Exhibit C: Deliverables-Liquidated Damages Matrix
This is a liquidated damages matrix for RFP No. HHS001708, establishing performance standards and financial penalties for a Medicaid and Children's Health Insurance Program (CHIP) dental services contract administered by the Texas Health and Human Services Commission (HHSC). The document outlines comprehensive performance requirements across multiple service categories including operations readiness, general administrative functions, privacy and security compliance, claims processing, encounter data management, member and provider hotlines, complaints and appeals resolution, provider network management, marketing activities, management information systems, financial reporting, fraud and waste prevention, and turnover operations. The dental contractor must achieve operational status by an agreed-upon Operational Start Date, submit required plans and documentation within specified timeframes during the transition phase, and maintain compliance throughout the operations and turnover phases of the contract.
The liquidated damages framework establishes daily and periodic financial penalties ranging from $100 to $25,000 depending on the severity and nature of non-compliance. Penalties are assessed per day of noncompliance, per incident, per program, per county, and per provider type as applicable. Critical performance areas include achieving 98% claim resolution rates within 30 days, maintaining 80% of hotline calls answered within 30 seconds, resolving 98% of member and provider complaints within specified timeframes, submitting encounter data with no more than 2% variance, meeting alternative payment model (APM) ratios beginning at 25% overall and 2% risk-based in year one with escalating targets, and maintaining provider network standards including distance and time accessibility benchmarks. The matrix distinguishes between initial occurrences of non-compliance and subsequent occurrences, with substantially higher penalties for repeated violations, and includes force majeure exceptions for specific performance standards such as hotline operations.
