform both price and technical evaluations on non-responsive Offerors to determine if it is in the Government’s best interest to open discussions. Only those Offerors determined to be technically acceptable, either initially or as a result of discussions, will be considered for award.

Warnings

• Offerors are cautioned to thoroughly consider all potential costs, risks, economic trends and the proposal environment when developing proposed coefficients. Carefully consider consequences of a coefficient of less than 1.0000. Contract coefficients will remain fixed for the life of the resulting contract and no allowances will be made after award.

• Line Item Quantities are vital, not only do they tell us how many labor-hours and which materials you are going to use, they are used, on occasion, to de-scope a project and are required to make a equitable resolution.

• We will provide a statement of objectives, you will in turn provide a detailed statement of work in your own words telling us how you are going to complete a certain project.
