About this file

This file is a Subcontractor/Teaming Partner Consent Letter Template for the Minot Air Force Base Multiple Award Construction Contract (MACC) IDIQ solicitation (FA4528-26-R-0002). The template serves as a required authorization document that allows proposed major subcontractors and teaming partners to grant the U.S. Air Force explicit consent to disclose and discuss their past and present performance information with prime contractors during the proposal evaluation process.

The consent letter must be completed on the subcontractor's official letterhead and signed by an authorized representative with legal authority to bind the company. The letter authorizes the 5th Contracting Squadron to disclose specific performance data to the prime offeror, including CPARS evaluation ratings and narratives, Past Performance Information Forms (PPIFs), history of cure notices, show cause letters, termination actions, safety violations, and direct performance exchanges under RFO 15.306. Prime offerors are required to submit completed and signed consent letters for each major subcontractor or teaming partner proposed to perform key aspects of the MACC requirements within the "Part II - Past Performance Volume" of the proposal package. The template includes designated fields for the subcontractor's authorized signatory information, printed name, corporate title, legal company name, company address, CAGE code, contact phone number, and contact email address.

SUBCONTRACTOR / TEAMING PARTNER CONSENT LETTER

5th Contracting Squadron (5 CONS) | Minot AFB, ND Solicitation Number: FA4528-26-R-0002 | Multiple Award Construction Contract (MACC)

SECTION 1: GENERAL INSTRUCTIONS TO THE OFFEROR

1. Background & Legal Necessity:

Past performance information concerning subcontractors and teaming partners is proprietary business data and cannot be disclosed to a private party without the subcontractor's or teaming partner's explicit consent. Because a prime contractor is a private party, the Government requires written consent before disclosing or discussing subcontractor/teaming partner past and present performance information (including CPARS and survey evaluations) with the Prime Offeror during exchanges or discussions under Revolutionary Federal Acquisition Regulation Overhaul (RFO) 15.306.

2. Requirement:

To assist the 5 CONS Evaluation Team in assessing your past performance relevancy and establishing a performance confidence rating under Section M, the Prime Offeror must ensure that a completed and signed Consent Letter is submitted for each "Major Subcontractor" or "Teaming Partner" proposed to perform key aspects of the MACC requirements.

3. Instructions for Completion:

· The Proposed Subcontractor/Teaming Partner must place the text in Section 2 on their official Company Letterhead.

· The form must be signed by an individual who has the active legal authority to sign for and contractually bind the subcontractor's company.

· The completed and signed letters must be compiled and submitted by the Prime Offeror within "Part II – Past Performance Volume" of the proposal package.

SECTION 2: CONSENT AUTHORIZATION LETTER

(To be typed on the Proposed Subcontractor's/Teaming Partner's Official Letterhead) Date: [Subcontractor to insert date] To:

1. Acknowledgment of Role:

I, the undersigned, as an authorized representative of [Subcontractor/Teaming Partner to insert Legal Company Name], hereby acknowledge that our firm has agreed to participate as a proposed major subcontractor or teaming partner to [Prime Offeror to insert Legal Company Name] in their proposal response to Solicitation FA4528-26-R-0002.

2. Awareness of Evaluation Emphasis:

We understand that the U.S. Air Force is placing increased emphasis on past performance in order to obtain the best value in this source selection. We recognize that our firm's demonstrated record of performance and technical execution on previous construction efforts may be a critical factor in the overall Past Performance Confidence Assessment of the Prime Offeror's proposal.

3. Explicit Consent & Authorization:

In accordance with RFO 3.104 (Procurement Integrity Act protections) and to facilitate a thorough and transparent evaluation, [Subcontractor/Teaming Partner to insert Legal Company Name] hereby grants the U.S. Government, specifically the Department of the Air Force and the 5th Contracting Squadron, full consent and authority to disclose, discuss, and exchange any and all of our company's past and present performance information directly with the Prime Offeror, [Prime Offeror to insert Legal Company Name], during any phase of the source selection process for the referenced solicitation.

This authorization includes, but is not limited to, the disclosure and discussion of:

· Contractor Performance Assessment Reporting System (CPARS) evaluation ratings and narratives.

· Past Performance Information Forms (PPIFs) or surveys gathered by the Government.

· History of cure notices, show cause letters, termination actions, or safety violations.

· Direct performance exchanges, clarifications, or discussions under RFO 15.306.

4. Voluntary Release:

This consent is provided voluntarily and without reservation to ensure that the 5 CONS Evaluation Board has access to complete and validated performance data during its review.
