About this file

This is an Insurance Requirements exhibit for Volusia County, Florida's Invitation for Bid (ITB) No. 26-B-38IF for the Heron Street, Egret Avenue, and Mallard Street Seawall Replacement Project. The exhibit establishes comprehensive insurance coverage mandates that all contractors and subcontractors must maintain throughout project execution. Required coverage includes Workers Compensation with Florida statutory limits and waiver of subrogation; Commercial General Liability with $1,000,000 per occurrence and $2,000,000 general aggregate limits on an occurrence basis with contractual liability, waiver of subrogation, and County as additional insured; Auto Liability with $1,000,000 combined single limit covering any auto and all subcontractors and independent contractors; Excess Liability of $1,000,000 per occurrence and aggregate following Commercial General Liability form; Contractors Pollution Liability with $1,000,000 occurrence and aggregate limits; and Builders Risk or Installation Floater coverage on an all-risk basis including wind, hail, named storms, and flood with County as additional loss payee. All policies must maintain primary and non-contributory status relative to County insurance, include County as additional insured utilizing ISO forms CG 20 37 and CG 20 38, and contain thirty-day written cancellation notice requirements directed to the Certificate Holder at Volusia County Purchasing & Contracts Division, 123 W. Indiana Avenue, Room 302, DeLand, FL 32720, Attention: Inga Fegley, Risk Management Division.

The insurance requirements establish uniformly applicable standards across all insurance types with no variations based on contractor size, experience level, or bid amount. Notably, the exhibit does not establish minimum coverage amounts that vary with contract pricing or project scope value, nor does it differentiate requirements between the general contractor and subcontractors beyond the requirement that subcontractors maintain identical policy limits, terms, and conditions. All required coverages must identify Volusia County as additional insured and maintain waiver of subrogation provisions, ensuring the County's risk mitigation and recovery rights are protected throughout the project duration.
