About this file
This is a draft progressive design-build agreement between the Washington Suburban Sanitary Commission (WSSC Water) and a design-builder for the Rehabilitation of the 102-Inch Anacostia Trunk Sewer (Phase II) located in Lower Anacostia, Prince George's County, Maryland. The project involves the design, construction, and commissioning of approximately 6,620 linear feet of trunk sewer rehabilitation, including field investigations, evaluation of alternatives, report preparation, permitting assistance, and construction of the rehabilitation. The contract is structured in two stages: a Preliminary Stage lasting 325 working days from the effective date, and a Completion Stage lasting 390 working days after owner approval of the binding completion stage price. The preliminary stage includes study and report services, preparation of preliminary technical documents at 30% and 70% design completion levels, early work packages, and construction planning services. The deadline for sealed responses is 2:00 p.m. on Tuesday, June 23, 2026, submitted through WSSC's eProcurement Portal.
The preliminary stage price is comprised of stipulated prices for four submittals, an allowance of $300,000 for additional engineering services, and an allowance of $700,000 for preliminary construction or field work. The completion stage price will be negotiated following preliminary stage completion and must be accepted by the owner or negotiations may proceed; if no agreement is reached, the contract terminates for convenience with the design-builder receiving full payment for preliminary stage work and the owner retaining rights to preliminary technical documents and field investigation data. Liquidated damages are assessed at $2,390 per day for delays in achieving substantial completion and final completion during the completion stage. The design-builder is required to obtain performance and payment bonds equal to the completion stage price and maintain professional liability insurance. Maryland prevailing wage requirements apply. The contract includes provisions for an owner's completion contingency of $0.00 and requires the design-builder to maintain detailed accounting records for three years following final payment.
