About this file
This is a Designation of Confidential and Proprietary Information form submitted by a vendor to the State of Wisconsin Department of Administration, Division of Enterprise Operations, in response to Bid/Proposal #E17-062-OP for a ticketing solution for the University of Wisconsin-Milwaukee Peck School of the Arts. The vendor is requesting that specific pages of their bid response be treated as confidential and proprietary information under Wisconsin Statutes section 19.36(5), qualifying as trade secrets or information protected under the Wisconsin Open Records Law. The form identifies the bidder's intent to protect information that derives independent economic value from not being generally known and is subject to reasonable efforts to maintain secrecy.
The vendor acknowledges that pricing information automatically becomes public upon bid opening and cannot be kept confidential. The form requires the vendor to identify specific page numbers and topics designated as confidential; failure to complete this form may result in all bid materials being subject to public examination and copying. The vendor agrees to provide legal counsel or assistance to defend the confidentiality designation and to hold the state harmless for any costs or damages resulting from the state's agreement to withhold the materials. The form must be returned to the State Bureau of Procurement and serves as the sole acceptable method for designating confidential information, with other markings considered insufficient by the state.

The attached material submitted in response to Bid/Proposal #E17-062-OP includes proprietary and confidential information which qualifies as a trade secret, as provided in s. 19.36(5), Wis. Stats., or is otherwise material that can be kept confidential under the Wisconsin Open Records Law.
