Vance FOS Draft PCP Questions and Responses

Technical Performance

1 1
2.1, Table 1
Para. 3.1
Contractors are normally given a standard that represents a reasonable period in which to respond to a CAR, i.e., 3 days.
Each CAR may be different in terms of how much time a contractor is given to respond. Because of the severity of CARs and the government’s need to emphasize quality, the plan will begin deductions on the day the CAR is issued. If the contractor is able to prove the CAR to be completely invalid, the government reserves the right to reduce the amount of deducted funds.

Recommend the additional deduction of 0.2% for open CARs begin on day 4, which would represent the first day the CAR response is overdue with an additional 0.2% for each day it remains open between 4-89 days.

Technical Scope3 1
Paragraphs 1 and 2
Para. 1 states, "…describes how a percentage of the contractor's Total Value of Firm Fixed Price
(TV-FFP) CLINSs will be used as compensation for quality performance." Para. 2 states, "…a percentage of the TV-FFP CLINs will be set aside as a separate CLIN each contract year to compensate performance in the area of Quality."
Is the money for the separate Performance Compensation CLIN over and above the TV-FFP CLINs?
No. The money for the Performance Compensation CLIN will be 4% deducted from the TV-FFP
CLINs as proposed by the contractor.
Comment:
Question:
Response:
We want to be clear that the percentage of the TV-FFP CLINs that is set aside as a separate CLIN each year is not taken from the FFP CLINs but is additional money set aside. In other words, the
TV-FFP CLINs are only the basis for which the 4% is calculated. If money used for the
Performance Compensation CLIN is subtracted from the TV-FFP CLINs, then the CLIN is not compensatory, but punitive.

Sub-Areas
4 1
2.1
The primary focus of the plan is on the evaluation of the sub-areas of Technical Inspections (TI) and
Observation Guide Inspections (OGI); however, it also utilizes As Observed Findings (AOFs) and
Corrective Action Reports (CARs) tied to the entire services summary.
Will inspections from outside agencies be included as a performance sub area?
Yes. Inspections from outside agencies may be included as a performance sub-area for purposes of this plan. In addition, surveillance personnel may use these results as tools to focus their own contract inspections.

Technical As-Observed
Findings
5 2
3.2
As-Observed Findings are issued by the Government if deficiencies or non-compliances are identified but are not associated with a scheduled TI or OGI inspection (to include Quality Control findings).
Will the contractors Quality control finding be documented as CAR's by the COR?
Yes. If the findings are not corrected in a timely manner, contractor quality assurance findings may require COR to create a CAR.
Comment:
Question:
Response:
During some inspections the QAE will document the findings of the contractor quality personnel. If contractor QA personnel detect errors during the inspections then technically 2 inspections have been performed by the QAE. Will both inspections be documented?

Technical Determination of Sub-Areas
Quarterly
Percentage
6 3
Quarterly percentages will be computed using COR inspection results from the evaluation period for each sub-area (TI and OGI) using the total number of applicable inspections rated satisfactory divided by total number of inspections accomplished in that sub-area then multiplied by one hundred.
How will successful inspections be documented? And how will minor discrepancies be categorized?
All inspections will be documented in the Quality Management Information System (QMIS). All deficiencies will be categorized as either major or minor findings depending on the severity of the disrepancy found during surveillance.
Comment:
Question:
Response:
Current inspections are all documented on CAR forms. If as observed that are satisfactory are not documented it will skew the rates.
