About this file
This file is Exhibit K: Data Security Requirements from the Texas Department of Agriculture, establishing mandatory cybersecurity standards for contractors handling sensitive personal information and agency data throughout the contract term and any renewal options. The exhibit requires contractors to implement and maintain reasonable procedures to protect against unlawful use or disclosure of personally identifying information (PII), with specific compliance obligations including adherence to NIST SP 800-53 or TX-RAMP requirements, quarterly vulnerability reports and scanning updates to TDA's IT department, immediate breach reporting within 24 hours with resolution within 72 hours, Payment Card Industry Data Security Standard compliance for payment processing, and AES 128-bit data encryption for applications. Additional technical requirements mandate password standards with minimum 10 characters including uppercase, lowercase, numbers, and special characters, TLS 1.2 or above for HTTPS connections on port 443 or other secure ports, TX-RAMP compliance for hardware infrastructure, and OWASP compliance for client-facing web applications.
Contractors must provide background checks for all personnel with PII access, basic network diagrams upon request, and disaster recovery plans, with quarterly vulnerability reports due by the first business day of each quarter meeting TX-RAMP guidelines. A Service Organization Controls Report (SOC 2 - Type 2) must be submitted annually, or alternatively a Bridge Letter, by the first business day after September 1st each year to the Chief Information Officer at Chris.Bunton@TexasAgriculture.gov and the Information Security Officer at Wesley.Williams@TexasAgriculture.gov. Contractors must certify compliance with the Texas cloud computing State Risk and Authorization Management Program under Texas Government Code Section 2054.0593 and maintain all certifications and program requirements throughout contract performance. The document requires executed signatures from both the respondent and an authorized representative affirming understanding and acceptance of these data security obligations.
