1.
INTRODUCTION
1.1.
The intent of this Contingency Plan is to insure that (contractor name) is in compliance with the
Contract Clause 5352.237-9001—Requirements Affecting Contractor Personnel Performing Mission Essential Services (Oct 2004) and the DODI 3020.37, “Continuation of Essential DoD Contractor Services During Crises.” As required by the Contract Clause 5352.237-9001, (contractor name) will within 30 days of contract award or the incorporation of this clause into a contract by modification, provide a written list of all “Mission Essential Contractor Personnel” to the Contracting Officer or other designated personnel. The list will identify by employee name and country(ies) where each employee will perform work under this contract.
1.2.
This Contingency Plan is intended to address, as a minimum, the definition of Crisis Situation as defined in DODI 3020.37, Enclosure 2: Any emergency so declared by the National Command Authority (NCA) or the overseas Combatant Commander, whether or not U.S. Armed Forces are involved, minimally encompassing civil unrest or insurrection, civil war, civil disorder, terrorism, hostilities buildup, wartime conditions, disasters, or international conflict presenting a serious threat to DoD interests.
1.3. The signed Notification of Compliance with Contract Requirement, Required List of Mission Essential Personnel (Attachment 1) insures updated lists of Mission Essential Personnel will continue to be provided to the cognizant Security Forces at the Post, Camp, Base, or Host Unit/Site where the mission occurs and Mission Essential Personnel report for work during a catastrophic/non-catastrophic contingency, emergency and crisis situations.
1.4.
Further, this plan establishes contingency procedures for the Air Force Space Command (AFSPC) (name of program). This plan describes responsibilities and actions taken to mitigate interruptions in contract performance in the event of catastrophic and non-catastrophic contingencies, emergencies and crisis situations to include continuation of mission during wartime. The following are possible contingencies and emergency services that (contractor name) personnel support:

· Essential Services required during crisis situations as defined in paragraph 1.2.
· Essential Services required during peacetime and wartime missions
· Headquarters, Host-Wing/Group/Unit directed exercises and taskings
· Fire Suppression Support
· Other Contingency, Design Operational Capability (DOC) Generation or Emergency Support deemed necessary by the Unit Commander
· Catastrophic Events and/or Natural Disasters
· Labor Strikes/Work Stoppages
· (any other that apply) 1.5.
(contractor name) maintenance and/or operational personnel support all mission requirements that may occur outside the regular hours of operation listed in the Statement of Work (SOW) or Performance Work Statement (PWS) including 24-hour exercises or contingency operations. (contractor name) understands the wide range of missions AFSPC perform and we are committed to accomplishing all contingencies.
1.6.
This plan is reviewed annually by the (contractor name) Site Manager and updated accordingly. It is then submitted to the Program Manager who in turn submits it to the Contracting Officer for approval.
2.
CONTINGENCY ACTIONS

2.1.
This Contingency Plan allows for the following assumptions:
· Overtime is not granted in case of a strike or employee walk-off.
· Limited overtime may be granted for all contingency operations other than strike or employee walk-off.
2.2.
(contractor name) staffs all contingencies and emergency operations with existing on-site personnel. If additional personnel are required our recruiting sources include, but not limited to, the following:
· Qualified personnel who have applied for a position and whose contact information are in our Personnel Database.
· Qualified personnel from other AFSPC contract site locations if the contingency involves less than all sites. (if mission occurs at multiple sites)
· Qualified personnel from other operational sites within (contractor name) if the contingency involves all the sites. (if mission occurs at multiple sites)
· Qualified personnel available from other companies with which (contractor name) maintains a professional working relationship.
· Qualified personnel from state employment services.
· Qualified personnel from temporary hiring agencies.

All newly assigned personnel are screened to determine their particular skill level. Personnel who do not possess unique (specific program) qualifications are provided specific task training and certification for the area they are working. Training and certification is performed In Accordance With (IAW) the (contractor name) Training Plan. New hires are assigned a trainer and initially work side-by-side with an experienced, qualified (contractor name) employee.
2.3. The Site Manager (SM) is primarily responsible for ensuring compliance with this plan. Specific SM responsibilities include but are not limited to:

· Implement this plan when required.
· Establish and maintain a current recall roster of all employees.
· Ensure (contractor name) operational and maintenance personnel respond to contingencies and report to work within (state time frame i.e. “one hour”, may differ by site) after notification from Government personnel.
· Ensure the Contingency Plan is made available for review by the Government within 30 minutes of request.
· Ensure coordination with the Functional Commander (FC), Contract Officer Representatives (CORs), and operations personnel when developing and maintaining appropriate recall rosters and emergency/quick reaction checklists for crash, fire, severe weather warning, bomb threat, etc. as required by the host base/unit. All checklists are approved and signed by the FC and are made available for use in the Maintenance Operations Center (MOC) (or applicable functional area).
2.4.
In addition to the above actions, (contractor name) personnel accomplish the actions in each of the following areas: Emergency Work Requests, Natural Disasters, and Labor Strike/Employee Walk-Off.
3.
EMERGENCY WORK REQUESTS
3.1.
(contractor name) personnel treat emergency work requests with the utmost urgency. The following actions are accomplished in addition to all local requirements and/or Operational Instructions (OIs):
· The MOC notifies the SM after receiving emergency notification by the Government.
· Any additional support equipment required is requested from the Government.
· The SM appoints personnel to work the emergency request. These personnel:
· Work until the task is completed, or
· Work until relieved by another crew, or
· Work a 12-hour on, 12-hour off work cycle coordinated with the Government.
4.
NATURAL DISASTERS
4.1.
Natural disasters can occur at anytime and cause extensive damage to property and equipment. Floods, tornadoes, hurricanes, typhoons, hail, blizzards, and gale force winds can have a major impact on a unit's mission capability. All facilities, equipment, and any aircraft are properly secured in order to prepare for the disaster. If a unit's facility and/or equipment are damaged due to a natural disaster, (contractor name) personnel:
· Secure and inventory all property in the facility and identify any damaged or destroyed equipment and immediately requests replacement.
· Establish around the clock work shifts to maintain continuity of mission requirements.
4.2.
If an off-site disaster should occur and unit assistance is required, (contractor name) personnel:
· Maintain mission support with all available resources or request additional resources.
5.
LABOR STRIKE/EMPLOYEE WALK-OFF
5.1.
It is (contractor name) policy to respect the worker’s right to unionize. But we also realize that personnel who are satisfied with a company's management and working conditions generally do not form a union. From practical experience, this is the only contingency that is within the contractor’s control. By establishing excellent communication avenues, we can detect any employee dissatisfaction early. All necessary actions are accomplished to alleviate the dissatisfaction. If this fails and a union is formed, we survey the dispute and make every reasonable effort for a quick settlement/agreement. We are also prepared for a strike or walk-off. If either of these two conditions is threatened, (contractor name) Corporate Headquarters immediately:
· Accelerates the recruitment plan.
· Travels to the site and attempts to settle the dispute.
· Retains a labor attorney.
· Plans for a strike/walk-out.
5.2.
If a site is unionized and the strike/walk-out is authorized per the Collective Bargaining Agreement (CBA), (contractor name):
· Respects the rights of the strikers.
· Recruits and maintains a qualified temporary work force to insure mission continuity until the strike is ended.
· Absorbs the financial burden.
5.3.
If a site is or is not unionized and the strike/walk-out is not authorized per the CBA or is illegal, (contractor name) will:
· Issues a statement to return to work.
· Terminates those employees who do not return to work.
· Screens and hires a new work force.
· Absorbs the financial burden.

CONTINGENCY MOBILIZATION
6.1 During a contingency mobilization the work shifts are adjusted as follows:
Adjustments in the shift manning may be required to cover for personnel that are absent due to illnesses. Personnel on vacation are requested to return to duty if the contingency requires all assigned personnel.
6.2.
The following are accomplished during mobilization:
· Any critical scheduled maintenance is performed early if possible.
· Supply Technicians upgrade priorities on all due-outs.
· Equipment and supplies are assembled to support mobilization.

7.
MOBILIZATION RECALL COMMITMENTS
7.1.
(contractor name) recognizes the fact that there are employees who have military mobilization recall commitments in either the Guard or Reserve. It has been our experience that when these individuals are recalled to serve it is normally for 30 days or less. For these relatively short periods of time, it is not feasible to recruit, hire, and train someone to temporarily fill in.
7.2.
Whenever an individual is recalled, the SM reviews the current personnel levels and adjusts the shift manning levels accordingly to cover for the Guard or Reservist’s absence. In the rare case that an individual is recalled for more than 30 days, one option is for the SM to recruit, hire, and if required, assign a trainer to train temporary replacements until the recalled individual’s return to duty. Another option is to temporarily assign an employee from another unit to cover while the recalled member is serving. In any case, (contractor name) will not allow the services we provide to degrade in any way.
NOTIFICATION OF COMPLIANCE WITH CONTRACT REQUIREMENT, LIST OF CONTRACT PERSONNEL AND MISSION ESSENTIAL PERSONNEL Contract No: F05604-XX-C-XXXX The undersigned Contractor hereby acknowledges that he/she has read and understands the List of Mission Essential Personnel requirements specified in this contract and hereby provides notification (1) that such written list(s) shall be maintained and provided within 30 days of contract award or incorporation of the clause, 5352.237-9001 – Requirements Affecting Contractor Personnel Performing Mission Essential Services in the contract by modification. The list(s) will include all individuals performing the requirements set forth in the Performance Work Statement (PWS) or Statement of Work (SOW) and will include which individuals are designated Mission Essential. Each individual on the list will have contact telephone numbers provided, work and home and email address as applicable and the country where performance occurs. The original list and all revisions through the life of the contract to include option year modifications and/or time extensions granted thereto will be provided to the Contracting Officer and cognizant Security Forces at the Post, Camp, Base, or Host Unit/Site where the mission occurs and the designated Mission Essential Personnel report for work during a catastrophic/non-catastrophic contingency, emergency and crisis situations.
