About this file
This is an Exhibit N document for RFP No. HHS0017108 outlining breach and incident disclosure requirements for respondents to the Texas Medicaid and Children's Health Insurance Program Dental Services contract opportunity. Respondents must disclose any breaches of information, data breaches, or security incidents reported to state or federal regulatory authorities within the three calendar years preceding solicitation response submission. Required disclosures include high-level descriptions of breaches or incidents, methods of compromise and identification, general categories of data involved (including CJIS, CMS, financial data, IRS FTI, PII, PHI, SSA data, or other confidential information), whether data was subject to heightened protection requirements, approximate scope of impact, timeline information including discovery and remediation timeframes, and systems or environments involved along with data-protection measures in place at the time of the event.
The exhibit further requires respondents to address impact considerations and risk context by identifying affected stakeholder categories and numbers of impacted individuals, describing compliance and reporting considerations including breach notification requirements and regulatory reporting obligations, and indicating whether regulatory investigations occurred. Respondents must also detail the response approach and ongoing risk management by describing general steps taken to address issues and reduce recurrence likelihood, confirming whether post-event review activities were conducted, summarizing security enhancements resulting from events, confirming appropriate internal stakeholder engagement, and disclosing any known external matters directly related to events that may affect ongoing operations or risk-management posture.
