About this file

This document is a sample template for a Teaming Partner/Subcontractor Consent Letter required for the Defense Health Agency (DHA) TRICARE Medicare Eligible Program (TMEP2) solicitation HT940226R0001. The letter serves as formal authorization allowing the Government to disclose subcontractor and teaming partner past performance information to the prime contractor during the source selection evaluation process. Federal regulations prohibit disclosure of such performance data to private parties without explicit consent; since prime contractors are considered private parties, individual consent letters from each subcontractor and joint venture/consortium partner must be included in Volume III (Past Performance) of proposal submissions.

The letter requires completion on company letterhead and must be signed by an individual with authority to legally bind the company. It should include the subcontractor or teaming partner's company name and address, the prime contractor's name, the solicitation title and number, and acknowledgment that the Government is emphasizing past performance for best-value source selection decisions. Past Performance Consent Letters are exempt from proposal page count limitations. This template applies specifically to the DHA TRICARE Medicare Eligible Program solicitation but can be adapted for similar federal contracting situations where past performance assessment is a critical evaluation factor.

Exhibit 6 Sample Teaming Partner/Subcontractor Consent Letter

Past performance information concerning subcontractors and teaming partners cannot be disclosed to a private party without the subcontractor’s or teaming partner’s consent. Because a prime contractor is a private party, the Government needs each subcontractor’s (teaming partner’s) consent before disclosing subcontractor/teaming partner past and present performance information to the prime contractor during exchanges if necessary. In an effort to assist the Government’s Source Selection Evaluation Board (SSEB) in assessing an offeror’s past performance relevancy, the offeror shall include the following consent letter for each subcontractor and partner of the joint venture, and/or consortium identified in their proposal in the offeror’s Volume III, Past Performance. Past Performance Consent Letters are exempt from the page count.
