L.3 GENERAL INSTRUCTIONS

General Offerors shall submit a written proposal as described in this solicitation. The proposal shall be presented in a clear and logical manner. Offerors are cautioned that statements such as “will comply”, “will meet the intent of”, or other such paraphrasing will not be acceptable. The technical portion of the proposal shall contain sufficient information to enable the evaluators to make a complete analysis of the proposal.

By submission of its offer in accordance with the instructions provided in this Section, the Offeror unconditionally assents to the terms and conditions in this solicitation document and in any attachments, hereto.

The Government intends to evaluate proposals and make award without discussions. However, the Government may determine that it is necessary to conduct discussions. In that case, the Contracting Officer will establish a competitive range and conduct discussions with the firms in that range. Up to eight MATOC awards will be made to the Offerors whose proposal provides the greatest overall value to the Government based on the Technical and Price evaluations. To achieve best value the Government will trade off price with all other technical factors to determine the best overall value to the Government. The Government reserves the right to award to an Offeror with a lower scored proposal to ensure the best value to the Government, for example, to obtain adequate coverage for all states covered by the MATOC.

Contractor Teaming Arrangements are permitted in accordance with Federal Acquisition Regulation (FAR) 9.6. Contractor Team Arrangement,” (CTA) means an arrangement in which two or more companies form a legally binding agreement to act as a potential prime contractor.

Project: Western Region Pavement Preservation MATOC

For the purposes of this solicitation, this definition is limited to FAR 9.601(1). CTA’s where a potential prime contractor agrees with one or more other companies to have them act as its subcontractors under a specified Government contract will not be accepted. Proposals submitted by a CTA Offeror, that meets the initial compliance review, will be evaluated as a CTA for the purposes of the non-price factors. The CTA will provide submittals, as applicable, for each evaluation factor. Documentation to support evaluation factors may be submitted for each individual firm and/or the CTA itself.

No requests for additional information or clarification to any other government office, consultant, employee or agency will be considered.

Fax or Email questions to:

FAX: 360.619.7932

Email WFL.Contracts@dot.gov for general information.

Email wfl.plans-spec@dot.gov for technical information.

Discrepancies If an Offeror believes the requirements in this solicitation contain an error, omission, or are otherwise an illogical statement, the Offeror shall immediately notify the Contracting Officer (CO) in writing with supporting rationale.

Type of Contract The Government contemplates award of up to 8 Multiple Award Task-Order Contracts (MATOCS) resulting from this solicitation.

Amendments All amendments to this MATOC solicitation will be issued electronically on the Federal Business Opportunity (FBO) website. The Offeror shall acknowledge receipt of all amendments on either the SF 1442 (block 19) or by signing the amendment form (SF 30). Failure to acknowledge receipt of amendments may result in rejection of your offer.

Cross Referencing To the greatest extent possible, each element to be evaluated in the proposal shall be written on a stand-alone basis so that it may be evaluated with a minimum of cross-referencing to other elements of the proposal. Cross-referencing within a proposal volume is permitted where its use would conserve space without impairing clarity. Information required for proposal evaluation which is not found at the relevant element, may be assumed to have been omitted from the proposal.

Source Selection Evaluation Process The source selection process will utilize the Best Value Tradeoff Source Selection process identified in FAR Part 15.101-1.

mailto:WFL.Contracts@dot.gov mailto:wfl.plans-spec@dot.gov

L-4

Step 1: The Government will conduct an initial review of the proposals and determine if the offer meets the minimum requirement and is compliant with the requirements in the RFP. Noncompliance with any of the RFP requirements may raise serious questions regarding an Offeror’s technical and/or cost performance and may be grounds to eliminate the proposal from consideration for contract award. Completion and submission of an offer (proposal) will indicate the Offeror’s unconditional assent to the terms and conditions in this RFP, including all amendments. Offerors will be notified of their exclusion from further evaluation and consideration for award.

Step 2: The Government will evaluate all compliant proposals against the non-price evaluation factors contained in section M of this solicitation.

Step 3: Proposals will be scored and ranked in order for all non-price factors.

Step 4: The Source Selection Authority (SSA) will evaluate price based on the Task Order RFPs issued in conjunction with this MATOC RFP:

1. Solicitation #: DTFH7017R00016 Project Number: CA NPS PP JOTR 2017(1) Project Name: Pavement Preservation Joshua Tree

2. Solicitation #: DTFH7017R00010 Project Number: MT PARK 486(1) Project Name: Mill Creek Road Surface

The Government will complete a comparative analysis of pricing received for each project to determine price reasonableness.

Step 5: Pricing determined to be reasonable will be ranked within each project from lowest to highest.

Step 6: The Government will conduct a tradeoff between technical and price factors and select the proposals for MATOC award which represent the best value to the Government. Two MATOC awards are reserved for small business. The two small business firms determined to represent the best value will be awarded independent of the ranking of the large business firms.

Project Task Orders being used for the price evaluation for this MATOC solicitation will be awarded to the Offeror with the lowest price received for that particular project where the Offeror will be awarded a MATOC contract.

Step 7: The Government will conduct a responsibility determination and award the MATOCs and both Task Orders solicited for the price evaluation to responsible Offerors.

Responsibility Determination:

Award shall not be made to any Offeror failing to be determined responsible in accordance with FAR 9.104. As part of this determination, all contractors must have adequate financial resources to perform the contract or the ability to obtain them.

L-5

Proposal Retention In accordance with FAR Subpart 4.8 (Government Contract Files), the government will retain one copy of all unsuccessful proposals. Unless the Offeror requests otherwise, the Government will destroy extra copies of unsuccessful proposals.

Cost of Proposal This solicitation does not commit the Government to pay any costs incurred for preparation of proposals.

Debriefings In accordance with FAR 15.505 & 506, Offerors excluded from the competitive range or otherwise excluded from the competition during the technical evaluations may submit a written request for a pre-award debriefing to the Contracting Officer. After award, unsuccessful Offerors may submit a written request for a post-award debriefing to the Contracting Officer.

When requested unsuccessful Offerors will be debriefed and will be furnished with the basis for the selection decision. Debriefing information will include the Government's evaluation of the strong and weak or deficient factors in the Offeror's proposal; however, item-by-item comparisons with other Offeror’s proposals will not be made. Bid tabs will not be released.

Debriefings will not reveal the relative merits or technical standing of competitors or the evaluation results of competitors. Debriefings will not reveal any information that is not releasable under the Freedom of Information Act.

Submission of Offers Each Offeror shall submit an offer that fully addresses the evaluation criteria contained in this solicitation and complies with the submission instructions contained in this section. Offerors should carefully review this section and its relationship to the evaluation criteria, Section M, prior to commencing proposal preparation. This solicitation does not commit the Government to pay any costs incurred for preparation or submission of proposals.
