Section C - Description/Specifications/Statement of Work The documents listed in Section J of this solicitation constitute the work description, specifications and the Performance Work Statement (PWS) to define the task requirements for performance under this RFP and may be incorporated into the resulting contract either by reference or full text.

Requirements:

The Contractor shall provide non-personal services to operate, maintain, and support (OM&S) the Perimeter Acquisition Radar Attack Characterization System (PARCS) at Cavalier SFS Force Station, ND. Services encompass base support including management of radar and mission computer maintenance, civil engineering, environmental functions, security, logistics, sensitive and non-sensitive communications. The Contractor shall provide all necessary personnel, administrative, and managerial resources necessary on a continuous, 24-hours-a-day, 7-days-a-week (24/7) basis to meet Space Force Station operations and maintenance requirements as specified in this PWS. Services shall include support for system upgrades and modifications, as well as provide day-to-day support services. The Contractor shall support organizational level maintenance on system upgrades and modifications once they are accepted by the Government.

Section D - Packaging and Marking

1. Packaging and marking of technical data, hardware, and software to be delivered pursuant to this contract shall be in accordance with the contractor's standard commercial practices.

2. Requirements for packaging and marking other materials are contained in the PWS. Otherwise, standard commercial practices for routine, miscellaneous materials will be satisfactory if sufficient to protect the materials during transit.

Section E - Inspection and Acceptance Point of Inspection

1. The Government reserves the right to perform quality assurance inspections at the place of performance identified in this contract. The Government will inspect the contractor's submissions (deliverables) and services /products as specified in this contract. To accomplish these inspections, the Contracting Officer will appoint Contracting Officer's Representative(s) (CORs).

2. Inspection and acceptance will be performed by the assigned COR.

3. The address, telephone numbers, and e-mail address of the COR will be provided in a memorandum to contractor following award.

Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an Offeror for any costs.

Section H - Special Contract Requirements Failure to perform in accordance with PWS Section 1, Chapter 1, para 1.2.7 will result in the Government removing 2% from the total invoiceable amount of the Operations, Maintenance, and Support Services (OM&S) Contract Line Item Number (CLIN). The Minimum Quantitative Requirement for the Small Business Participation Commitment Document, calculated on the OM&S CLIN value, will not be affected by any adjustment under this section. The 2% removal will occur each month for each vacancy not filled after 60 days. Each month will be calculated based on the total awarded value and will not change based on the new value and funded amount of the OM&S CLIN.

The proration will begin on the 61st day and will be based on 2% of the CLIN value divided by 30 days (standard # of days in a month) and then multiplied by the number of days vacant in that month. All numbers will be rounded to the whole dollar amount. See Example below.

The total number of vacancies will be looked at for the entire contract. The Government considers failure to maintain staffing at the proposed and incorporated staffing level an event of default and reserves all rights and remedies of default. In the event of a termination for default, the Government will assess these damages until the Government reasonably obtains performance of similar services. This removal is in addition to excess costs of repurchase under the termination clause.

Example:

The 61st day of an unfilled vacancy falls on the 10th day of a month.

The vacancy is open for the rest of the month, which is equal to 20 days.

All values will be rounded to the nearest dollar.

CLIN 000X value= $1,000,000. 2% of CLIN 000X = $20,000.

$20,000/30 days = $666.67 per day (rounded to $667) $667 times 20 days = $13,340 will be removed from the OM&S CLIN.

The Government will take into consideration the circumstances surrounding each vacancy provided the contractor submits information for the Contracting Officer to review. The enforcement of this failure to perform PWS Section 1, Chapter 1, para 1.2.7 will ultimately be up to the Contracting Officer.
