About this file

This is an AIA Document B101-2017 Standard Form of Agreement Between Owner and Architect executed on March 4, 2024, between the West Virginia Department of Transportation (Owner) and McKinley Architecture and Engineering (Architect) for the renovation and HVAC replacement of the District Two Headquarters located at 801 Madison Avenue, Huntington, WV 25704. The project scope encompasses renovations to DMV spaces with relocation of offices, expansion of public space, creation of new accessible public restrooms, renovation of a first-floor area for Parole operations with separate controlled entry, and comprehensive upgrades to plumbing, mechanical, and electrical systems. The initial construction budget is $11,600,000. The design phase completion milestone is September 4, 2024, with construction commencement scheduled six weeks thereafter. Substantial completion is anticipated eighteen months after Notice to Proceed, with recent delays in mechanical and electrical equipment delivery factored into the construction duration. The procurement and delivery method is Design-Bid-Build. The Architect identified representatives include Thom Worlledge, AIA (Senior Architect) and Bill Murray, PE. The Architect shall retain Structural, Mechanical, and Electrical Engineers as part of Basic Services.

Architect compensation for Basic Services is established at a fixed fee of $650,260 according to the attached Fee Schedule Addendum B, based on the scope described in Addendum A. Supplemental Services are provided on an hourly basis mutually agreed upon by the Owner and Architect. Reimbursable expenses include transportation, travel, communication services, permitting fees, printing, reproductions, and other project-related expenditures, compensated at actual cost plus fifteen percent. Progress payments for services are due thirty days from invoice receipt. The agreement is governed by West Virginia law, with dispute resolution initially through mediation via the American Arbitration Association's Construction Industry Mediation Procedures, and if unresolved, proceeding to binding arbitration. The agreement incorporates AIA Document A201-2017 (General Conditions of the Contract for Construction) and State of West Virginia Supplementary Conditions to AIA Document B101-2017, establishing order of precedence for contract documents. The agreement terminates one year from Substantial Completion unless extended or terminated for cause with seven days' written notice.
